SAN DIEGO (CNS) - A jury awarded million Friday to the widow of a retired San Diego Police Department criminalist who committed suicide after he was accused of a 1984 murder.The attorneys alleged the investigation was begun improperly by San Diego police homicide detectives, driving her husband to suicide.The verdict was the result of a federal lawsuit alleging wrongful death and civil rights violations filed by Kevin Brown's widow, Rebecca, against the city of San Diego and its police department. Jurors are due back in court Tuesday to consider punitive damages.Brown, 62, was suspected in the murder of Claire Hough, who was strangled and found dead at Torrey Pines State Beach in 1984. Brown hanged himself at Cuyamaca Rancho State Park in October of 2014, which his lawyers said was a result of the homicide investigation, as well as the seizure of numerous items of sentimental value from his Chula Vista home.Rebecca Brown's attorneys alleged now-retired SDPD Detective Michael Lambert misled a judge when securing an affidavit for a warrant to search and seize property at Brown's home. The affidavit was secured on the basis of Brown's sperm cells, which were found on a vaginal swab of Hough, though Rebecca Brown's attorney, Eugene Iredale, said those cells were most likely transferred onto the swab via accidental cross-contamination.Iredale told jurors that lab techs at the SDPD crime lab often used their own semen as reference samples when conducting testing for the presence of semen.Other DNA evidence found on Hough's clothing pointed to another suspect, Ronald Tatro, who was previously convicted in several other rapes and assaults on women. Tatro, who died in 2011, was matched to several blood stains and a pubic hair found on the girl's clothing, Iredale said.Despite Tatro's DNA being far more prominent on the swab, Iredale said Lambert used Brown's sperm cells and evidence that Brown had frequented strip clubs in the 1980s to suggest he worked in concert with Tatro in the killing.However, no such connection between the men was ever discovered, nor was Brown ever connected to the murder.Brown, who suffered from anxiety and depression, was "obsessed with getting his property back," Iredale said, yet was unable to secure their return over the course of several months.Iredale said the prospect of spending time in jail while fighting to clear his name and the property seizure was enough to push Brown to suicide.The attorney said Lambert was aware Brown was suicidal and held onto his property "because he knew it would cause pain and hurt, because he felt he was going to break him down, he was going to crack the case."Deputy City Attorney Catherine Richardson argued at trial that Lambert relied upon DNA experts when he wrote the affidavit and was not given all the information he needed.The attorney said Lambert asked about contamination when presented with the evidence of Brown's DNA, but was told by his sergeant that contamination was not possible. She also said Lambert was not informed that SDPD lab techs sometimes used their own semen for testing until months after the search warrant was secured.Richardson said the items from Brown's home had to be seized in order to prove or disprove a possible connection between Tatro and Brown, which would have dated back more than three decades, and that a rigid investigation was needed to prove there was no favoritism toward an SDPD employee."If he hadn't investigated (Brown), then the police would have been accused of covering up for one of their own," Richardson told the jury in her opening statement. 3615

SAN DIEGO (CNS) - A man who ambushed a janitorial worker at a Little Italy coffee shop at knifepoint, tried to sexually assault her and stole her SUV, was sentenced today to 14 years in state prison.Christopher Merron, 28, was also ordered to register as a sex offender for life.The attack occurred around 4:30 a.m. last Oct. 14 as the victim was cleaning the coffee shop in the 1700 block of India Street. Merron pushed the woman into a back room, took her car keys and threatened her with a knife, according to police and prosecutors.Following a struggle, she was able to break free and run out of the building, said San Diego police Lt. Jason Weeden.The assailant fled in the woman's 1998 GMC Jimmy. Merron was arrested in Mission Valley the next day and the victim's SUV was recovered, Weeden said.Merron pleaded guilty in January to assault with intent to commit a sex offense, robbery and sexual battery charges and admitted a knife-use sentencing enhancement allegation. Other charges, including kidnapping with the intent to commit a sex offense, attempted oral copulation, false imprisonment with force and auto theft, were dismissed at sentencing. 1165

SAN DIEGO (CNS) - Mayor Kevin Faulconer and San Diego Police Chief David Nisleit have launched a digital marketing campaign that aims to fill more than 200 positions that are currently vacant in the department, the mayor announced Thursday.Downtown-based Loma Media will run the marketing campaign, which includes videos that will be shared on social media as well as a new recruitment website, with the goal of fully staffing the department by 2020, Faulconer said."Getting the San Diego Police Department back to full staffing of over 2,000 officers is a top priority," Nisleit said in a statement.In December 2017, the City Council approved an agreement to boost salaries for San Diego police officers through the 2020 fiscal year.Since the raises were announced, the number of officers lost to other law enforcement agencies is down 84 percent from last year, Faulconer said."The best way to keep San Diego one of the safest big cities in the country is by attracting the best and brightest recruits to the San Diego Police Department," Faulconer said in a statement. "We're going to be innovative and creative in how we do that."Loma was one of four companies that responded to a request for proposals issued by SDPD earlier in the year. A panel selected the firm because of its social media expertise and prior clients, which included the U.S. Naval Special Warfare Command, Semper Fi Fund, UC San Diego and Google, among others.The 0,000 contract with Loma, which was approved in June, lasts two years, with an option to extend the contract for up to three more years.Funding for the first two years of the marketing contract was included in the current fiscal year budget. 1691

  

SAN DIEGO (CNS) - A man was sentenced to nearly a decade in state prison Wednesday for his role in the fatal shooting of a Navy sailor who pulled over on a San Diego freeway ramp to help a seemingly stranded motorist.Harvey Liberato, 26, pleaded guilty to voluntary manslaughter and other charges stemming from the Oct. 27, 2018 slaying of 21-year-old Curtis Adams on the connector ramp between southbound state Route 15 and northbound Interstate 5.Adams was driving on the freeway with his girlfriend at around 2 a.m. when he stopped to assist a disabled vehicle on the side of the freeway, which was actually a car that had sustained flat tires in a shootout from a bungled vehicle burglary earlier that night.RELATED: Man found guilty of murder in slaying of Navy sailor on freewayThe disabled car was occupied by Liberato, Susana Galvan, 40; Brandon Acuna, 23; and Brandon's brother, Edson Acuna, 26.Believing Adams was the person they had engaged in a shootout with earlier in the night, Edson Acuna exited the car and shot Adams in the chest.Edson was convicted by a jury earlier this year of first-degree murder, robbery, burglary, various firearm counts and a special-circumstance allegation of committing the murder in the commission of a burglary.
