(KGTV) A witness is disputing the claim that a July 4th incident in an El Cajon neighborhood was a racially motivated attack.On Lima Court on the night of July 4th, families were getting set to view a nearby fireworks show. Scott, who was visiting family, says that for hours, neighbors had been dealing with drivers speeding through the area."Bunch of people telling were telling the cars that were passing through. The woman in the passenger seat, Alana Christman, says they were driving slowly. The man at the wheel was her fiance, William Gavin. Their two young children were in the back."I was looking down at the GPS and we heard, 'You can't come in our neighborhood,'" Christman told 10news in an interview Monday.She says at that moment, a man threw a lit cigarette, which landed on her blouse, the ashes filling up the vehicle. Surveillance video obtained by 10news shows Gavin was outside the vehicle moments later.While Gavin says the man he believed tossed the cigarette, took the first swing, Scott says he saw Gavin swing first."Hit him, threw him to the ground, then kicked him in the chest," said Scott.In the video, a group of people are seen following Gavin to the SUV. Christman calls the group a 'mob,' attacking the SUV and ripping the door off its hinge. Scott says the group was just trying to prevent the man from leaving the scene."Everyone tried to get him to stop for a second. The door was damaged in the process of car trying to pull off and speed off, and ended up hitting a lady in the process," said Scott.Police say a woman suffered minor injuries. The family says they pulled around the corner to get to safety and called police. They told 10news they felt the incident was racially motivated. Scott believes the spark was the speeding cars."People of all races were yelled at that night. It was preventing people from being jerks. It wasn't anything to do with race. It was trying to keep safety for the kids," said Scott.Police say there is "no indication the incident was racially motivated." A spokesperson says the investigation is ongoing and they're looking into the alleged cigarette tossing and a possible hit-and-run case. DUNCAN, Okla. -- Rural hospitals faced unique challenges preparing for a rush of COVID-19 patients. From financial struggles to attaining PPE, smaller facilities did everything they could to get ready.One regional hospital in Oklahoma has waited for months for coronavirus cases to flood their emergency room, but that wave of patients is just now starting to trickle in.“We saw cases increasing, but as of now, it hasn’t come to Duncan quite like we expected,” said Dr. Michael Hemphill, a pulmonary and critical care physician and Duncan Regional’s Director of the ICU.As coronavirus cases overload emergency rooms across the country, this rural hospital—one of few medical centers in Southern Oklahoma—has only seen a handful of cases. After the holiday weekend, their facility is starting to see cases increase.As they wait for the surge, the fear of what would happen if beds or supplies ran out looms over the staff.“The most difficult thing is, there’s not a lot of backup,” said Hemphill. “I’m the only pulmonogist in Duncan,” he said.So, the hospital gathered as much personal protective equipment as possible—preparing for the worst.Chief Nursing Officer Kristen Webb said it’s been tougher to get critical supplies as a smaller hospital.“The last time we were able to receive N95’s was probably in December,” said Webb. She said they needed them again come February, but were never able to fill any of the orders they placed.When she was able to find supplies, she spent every penny she could to make sure staff would be safe.“We probably spent close to a million dollars on equipment, PPE, or other supplies and equipment towards a pandemic that we didn’t fully realize at this point,” said Webb.That massive expense was made tougher because the hospital had to cancel all elective procedures and appointments.“We spent quite a bit of money at a time where we weren’t bringing in our normal resources,” said Webb.“Rural hospitals are especially financially strained, especially here in Oklahoma, so when everything shut down…our elective procedures shut down. So, there is a financial burden the hospital had to bear,” said Dr. Hemphill.The burden extends past these walls to Jefferson County Hospital. Duncan Regional helps the critical access hospital stay open. It’s a facility with only 18 beds that was on the verge of shutting down just a couple years ago.But if the pandemic hits, that critical access facility and Duncan Regional are the places people will turn to. So it’s necessary these facilities maintain enough revenue to stay open so communities have access to care. 2601

Dramatic moments in a San Bernardino courtroom today as a prosecutor slammed a sledgehammer onto a table. He was simulating what he says is how a Fallbrook family of four was murdered in 2010. Charles Merritt is accused of killing his business partner, Joseph McStay, his wife Summer and their two young sons Giani and Joe Jr. The prosecution says Merritt was being sidelined from the business and owed thousands of dollars to McStay. The defense countered in their closing arguments that the prosecution focused on trying Merritt’s character and not the actual facts of the murder. The defense told jurors the circumstantial case produced no evidence tying their client to the family’s violent deaths. The prosecution told jurors they didn’t have to prove how, where or when the murders took place, only that Merritt committed them. The McStays disappeared from their Fallbrook home in early February 2010. Days after they were last seen, the family’s SUV was found abandoned at a strip mall parking lot in San Ysidro.In 2013, the bodies of the family members were found in the Mojave Desert, near Victorville. Prosecutors said the family died from blunt-force trauma to their heads. Authorities found a sledgehammer, believed to be the murder weapon, in one of the graves.Merritt was arrested in connection with the killings in November 2014 after sufficient evidence linking him to the case, including DNA, was discovered.Authorities alleged Merritt killed the family members inside their home and then buried them in the desert. Merritt also tried to paint over the crime scene, according to authorities.Merritt, 61, has pleaded not guilty to charges of murder and is being held without bail.Prosecutors are seeking the death penalty in the case. 1758
