FREDERICK, Colo. — Newly released court documents in the Chris Watts case obtained by KMGH suggest his two young daughters may have been strangled.The suggestion came in a motion filed by defense attorneys in Weld County court to compel the coroner to take DNA from the necks and throats of the remains of 4-year-old Bella and 3-year-old Celeste Watts, whose bodies were found inside oil and gas tanks Thursday. The court document also said the bodies were submerged in crude oil for four days.The bodies of the two young girls were found in close proximity to the other body positively identified as Shanann Watts, the girls’ mother.In the motion filed Friday, DNA expert Richard Eikelenboom concludes that DNA evidence “would remain on the necks of the decedent children,” after they were submerged in the oil. Eikelenboom is quoted in the motion as saying he believes the oil would not eliminate DNA and said samples can be obtained "after strangulation."The motion also asks that DNA samples be taken from the hands and nails of the body of the girls' mother.Eikelenboom writes:“This DNA can be retrieved with a double swab technique. DNA scientists are familiar with this technique and an experienced person should take this samples. In my opinion the presence of oil will not destroy the DNA. The hands wand nails of the mother should be sampled as well. After samples are taken the nails should be cut preserved. I have a lot experience taking samples from dead bodies getting good results after strangulation. The hands of the children should be sampled as well.”Eikelenboom is a forensic scientist who has claimed to be a DNA expert in trials in Colorado and across the United States, but was discredited two years ago in a 2013 sex assault case in Denver District Court.“I would be shocked if the defense tried to use him front of a jury after he has been discredited as an expert witness,” said former Denver District Attorney Mitch Morrissey, who led the charge against Eikelenboom.The motion was dismissed by the judge.On Friday, the coroner's office announced they have positively identified the victims of the Frederick case as Shanann Watts and her two daughters. The manner and cause of death of all three bodies are pending further laboratory results and will not be released at this time.Chris Watts remains in the Weld County Jail on suspicion of murder his family. He was taken to jail at 11:30 p.m. Wednesday after he was detained for questioning. Two law enforcement sources told KMGH Watts had confessed to killing his wife and daughters. He faces investigation on one count of first-degree murder after deliberation; two counts of first-degree murder – position of trust; and three counts of tampering with a deceased human body.All three were reported missing Monday around 2 p.m. after Shanann did not arrive to a scheduled meeting. FRAMINGHAM, Mass. – A school bus driver in Massachusetts says he was inspired by the students he drove to earn his college degree and pursue his dream of becoming a teacher.After high school, Clayton Ward attended college in Virginia, but the demands of school and work took their toll on him and he left after a few semesters.Eventually, he started driving a school bus for the City of Framingham and talking to the students on his route every day renewed his sense of passion for expanding and teaching young minds.So, he enrolled at MassBay Community College in 2019 with the goal of earning his degree, transferring to a four-year institution, and someday teaching high school history.MassBay says Ward worked full-time driving the bus, while also attending classes full-time at the community college. He excelled and earned a spot on the dean’s list every semester. He also did all of this during the COVID-19 pandemic.“It wasn’t always easy," said Ward. "I would drive my route in the morning and afternoon, take a class in between shifts, and take night classes and classes online to complete my degree requirements. I would think of those students and all the years I wanted to make this happen, and it helped me focus my energy.”In just one year, Ward completed his associate in arts degree in liberal arts and he plans to transfer to Framingham State University in the fall to pursue his bachelor’s degree in history, with a minor in secondary education.“I really enjoy working with kids, especially the high school students, and during the bus routes, we would chat about their classes,” said Ward. “As a history buff, I would share lessons that I learned in school and we talked a lot about academics. After several of these discussions, some of the students would tell me they wanted me to be their teacher. I think they only said that because I was a different person than their regular teachers, educating them in a different way to pique their interest. But, however small that mention was from those kids… it stuck with me and gave me the motivation to complete a goal I had started years ago.” 2119

FORT YATES, N.D. – After years of fighting over the Dakota Access Pipeline, the Stand Rock Sioux Tribe feels vindicated now that a judge has ruled it be shut down pending an environmental review.John Buckley was on the front lines of the Dakota Access Pipeline protests, which started almost four years ago.Buckley lives on the Standing Rock Sioux reservation just south of Bismarck, North Dakota. Four years ago, he was fighting for his right to drink clean water.“If that pipeline ever leaks, that’s going to cause a major problem,” he said.The pipeline carries hundreds of thousands of gallons of crude oil from western North Dakota to an oil terminal in Illinois. It crosses the Missouri River just a few miles north of the Standing Rock reservation.“Like the old ones say, Mini Wiconi, water is life. Without water, we can’t survive, as humans. So, it’s a way of life, it’s our life,” said Mike Faith, the tribal chairman of Standing Rock Sioux.The tribe's biggest issue was the Army Corp of Engineers and Energy Transfer Partners, the company that owns the pipeline, never completed an environmental impact statement.“The judge I think made the right decision, as far as telling the court, get an environmental impact statement. The EA, the little blanket resolution that allowed the environmental assessment. That hurt a lot of cultural resources, it did danger to a lot of species, it’s a danger in our existence,” said Faith.That disagreement sparked seven months of protests and drew people from all over the world. Thousands gathered and squared off with police. The clashes sometimes turned violent.Eventually, law enforcement cleared the protesters and oil began flowing through the pipeline. But that didn’t mean the fight was over.“Appeals, appeals, appeals. Standing Rock is here, we didn’t go away. We’re still here.”Three years after the first barrels of North Dakota crude started moving through the pipeline, a federal judge ordered an environmental impact study needed to be completed. The judge ordered that the pipeline will be drained of oil by the beginning of August. Since that ruling, the US District Court of Appeals in Washington, D.C. has granted an administrative stay on draining the pipeline while the appeal of the ruling plays out.“The decision by Judge Boasberg last week, last Monday, took us just completely by surprise," said Ron Ness, the President of the North Dakota Petroleum Council.Ness represents the oil industry in the state. He says there are huge economic impacts from shutting down the pipeline.“For every dollar in North Dakota that we get less for a barrel of oil, that’s like million a year to the state of North Dakota,” he said.And he says shutting the pipeline down means more oil on trucks and trains.“Prior to DAPL, we were putting almost 800,000 barrels of Bakken oil on rail cars, moving them to various markets. This pipeline not only offered a safety component, it took trucks off the road in counties across western North Dakota,” said Ness.But for the people of Standing Rock, this fight has always been about respect and preserving the environment“The federal government, the Army Corps of Engineers, did not do true government to government consultation. Economics vs. environmental, I would say that they have to be balanced,” said Faith.Faith and Buckley say we need to think about more than just money."All that water comes down this way and all that water is going to be fouled and it's not going to be worth drinking," said Buckley.“The almighty dollar sometimes, you’re not looking realistically into the future of future generations to come that can enjoy clean clear water," said Faith. 3674

Florida Democrat Sen. Bill Nelson called Wednesday for a recount in his race for re-election against Republican Gov. Rick Scott.In a statement from Nelson's office, the longtime incumbent said Scott had prematurely declared victory in the race, which CNN has not yet called.In Florida, an automatic recount is triggered when the final margin is less than .5% and are not triggered by candidate requests. Votes were still being counted Wednesday morning, but Scott's lead was within that margin, according to CNN projections. The initial vote count won't be finalized until Saturday at noon. 598
