SAN DIEGO (CNS) - A San Diego-based telemarketer was fined nearly million by the Federal Communications Commission Wednesday for making more than 47,000 robocalls over a two-day period leveling false accusations against a local state Assembly candidate and manipulating caller ID information to appear as though a competitor was making the calls.Kenneth Moser and his company, Marketing Support Systems, were fined ,997,750 for making the calls on May 30 and May 31, 2018, about one week prior to the primary election, in which Philip Graham unsuccessfully sought to represent the 76th Assembly District.Shortly before the primary, a woman accused Graham of kissing her against her will in an Encinitas bar, triggering a sheriff's department investigation that concluded the claim was unfounded. Nichole Burgan, the woman at the heart of the allegation, later pleaded guilty to filing a false report.According to the FCC, the robocall messages repeated Burgan's claim and caller ID information was manipulated to make the calls appear as though they originated from another telemarketing company, HomeyTel, described as a competitor to Moser's company. Fraidoon Ahmad gave alcohol to Yolanda Lozano and Mabel Bahena, both 19, on Feb. 17, 2017. Lozano later drove while drunk and collided with a truck on Interstate 15, killing Bahena. Lozano pleaded guilty to gross vehicular manslaughter while intoxicated and was sentenced to one year in custody, with Bahena's family asking a judge for leniency as the two women had been best friends since grade school. Ahmad pleaded guilty in May to misdemeanor charges of furnishing alcohol to a person under 21 and furnishing alcohol to a minor causing great bodily injury and death. SAN DIEGO (CNS) - A transient who allegedly overpowered a woman in the East Village, dragged her into some bushes and sexually assaulted her before running away pleaded not guilty Tuesday to three felony charges, including assault with intent to commit rape.Gary Ryan Cushinberry, 51, who is on felony probation for robbery and failing to appear in court, was ordered held without bail.Late on the evening of Nov. 5, Cushinberry allegedly grabbed a 26-year-old pedestrian walking by herself in the 400 block of 13th Street, pulled her off the sidewalk and assaulted her before fleeing.Detectives identified Cushinberry -- a recent transplant from Indiana who has been living on the streets of San Diego -- as the alleged perpetrator by means of ``several tips and leads,'' Lt. SAN DIEGO (CNS) - County environmental health officials issued a water contact closure Friday along the Tijuana Slough National Wildlife Refuge and Border Field State Park due to sewage-contaminated water. The San Diego County Department of Environmental Health issued the closure Friday afternoon following rainfall this week that caused contaminated water in the Tijuana River to flow into U.S. waterways. County officials regularly issue beach closures after rainstorms due to contaminated flows from the river. The closure extends along the shoreline from the U.S.-Mexico border to the southern end of Seacoast Drive. County officials have placed water contact closure signs to alert beachgoers of the water's contamination. The signs will remain in place until water sampling meets state health standards.
