SAN DIEGO (KGTV) - On Monday, San Diego County supervisors met privately to discuss options if the county is moved back into the most restrictive tier.Although the meeting is taking place behind closed doors, it's not stopping them from sharing their frustrations publicly.At a press conference on Monday morning, Supervisor Nathan Fletcher called the actions of two of his fellow board members reckless and irresponsible."Supervisors Jim Desmond and Kristin Gaspar are inciting a fight between government and small business," Fletcher stated. “They are exploiting the pain and suffering the small businesses are going through as a result of the global pandemic as a wedge for political gain."Responding to the statements made at the press conference, Supervisor Kristin Gaspar said that she's never supported an approach to reopening that was not supported by the Public Health Officer and clinical leadership team.In a statement, Gaspar wrote, "Supervisor Fletcher knows this but prefers to continue spreading this false narrative because he is actively running a campaign against me. I measured the distance between our office doors, and it is 7 feet, so he and I can actually have a socially distanced conversation anytime he isn't holding a press conference."The public display of animosity comes as supervisors continue to discuss different options, including taking legal action against the state, to prevent potentially sliding back into the most restrictive risk level.Fletcher is against any potential legal action; Gaspar is for it.A spokesperson from Supervisor Jim Desmond's office said Desmond is weighing the options and waiting to hear any potential ramifications.On Monday, Supervisor Dianne Jacob told 10News, "I will do what is legally possible and where we are on solid legal ground. We do have a good solid legal option here."Jacob said the colleges and universities have a choice whether to allow students back on campus and hold in-person classes. She explained businesses have no choice, and she will fight to keep them open.A spokesperson for Supervisor Greg Cox told ABC 10News they wouldn't comment before the closed-door meeting.Legal actions by citizens and government entities against the state aren't uncommon.ABC 10News has reported on businesses and churches suing Gov. Gavin Newsom.At the end of July, the Orange County Board of Education voted to file a lawsuit against Gov. Newsom and the California Public Health Officer to seek a court order that sets aside the state orders preventing public schools from holding in-person classes and resuming services on campus."There's precedent from before the pandemic and during the pandemic for the county and other local governments to file suit against the state government to try to get the courts to weigh in on who holds the reins," said Lindsay Wiley, Professor of Law at American University Washington College of Law.Wiley said if the county did file a lawsuit, it's likely the courts would defer to the governor based on recent rulings."These cases are unpredictable and there's a fair bit of discretion left to the courts to decide these issues," Wiley said. "It's hard to say much given that we haven't seen what the complaint is that the county might bring but for the most part the general trend has been to uphold reasonable orders of this type." 3346

SAN DIEGO (KGTV) -- Protesters will be out in full force Saturday protesting the Crossroads of the West gun show in Del Mar.The protest is set to begin at 10:30 a.m. on Jimmy Durante Boulevard and Villa De La Valle.In years past, gun control advocates have targeted the show aiming to have the fairgrounds cancel the event.In 2016, a group of gun control advocates lobbied the Del Mar Fairgrounds board to end the shows saying the venue is inappropriate for a gun show."They glamorize the gun culture and help put more guns and more ammunition into the society. We don't believe the public facilities of the fairgrounds should be used for a purpose that is harmful to the public health and welfare," said Wayne Dernetz, of a group called Advocates for Gun Safety.Saturday’s gun show begins at 9 a.m. and will last until 5 p.m. 834

SAN DIEGO (KGTV) — Police say they have made an arrest in connection with a deadly shooting in the Midway District during a meeting set up on social media.San Diego Police arrested 18-year-old Angel Garcia of San Diego on Wednesday and charged him in the murder of Eduardo Salguero, 18, of San Diego, on Nov. 25.Police say Salguero had arranged to purchase an item through Snapchat and met for the transaction behind several businesses in the 3600 block of Midway Dr. When he arrived, two Hispanic males entered his vehicle. During the meeting, one of the suspects pulled out a handgun and the transaction turned into an armed robbery.RELATED: Midway District shooting victim killed during Snapchat transaction, police sayMultiple gunshots were fired inside the vehicle before the two suspects fled. Salguero was taken to a nearby hospital but died of his injuries.Both suspects were described the suspects as Hispanic males, between 20-30 years old, who were wearing dark clothing at the time. SAN DIEGO (KGTV) — Padres all-star pitcher Kirby Yates will be out of his comfort zone Sunday night when he and his wife, Ashlee, host a night of stand-up comedy. The event will raise money and awareness for a cause very close to the Yates' heart: Epilepsy.One night in 2018, the couple was asleep when Kirby heard Ashlee begin making strange sounds. It went from that to a seizure. She was pregnant with their second child at the time."It's the first time I'd ever been involved in anything like that," Yates told 10News. "It's hard to see your wife, she's pregnant with our son, and you have feelings that you've never had before.""He was definitely terrified," Ashlee said. "I obviously don't remember it, but I just know he had a very hard time with that."After a myriad of tests, Ashlee was shocked to be diagnosed with epilepsy. "I didn't know it was random and can come at any time or age," she recalls.When searching for ways to cope with the diagnosis, Ashlee turned to one of her favorite things: Stand-up comedy. She had performed at clubs before, but began integrating humor about her condition into her act. "That was actually my outlet. As soon as this happened, that was the first thing I did. I was like, I need to do something drastic to deal with this and I don't know what those options are," Ashlee said. "I like to make people laugh. I like to have fun, so this seemed like a good fit."That led to the decision to host "Comedy for a Cause", which will take place Sunday night at the American Comedy Co. in the Gaslamp. Ashlee will perform with two other well-known San Diego comedians. Kirby and several of the biggest Padres stars will be in the crowd. They also will likely be the biggest targets for the comics' humor, "I know they're big Padres fans, so I'm sure they've been following the season and have some good jokes," Ashlee said. "I did suggest a roast on Kirby.""I told them they can roast me as much as they want and it's fine," Kirby responded. SAN DIEGO (KGTV) -- Police are asking that additional victims come forward in a San Diego sexual assault case. According to police, Seth Roberts, 18, was arrested on December 5 for multiple sexual assaults around San Diego County that happened between early October and late November. Based on the circumstances of the cases, the San Diego Police Department Sex Crimes Unit is looking for additional victims or anyone with information. According to police, Roberts reportedly identified himself to young women and befriended them by telling them he’s from out-of-state before sexually assaulting them. According to public records, Roberts was previously arrested in Oklahoma for harboring a runaway child felon. Records also show that in April of 2018, a permanent protective order was issued against Roberts in Oklahoma. The order was filed on behalf of a 16-year-old who says Roberts inappropriately touched her even after she asked him to stop. The protective order goes on to say the victim's mother wanted criminal charges filed, but none are listed. He is currently being held on ,250,000 bail.
