SAN DIEGO (KGTV) — A man was rescued from the top of a section of the border wall in Otay Mesa Tuesday.Cal Fire firefighters were called to a section of barrier in Otay Mesa just before 6 a.m. Crews arrived to find one person stuck on top of the border wall structure.Crews used a 35-foot ladder to reach the man and assist him down. No injuries were reported.Tuesday's rescue comes more than a month after San Diego Fire-Rescue firefighters and Border Patrol agents helped rescue three people stuck on top of a portion of the border wall in Otay Mesa. 560

SAN DIEGO (KGTV) -- A measure that would increase San Diego's hotel tax is heading to the ballot on March 3 and a recent poll shows how San Diegans feel about Measure C. The measure also includes criminal penalties if politicians misuse the funds, according to the campaign. A new poll shows how San Diegans are feeling about the measure. The measure requires two-thirds supermajority to pass. A 10News-San Diego Union-Tribune poll shows that, as of February, 61 percent support the measure while 21 percent are opposed and 18 percent are undecided. “A majority of San Diegans are uniting behind Measure C because it is straight forward in its approach to tackling the city’s most pressing issues with a tax on tourists, not San Diegans," said Greg Block, a spokesman for the Measure C campaign. "People already know Measure C will help with homelessness, street repair and job creation by expanding of the Convention Center."Michael McConnell, an advocate for the homeless, is leading the opposition and warns the measure has “loopholes and risks.”"They are hiding up to Billion in bonds with no guarantee that money will be spent the right way," he said in a statement. "It does not even guarantee any housing and services for homeless families, seniors or veterans. We can’t trust the supporters who have taken money from a private prison company and been exposed for paying for support."Below is a breakdown of how the money would be spent: From the date the tax takes effect through the city’s fiscal year 2023-2024, the revenue from the tax would be allocated as follows: 59% to Convention Center purposes; and 41% to homelessness programs and services. The Bakala family is seeking asylum after they say they barely escaped death in the Republic of Congo. Once they reached San Diego, the family of nine was separated.17-year-old Marie Louise Bakala should be focusing on college. But right now, that is on hold. "I am getting stronger, but it is not enough because I need my father back," Mari Louise said to the St. Luke's Episcopal Church congregation in North Park. The Bakala's left a comfortable life in the Republic of Congo. Father Constantin was a computer engineer for the Ministry of Health. His wife Annie Kapongo was a shop owner and mother of seven. The Bakalas say it all changed when the new government stepped in. Kapongo says because of Constantin's occupation, the family was targeted, brutalized, and even sexually abused by Congolese authorities. Fearing for their lives, they came to San Diego in 2017 to seek political asylum."This family came across a world come to a country that will protect them, but instead, it has only been a continuing nightmare," Pastor Colin Mathewson said. Annie Kapongo was released with an ankle monitor with the seven kids in San Diego. Immigration and Customs Enforcement [ICE] authorities detained Constantin in the East Coast alone. In February, a judge rejected Constantin's asylum case and appeal. But in March, he as given an emergency stay. Just last week, he earned the right to appear in front of a judge again, this time with a lawyer. Friends and staff of St. Luke's are now pleading with ICE to grant Constantin parole, to be with his family. They say it would be a show of good faith, just as the Good Samaritan did in the Bible."There is an assistant field director, and there is a deportation officer out there in Atlanta," Pastor Mathewson said. "We are asking Christine and Michael today to help somebody that needs so much help. After 19 months of detention, to bring him back home with his family as he awaits his next court date.""I hope that he will be here with us and we will be a family again," Marie Louise said."Please, please help me," Kapongo said through a French translator. "Send me back my husband."Last year, the couple missed their 20th wedding anniversary because Constantin was detained. If he is not paroled soon, he will also miss his eldest daughter, Marie Louise's 18th birthday. The family's next court date is September 25, 2019. 10News reached out to ICE for comment on this case. SAN DIEGO (KGTV) -- A San Diego judge has ruled that demolition of the historic California Theatre would violate environmental law.The theatre, which was built in 1926, was the largest vaudeville and movie palace in San Diego.City Council approved the demolition of the theatre in 2017. The proposed demolition, however, required an environmental impact report.RELATED: San Diego approves replacement for dilapidated California Theatre?The legal challenge to the approval, filed by the Save Our Heritage Organization, said the city failed to adequately address the ability to adapt and reuse the California Theatre.The court granted SOHO’s legal petition because the review failed to comply with the California Environmental Quality Act.The demolition approved by the city would have allowed a 40-story skyscraper to be built that would have included 282 residential units."The California Theatre is an outstanding historic building that has been standing for almost 100 years, it presents many opportunities for successful adaptive reuse to revitalize the C Street corridor. When the City's EIR failed to study alternatives to demolition, we put our faith in the Court to enforce CEQA. We are grateful for the Court's comprehensive enforcement of environmental law and look forward to review of an alternative in an EIR that will allow this historic building to survive as part of a successful new project. SAN DIEGO (KGTV) -- A judge ruled Wednesday that a Navy commander will face a third trial on charges he tried to rape a junior officer in her home.John Michael Neuhart II asked the judge to dismiss all charges after a second jury was unable to reach a verdict.The judge dismissed charges of assault with intent to commit rape during burglary, burglary and resisting or delaying a peace officer.RELATED: Mistrial declared for former Navy commander accused of rapeThe judge added that prosecutors can proceed with a third trial in January on charges of attempted forcible rape and assault with intent to commit rape.Neuhart now faces six years behind bars and lifetime sex offender registration if found guilty. Neuhart had previously been facing life in prison.In the two trials combined, 21 out of 24 jurors voted to convict Neuhart. The alleged victim said Neuhart sexually assaulted her after they spent time drinking and hanging out with colleagues in 2016.RELATED: Mistrial declared in trial of former Navy commanderThe woman said Neuhart took off her pants and underwear and was physically violent with her.
