SAN DIEGO (KGTV) - 10News got an exclusive interview with the young San Diego man who says a local ICE agent pointed a gun at his head before being arrested, in part, for driving under the influence.“I’m 20 years-old and for him to pull a gun on me just for test-riding my motorcycle on the street is definitely not okay,” says Jonathan Levenson.A spokesperson for Immigration and Customs Enforcement (ICE) confirms ICE Agent Ed Zuchelli is on administrative leave while officers investigate a criminal matter.San Diego police confirm the incident happened on February 16th on Blue Lake Drive in the community around Lake Murray.Levenson says he was test-riding his dirt bike on his street when he saw the agent walk into the middle of the street to block him.“He had it pointed at me at a ‘shooter’s position’. That’s when I knew it was definitely a gun,” he tells us of the agent, who is his neighbor. “When he first came up to me I could smell some beer on his breath but nothing too strong,” he adds.Levenson says he rode around the agent, but the agent got into his vehicle and followed. “He turned on his lights and sirens and started yelling at me through his microphone. [He was] telling me he was a federal agent and not to mess with him,” says Levenson.Levenson adds that the agent showed him his federal ID badge.SDPD confirms Zuchelli was in a government-issued vehicle at the time of arrest.Police say he was arrested for alleged DUI, showing a weapon and making threats. SAN DIEGO (KGTV) — While San Diego's Big Bay Boom and other popular fireworks shows are canceled this year, there are a handful of drive-in style events happening this weekend.In Vista, Poway, El Cajon, and Santee, fireworks displays are being hosted with social distancing in mind. Some of the shows require a ticket purchase to get prime viewing in a physical distancing atmosphere, or viewers can find street parking where allowed.Those who live nearby only need to look out their window!Fireworks displays have been canceled throughout much of California to limit gatherings and curb the spread of COVID-19. SAN DIEGO (KGTV) — Wednesday a preliminary hearing began for a man accused of aiming a loaded gun at off-duty San Diego Police officers at a Mission Valley bar parking lot last November.A San Diego Superior Court Judge listened to testimony from officers in case involving the defendant Jonathan Felix. The incident happened outside of McGreggor’s Bar and Grill on Nov. 7, 2018.Wednesday, officer Jonathan Rodriquez was the first witness on the stand. Rodriguez said he had a few beers after work with coworkers that night. He said Felix was sitting about 20 feet away from the off-duty officers.Once the bar was closing they all walked out into the parking lot.RELATED: San Diego man says off-duty SDPD officers assaulted himRodriguez claims he saw Felix looking into his car or looking at his car. He said after that he and the other officers watched Felix go to his own car.“The defendant got a bicycle out of his car, I thought it was strange and he left,” said Rodrigues. “After he left he came back a second time.”Felix claims he lives nearby and uses the parking lot at that shopping center because parking is limited at his apartment complex. Rodriguez says an off-duty officer then walked over to Felix and had an “innocent conversation." He said Felix asked the officers if they’d like to smoke, but they all denied him. Rodriguez decided he did not feel comfortable being there, and says he left in his own vehicle.After that, surveillance video shows what transpired.Felix is seen having interactions with the other off-duty officers, and then he’s seen holding a gun.The officers began beating Felix, leaving him with a bloody head, several lacerations and bruises. He was arrested that night. Second on the stand was officer Andrew Duncan. He was one of the officers involved in the fight. He claims they walked out of the bar and saw Felix acting strange. Duncan says Felix left and came back saying the other officers threatened to beat him. Duncan went on to testify that's when Felix showed his gun. Then, Duncan said, all 4 officers pointed their gun at Felix then tackled him. They say they were wrestling with him to get the gun away. Tasha Williamson with Building Justice says Felix shouldn't be facing these charges, but that the officers should face assault charges because Felix wasn't doing anything wrong that night. Williamson says the officers were off-duty and should have left Felix alone.Felix is charged with two felony weapons charges for being a felon in possession of a firearm and ammunition. He’s also charged with and a misdemeanor drug charge for being in possession of a controlled substance.Before the preliminary hearing started his lawyer, Alicia Freeze, spoke outside of the courtroom.“Uniquely and I think very creatively, my client is not being charged with brandishing a weapon, he’s not being charged with assault with a deadly weapon, he’s not being charged with a lot of the initial charges he was booked under,” she said.On Jan. 4 the San Diego Police Department issued the following statement: “The San Diego Police Department submitted a criminal case to the District Attorney's Office regarding this incident, in which Mr. Felix pulled a gun on four off-duty police officers. He has been charged with unlawful possession of a firearm, unlawful possession of ammunition, and possession of a controlled substance. Mr. Felix is entitled to the presumption of innocence and the full facts of this case will be litigated as the criminal case proceeds. As in any situation where there are allegations of misconduct, the San Diego Police Department has initiated an internal investigation. If found, any misconduct will be handled accordingly.”At the end of this preliminary hearing a judge will decide if there’s enough evidence for the case to move to trial. If the case goes to trial and Felix is found guilty and convicted, his lawyer says he could be looking at one to two years in prison.Several supporters of Felix showed up to court today and plan to have a press conference following the hearing. 4063

SAN DIEGO (KGTV) -- Traffic was backed up throughout the day Monday in Clairemont after a crash involving several vehicles. The crash happened just before 1 p.m. on Balboa Avenue near Albertine Avenue. According to San Diego Police, a 59-year-old man driving west on Balboa Avenue hit a raised median and crossed into the eastbound lanes of traffic. Police say he then hit a Jeep Patriot, causing it to slam into a Honda Civic and a Jeep Cherokee. Police say the driver of the Jeep Patriot sustained a fractured femur and was taken to the hospital. Her passenger also complained of pain. No one else was injured. The 59-year-old driver of the Nissan Frontier was arrested for DUI drugs. 695

SAN DIEGO (KGTV) — Tuesday marked the the 10-year anniversary of one of the most chilling murders in the history of San Diego County.Chelsea King, 17, was raped and murdered by a registered sex offender as she was out for jog around Lake Hodges in 2010.Today, her family launched a nationwide organization called "Protect the Joy" that will work to protect children.RELATED: A decade later, remembering Chelsea King and Amber DuboisLife changed for Brent King and his wife Kelly a decade ago. Their only daughter was missing out for a run then, nowhere to be found."You can't breathe. Your whole body is shaking, your chest is as tight as it's ever been," Brent King said. "You can't be in enough places at once. Every horrible thought is running through your mind as to whats happening … you know ... Where's my little girl?"After five excruciating days came the most brutal news of all. Chelsea's body was found buried in brush along the banks of Lake Hodges. "The hardest memory I have is the day that Sheriff Johnson pulled me aside and told me what had happened. And I then shared that with Kelly and Tyler," King said. "That was the hardest moment for me of my life. To not only to understand what had happened to my little girl, but then to have to share that with the two people that I care for the most." The community came together in sadness. Within weeks thousands gathered to finish Chelsea's run. It would become an annual event for the next eight years. The King family established the Chelsea's Light Foundation. To date, it's awarded over 0,000 in scholarships to local students. California lawmakers passed Chelsea's Law, which established stricter penalties for sex crimes against children.But the Kings aren't done. They're launching an organization called Protect the Joy to work on passing legislation to protect children across the country."[It's] really an umbrella organization that will work on passing legislation that will protect our kids from all those things out there," King added. All those things that threaten the safety of children, everything from gun violence, opioid abuse, sexual predators, and bullying. King says the new group will work with communities to pass laws to protect children. A lofty goal, he acknowledges."Well Chelsea always tells us to go big or home. And if you are going to do something than do it right. Do it all the way," King said.King says he's learned over the course of his time grieving that he can find joy in people's eyes, in being connected with others and trusting in the good of people. But as he sets out to grow the organization, he struggles to change policy will not be his only burden."The hard days for me is when I have to attend a wedding," King said. "Those things that a dad and a mom get to do with their kids that Kelly and I don't get to do." 2841
