SANTA ANA (CNS) - A man accused of setting the Holy Fire that burned 23,000 acres in Orange and Riverside counties, forcing thousands of people from their homes, is due in court Wednesday for a preliminary hearing. Forrest Gordon Clark, 51 -- whose criminal case was briefly suspended in August when his courtroom outbursts led a judge to declare a doubt about his mental competency -- remains jailed in lieu of million bail, after pleading not guilty to arson and other charges Dec. 12. Clark's attorney, Nicole Parness of the Orange County Public Defender's Office, argued that Clark's million bail should be reduced because an arson investigator with the Orange County Fire Authority has theorized that another person might be responsible for setting the blaze. Parness told City News Service the analysis was ``very well thought out and logical'' and believes prosecutors ignored the suggestion to keep pursuing Clark as the main suspect. Milligan denied the allegation and told CNS he has fully cooperated with investigators and invited them into his home ``to tear it apart, do what you have to do'' so they can rule him out as a suspect. He said he has met investigators three times and turned over his phone, a GPS device and an iPad to authorities. He said he has offered to submit DNA and fingerprints as well. He conceded he was in the area when the fire erupted, saying he was about a mile away from Clark's cabin at the time. He said he understands law enforcement must investigate everyone who was in the vicinity of the fire's origin. In court, Parness asked Orange County Superior Court Judge Nancy Zeltzer to read the police report and argued that Clark's mental competency should justify a lowering of his bail. Deputy District Attorney Jake Jondle said the investigator's report mentioning Milligan is just an ``alternative theory,'' but there is ``no credible evidence'' to lead prosecutors to consider it seriously. Prosecutors are ``confident'' Clark is the right suspect, he said. Clark could face 10 years to life in prison if convicted of aggravated arson damaging at least five inhabited structures, arson of inhabited property, arson of forest and making criminal threats, all felonies, as well as two felony counts of resisting arrest. In August, Orange County Superior Court Judge Kimberly Menninger ordered Clark to undergo a mental evaluation, saying she questioned his competency to assist in his defense. But on Nov. 28, Judge Michael Murray ruled that Clark was competent, and criminal proceedings were restarted. Initially, a defense expert concluded Clark was mentally incompetent, but a prosecution expert ruled otherwise, prompting Murray to appoint a ``tie-breaker'' expert, who concluded Clark was capable of assisting his attorneys in his defense. Parness has been pressing prosecutors to turn over more evidence in the case. She said she has been pushing to obtain text messages allegedly sent by Clark to neighbors, as well as surveillance video footage. On Aug. 6, the day the Holy Fire erupted, Clark allegedly threatened to kill a neighbor about 7:30 a.m., prosecutors said in a previous motion to deny him bail. As the neighbor walked to his truck, Clark allegedly told him that he `(expletive) with the wrong person,'' according to the motion. ``The defendant stated that he was `crazy' and noted it was `perfect' because he could do anything he wants and get away with it.'' Later that day, he allegedly set fire to his neighbor's residence in Holy Jim Canyon. The Holy Fire ultimately also destroyed 13 other residences. Orange County sheriff's investigator Jennifer Hernandez said in an affidavit supporting the motion to deny bail that Clark ``could be heard on video telling (a victim), `Mark my words, you're gonna die at 12:37... I have 100 percent plausible deniability. You're gonna die. I'm gonna murder you.''' Clark allegedly made at least five ``specific threats'' and``allusions'' to setting fires, according to Hernandez, who said the defendant``appears to believe in the Sovereign Citizen ideology.'' The ideology's supporters ``believe the government does not have the authority to enforce a majority of our laws and taxes,'' Hernandez wrote, adding that not everyone who subscribes to the theory is violent, but law enforcement recognizes it as a ``terrorism threat.'' Orange County sheriff's deputies have had multiple encounters with Clark dating back to 2006, according to Carrie Braun, a spokeswoman for the department. SANTA ANA (CNS) - A 30-year-old Palmdale man was sentenced today to 2 1/2 years in jail for smearing his semen on a co-worker's computer keyboard and mouse, in her honey jar and in half-consumed bottles of water and lotion on her desk in the La Palma office they shared.Stevens Millancastro, who was convicted Sept. 21, must also register as a sex offender for the rest of his life. Millancastro was convicted of two counts of battery and three counts of assault by Orange County Superior Court Judge Kathleen Roberts, who decided the case without a jury.Roberts was going to sentence the defendant to two years in jail plus five years of probation, but Millancastro rejected probation, so the judge tacked on the extra six months. Millancastro was given credit for serving 74 days behind bars.``We also know from his own testimony, and the testimony from the doctor, that he placed his semen on her items more times than he was actually charged,'' Roberts said.``This is much more serious and invasive than a normal punch or hit or slap,'' Roberts said, explaining why she was doling out the maximum punishment. ``This was a sexually motivated act... It is emotionally devastating to the victim.''Roberts pointed out that the defendant ``harassed her for four years, staring at her, making her feel uncomfortable at work to the point she altered her clothing.''At some point the woman finally complained informally three times and then ultimately made a formal complaint, Roberts said. ``When she finally made the formal complaint the defendant was forced to undergo sexual harassment training,'' Roberts said. ``He chose to ejaculate into her items and that was after sexual harassment training.''The judge said his ``sexual revenge'' was a ``sophisticated scheme to get her to ingest his semen after she reported him.'' Roberts also noted when she convicted the defendant last month that he testified that after the first time he fouled the victim's belongings, ``his anger was not satisfied,'' and said he did not need counseling. ``That makes someone very dangerous to the community,'' she said, adding that the victim ``hesitated to speak up for herself to complain formally because she knew the defendant and her boss were close friends and she thought there would be repercussions on her.''The judge noted there were eight separate acts in late 2016 and early 2017 and said she took into consideration the sexual harassment, though it was not criminal.``His anger grew out of control,'' she said. ``The evidence shows he can't control his anger. That is a red flag to the court that he cannot control himself.''Millancastro and the woman, whose name was not publicly revealed, had worked together since 2014, according to Nikaien, who said the defendant ``actually trained the victim.''The woman testified that Millancastro started asking her out via an instant messaging system at work.``He mentioned something about picking me up. I had no clue what he was talking about,'' she testified. ``He was basically asking me out to the movies. I said, no, I have a boyfriend.''``Did he keep asking?'' Nikaien asked. ``Yes,'' the victim testified. ``He would stare at me all day ... in an uncomfortable way, a crazy way.''Nikaien said the defendant ``would check her out from head to toe. He would stare at her when she walked to a printer... when she walked to a filing cabinet near her desk... It got so bad... she would wear a sweater around her waist... to prevent him from looking at her.''Ultimately, she ``made an informal complaint to her boss,'' the prosecutor said. ``He was told to stop, but he kept staring at her. To the point, about a month later... the victim filed a formal complaint with HR for the defendant incessantly staring at her.''A short time later in November 2016, she noticed a half-consumed bottle of water she had left on her desk looked ``cloudy'' and threw it away, Nikaien said.``A week after that, she left another half drunken bottle of water open on her desk and when she comes back to work again the next day, the water is cloudy and she's suspicious so she throws it away,'' Nikaien said. ``A week later she finds another bottle of half-drunken water on her desk and this time she opens it up.''The woman's ``boss then had a team set up a surveillance camera next to the victim's desk,'' and it captured the defendant after hours on Jan. 12, 2017, as he ``grabbed some tissues and walked over to the bathroom... '' the prosecutor said. ``He masturbates to arousal, he ejaculates... then what we see next on surveillance is he's holding up the crumpled tissue walking right to the victim's desk.'' 5166

SAN FRANCISCO (AP) — The University of California has accepted a record number of freshmen and transfer students that includes the most ever from California for the 2019-20 academic year.The university system said Monday its nine undergraduate campuses accepted 71,655 California freshmen and 26,700 students who will transfer from California community colleges. That's more than 3,200 California students than last year.UC schools have been under pressure to accept California residents so they can have a cheaper way to complete a four-year degree at the state's top public universities.Nearly 218,000 prospective undergraduates applied for at least one UC school for fall 2019 during the application period that ended Nov. 30, according to figures released by the university system.
