The driver eventually got out. It appeared that officers used a stun gun on him, prompting him to get back into the car.A standoff pursued and eventually ended after the man got out of the car, laid down for a while and tried to run away. CARLSBAD (CNS) - The Army and Navy Academy agreed to pay .75 million to settle a lawsuit filed by a former cadet at the Carlsbad-based military school, where the cadet was allegedly sexually assaulted in 1999, the law firm representing the cadet announced today.The civil suit, filed by Irvine-based law firm Manly, Stewart & Finaldi, alleged that 60-year-old Jeffrey Barton, who was an administrator in charge of academics at the academy, molested the cadet when he was a ninth-grader in 1999, the law firm said in a statement.The lawsuit alleged that Barton drugged the cadet in May 1999 and sodomized him in a bathroom on campus.In a criminal case involving the cadet, Barton was convicted in June 2017 of five felony counts of oral copulation and one felony county of sodomy.He was sentenced to 48 years in prison in August 2017.Manly, Stewart & Finaldi also represented a former cadet of the Carlsbad-based academy in a separate civil suit in 2017. (KGTV) -- A 16-year-old girl and a 19-year-old man were arrested in connection with the shooting death of a young man in Carlsbad, police announced Friday.Just before 7:30 p.m. Thursday, police and fire crews were called to the 2300 block of Caringa Way in response to a report of an injured person at an apartment complex.The injured person, an 18-year-old man, was found in the complex’s courtyard with a gunshot wound, police said.Kelly, an apartment resident, told ABC 10News, “I was fixing dinner. I looked out the kitchen window and he was on the ground. I started performing CPR, but it was too late.”The victim was transported to the hospital, where he was pronounced dead. His identity was not released.Following an investigation, Carlsbad police detectives identified two people linked to the man’s death and arrested them.According to police, a 16-year-old girl was booked into Juvenile Hall on suspicion of manslaughter and gross negligent discharge of a firearm.Gerardo Gonzalez, 19, of San Marcos, was booked into Vista Jail on a felony child endangerment charge.No other information was made available as the incident remains under investigation. 1186
California will end the cash bail system in a sweeping reform for the state. Rather than requiring defendants to pay in order to be released before trial, their release will hinge on an assessment of their risk to public safety."Today, California reforms its bail system so that rich and poor alike are treated fairly," Gov. Jerry Brown said in a statement.Brown signed the bill Tuesday, and the new law goes into effect October 1, 2019.Critics have long contended that the money bail system perpetuates inequality. While some people are able to quickly get out of jail by posting bail, people who aren't able to afford it sit in jail until the court takes action, or until they work with a bail bond agent to secure their freedom, which can leave them in debt."Abolishing money bail and replacing it with a risk-based system will enhance justice and safety. For too long, our system has allowed the wealthy to purchase their freedom regardless of their risk, while the poor who pose no danger languish in jail," said Assemblymember Rob Bonta, one the lawmakers who introduced the bill, in a statement.Under the new law, a pretrial assessment would be done by either court employees or a local public agency that has been contracted to determine a defendant's risk. That entity would assess the likelihood that the person will not appear in court or commit a new crime while released, and would make a recommendation for conditions of release. The pretrial assessment services will not release a person arrested for violent felonies.The California Money Bail Reform Act, also known as Senate Bill 10, passed in the State Senate with a vote of 26-12, and the General Assembly by 42-31."SB 10 puts all Californians on equal footing before the law and makes public safety the only consideration in pretrial detention. Businesses may be reopening, but they're still struggling to pay their rent.About 40% of major retailers didn't pay their rent in May, according to numbers from data firm Datex Property Solutions.Some companies are warning they won't be able to pay rent for months. Starbucks for example is asking for landlords to adjust lease terms and rent for at least 12 months.It's an even worse situation for some small businesses.“I would think landlords ordinarily are not that sympathetic, right, because they can get somebody else to pay the bill,” said Jack Strauss, an economics expert and professor at the University of Denver. “In this case, a landlord is foolish to ignore the struggling small business.”Strauss says it will be difficult for landlords to find a new tenant quickly, so they have an incentive to delay or partially reduce rent.Businesses in malls are getting hit especially hard. The country's latest mall owner recently sued Gap over three months of unpaid rent.“Being sued kind of makes sense by the landlord to take a heavy hand, but at the same time, it doesn't make sense because they're going to have a lot of, they're potentially going to have a lot of empty spaces,” said Strauss.Punchbowl Social, a national restaurant and entertainment spot just closed one location in the Denver area and one in the Chicago area, acknowledging that landlords are trying to ensure the success of their business.But the CEO says, "landlords cannot expect to maintain status quo economic terms that were negotiated in pre-pandemic times."Strauss agrees with that.
