The 2015 shooting figured prominently in President Donald Trump’s run for the White House four years ago. The case against Jose Ines Garcia Zarate on federal gun charges has been pending since a judge raised “serious concerns” about Garcia Zarate's mental capacities back in January. Two doctors have diagnosed Garcia Zarate with schizophrenia and found him unfit to stand trial. The San Francisco Examiner reports that Garcia Zarate told the court Friday through a Spanish interpreter that he wanted to be sentenced to prison or deported back to Mexico. 720

San Diego will seek to invalidate its landmark pension law, a citizens' initiative 65 percent of voters approved in 2012.The City Council voted 6-3 Monday to go to court to invalidate 2012's Proposition B, which switched most new hires from a pension to a 401(k) style plan. Firefighter John Hernandez II said he's seen a number of his colleagues leave for other departments, which offer better benefits - namely a pension."In my line of work, we can't work as long as most people, and that's why we need pensions," he said. But Councilman Scott Sherman, who voted to protect Prop B, said ultimately going back to pensions could cripple the city. "Every single year we make a 0 million minimum payment on our pension debt from the old system that too us to that point, and now they're asking us to go right back to that system," he said.Sherman said it's low unemployment, not a lack of benefits, leading to the city's worker retention issues. Former City Councilman Carl DeMaio, a major proponent of Prop B, said he would seek to defend the measure in court. 1722

  

SAN DIEGO — A lawsuit was announced Monday over the death of Roxsana Hernandez, a transgender woman who died in Immigration and Customs Enforcement custody earlier this year as she sought asylum at the border.Hernandez arrived at the U.S.-Mexico border in San Ysidro in May from her native Honduras, but Transgender Law Center Director Lynly Egyes said Hernandez “came to the U.S. seeking protection and instead was met with torture.”"An independent autopsy report reveals that Roxsana was shackled for a long time and very tightly, enough to cause deep bruising on her wrists. She also had deep bruising Injuries consistent with physical abuse with a baton or asp while she was handcuffed, according to an examination of the tissue by an independent expert board-certified forensic pathologist," Egyes said.According to attorneys, Hernandez died from dehydration after being denied water and medical care.Hernandez, who was HIV positive, became very ill as she was transferred from California to Texas, back to California, and then to New Mexico, where she died.Hernandez’s family is hoping the wrongful death lawsuit will provide answers as to what happened. The suit was filed against the state of New Mexico.With many LGBTQ migrants arriving in Tijuana to seek asylum, many advocates hope the lawsuit announcement serves as a reminder that they will be watching as LGBTQ migrants present themselves at various ports of entry along the U.S.-Mexico border."Her death was entirely preventable," Egyes said. 1525

  

SAN DIEGO (KGTV) — A Poway gun store is set to sell 1 million rounds of ammunition by the end of the year.It’s called the “1 million round month.” Managers at Poway Weapons and Gear Range are stocking up for the sale that begins on Black Friday. Customers can get their hands on all the ammunition they need before changes come to gun stores next year. The law, which kicks off in July 2019 says, in addition to a gun permit, gun owners will have to pass a background check to buy ammo.RELATED: March poll shows how San Diegans?feel about gun control“Then when they buy ammo we have to log into a database and report how much ammo they buy,” says Danielle Rudolph, Director of Sales Operations at the store.The data logged will then be sent to the Department of Justice. “We need to remain vigilant that guns and ammunition don’t get in the hands of people that shouldn’t have them,” says Ron Marcus with San Diegans for Gun Violence Prevention. Gun control activists say the new law is an important move toward safety. Poway Weapons and Gear range say the ammunition will be sold at a discounted price for the sale.  1150
