SAN DIEGO (CNS) - A man who was operating a panga boat carrying several undocumented immigrants when it capsized off the coast of southern San Diego County earlier this year, killing two men aboard, was sentenced today to nearly seven years in federal prison.Julio Cesar Murillo-Arce, 42, pleaded guilty earlier this year to federal charges stemming from the Feb. 3 boating accident off the coast of Imperial Beach.He was sentenced to 78 months in prison in connection with the boat fatalities, and an additional five months for violating the terms of his supervised release stemming from a separate maritime alien smuggling conviction last year, according to the U.S. Attorney's Office.According to court papers, Border Patrol agents spotted the boat in the early morning hours of Feb. 3. It began experiencing engine trouble about 150 yards off the coast, prosecutors said, then eventually became inoperable.Prosecutors say Murillo-Arce told the others aboard not to identify him as the boat's captain, then dove into the water.The boat was capsized by a large wave, sending all six occupants into the sea. Four were able to make it to shore, but Ramon Ponce-Rodriguez and Modesto Rodriguez-Ballesteros did not.Ponce-Rodriguez was pronounced dead on arrival at a hospital, while Rodriguez-Ballesteros was initially hospitalized in critical condition and died Feb. 4.The surviving occupants of the boat told investigators that the boat's captain abandoned the vessel and swam away, despite being told some of the people aboard could not swim. SAN DIEGO (CNS) - A United Airlines flight scheduled to take off from San Diego International Airport was diverted from the runway just before departure Friday due to an undisclosed mechanical issue with one of the plane's engines.Flight 478 was scheduled to take off for Denver shortly before noon, but was recalled while on the airport's taxiway. The plane was safely escorted back to the airport's terminal and the issue occurred at low speed, according to United.``The aircraft safely returned to the gate and customers deplaned normally,'' a United spokesperson said in a statement. ``We are making arrangements to get our customers to their final destination as soon as possible.''Roughly 120 passengers were aboard the flight. SAN DIEGO (CNS) - An ex-con accused of sexually assaulting a 24-year-old woman in broad daylight on a Mission Beach street pleaded not guilty Thursday to a charge of assault with intent to commit a sex crime. Philemon Shark, 40, who has two prior convictions from Washington state for residential burglary from 2014 and 2015, faces life in prison if convicted, said San Diego County Deputy District Attorney Trisha Amador. Judge Joseph Brannigan set Shark's bail at million and ordered the defendant to have no contact with the alleged victim. Amador said all sexual assaults -- no matter what level -- are ``serious'' and taken ``exceptionally serious'' by the District Attorney's Office. ``I think part of the concern is that when an individual is attacked in broad daylight in an area where they felt safe or did not feel a threat, of course that's added concern, but our office takes all sexual assaults equally as serious,'' the prosecutor said outside court. The attack happened about 8:40 a.m. last Sunday on Bayside Lane near San Jose Lane, just off Mission Boulevard, according to San Diego Police Lt. Jason Weeden. Weeden said the victim was walking south when Shark allegedly approached her from behind, threw her to the ground and held her down while he assaulted her. The woman screamed for help, and several residents forced the man off her, the lieutenant said. When Shark tried to leave, some of the residents followed him but lost track of him, Weeden said. Then, about 45 minutes after the attack, one of the neighbors found Shark hiding in a breezeway. Shark allegedly fled but was apprehended by patrol officers and booked into jail. Weeden said Shark is from the Seattle area and was believed to have been living in San Diego for the last few months. SAN DIEGO (CNS) - Cleveland National Forest officials Saturday announced elevated fire restrictions until Jan. 1, 2021, and ordered the closure of Three Sisters & Cedar Creek Fall Trails after a heat advisory was issued by the National Weather Service.The trails will be closed until Sunday, officials said."These restrictions are put into effect to provide for emergency resource protection and public safety during hazardous fire conditions," a forest official said.The new restrictions include:No smoking, except within an enclosed vehicle or building, or within a developed recreation sites; No welding or operating an acetylene or other torch with an open flame;No target shooting, discharging a firearm, air rifle, or gas gun;No building, maintaining, attending, or using a fire, campfire, or charcoal fire except within a developed recreation sites;No wood or charcoal fires are allowed except in identified developed campgrounds and developed picnic areas within designated fire rings.The Cleveland National Forest encompasses 460,000 acres and is the southernmost U.S. National Forest in California.
