SAN DIEGO (KGTV) -- California’s new gig economy law was meant to help rideshare drivers and other freelance workers get better benefits, but some critics say it’s threatening the spirit of Christmas itself.Those critics are mall Santas, who have traditionally been hired as independent contractors through third-party bookers or employment agencies.Under Assembly Bill 5, authored by Assemblywoman Lorena Gonzalez (D-San Diego), those workers must be reclassified as employees with insurance and other benefits.“Lorena Gonzalez, she might kill all the Santas. She might kill the Easter Bunnies,” said Steve Schafer, the president of the San Diego chapter of the Fraternal Order of Real Bearded Santas.Some Santas warn that bookers may go to great lengths to avoid paying employee benefits. “I don't know how someone can justify this,” said Jerry Tamburino, a Santa who has worked for more than a decade at a large commercial store.Tamburino said his agent notified him Tuesday that she would replace him and other Santas at a chain of California retail stores with out-of-state St. Nicks.“That's what [the booker is] being forced to do to address -- or evade -- or stay in business with this stupid law,” he said.Bringing in out-of-state workers to skirt AB-5 would violate California law, since labor laws apply to anyone performing work in the state, said Gonzalez’ office. But Tamburino said it would be hard for regulators to enforce.Malls and stores could hire Santas directly as independent contractors, Gonzalez’ office noted, since that kind of relationship passes AB-5’s three-pronged test.To do so, Tamburino said he would have to form his own LLC and said he doesn’t have the experience to run his own business.Tamburino said he would begin reaching out to other Santa-booking agencies in hopes they will hire him as an employee, but there’s a lot at stake: he receives about half of his annual income from Santa jobs. 1938

SAN DIEGO (KGTV) -- California has some of the most expensive gas in the entire country, and a new study by GasBuddy also claims the Golden State also has some of the most aggressive drivers.According to the study, California ranks number one with most aggressive drivers followed by Connecticut and Georgia.The study claims those aggressive habits are also costing Californians cold hard cash. GasBuddy says aggressive driving habits costs an additional 7 per year in fuel.The habits include hard braking, speeding and rapid acceleration.Further finding indicate that the more heavily populated the city, the more motorists drive aggressively.Check out the chart below:  687

  

SAN DIEGO (KGTV) — Bea Pesenti recently moved back to Italy after living in San Diego for more than a decade, now she and her fiance are quarantined in their apartment."I do worry about if this continues, how can we afford to live? How anyone can afford to live if you're not working," Pesenti asked.For the last two weeks she has been unable to work or leave her home, unless it's to get groceries.RELATED: FDA approves San Diego company's new coronavirus test-kit"We’ve been on lock down since March ninth," she said. "The issue that I’m starting to feel is there’s no light at the end of the tunnel."Italy's death toll has risen to more than 4,000. Pesenti said every hour she would hear ambulance sirens driving by her home, a painful reminder of the devastation caused by the coronavirus."Had we done things differently, maybe we would be looking at that end of the tunnel," she said. "It’s a huge temporary sacrifice for a lot of us, whether its losing our job, not seeing family, but it will only get us out of it sooner."The U.S. State Department issued a level four travel advisory Thursday, asking American citizens to avoid traveling internationally or immediately return to the U.S. if they are already overseas, or possibly prepare to remain abroad for an indefinite amount of time.Pensti said she and her fiance already planned to stay in Italy.
