SAN DIEGO (KGTV) -- A San Diego man convicted of murder will be a free man, decades before his scheduled release.Donnell Fulcher’s conviction for a Barrio Logan murder in 2006 was overturned due to changes in DNA standards, said Deputy District Attorney Hector Jimenez.On Tuesday, Fulcher pleaded guilty to voluntary manslaughter and assault with a firearm rather than go through a third trial. The judge sentenced Fulcher to 14 years, but he received credit for time he already served.Because of that, Fulcher will be released from custody tonight or tomorrow. This result comes after the San Diego County District Attorney’s Conviction Review Unit took a second look at cases involving DNA mixtures, meaning more than one DNA source is found in a sample. Fulcher’s case relied heavily on this type of evidence.The top forensic science group that analyzes DNA released guidelines that are now more conservative, which affected Fulcher’s case. Earlier this year, the District Attorney’s office agreed to give Fulcher a new trial.“We still believe that we have the right guy, but we lost confidence in the conviction so we wanted to give the defendant a chance to have a new trial if he wanted. He chose to plead guilty instead, so at the end of the day, I believe justice was done,” Jimenez said. Fulcher has always maintained his innocence.“I don’t think you can put any limit on the happiness that going free can have for someone who’s serving a life sentence. He is very, very happy. His family is very happy. This is really a joyous moment for all of them,” said Fulcher’s defense attorney Knut Johnson.This would have been Fulcher’s third trial. SAN DIEGO (KGTV) -- A man died following a shooting in downtown San Diego Thursday evening, police said.The shooting was reported just after 9:40 p.m. near the intersection of 5th Avenue and E Street in the Gaslamp Quarter, according to San Diego police.According to police, an altercation broke out between a man and his companion and a third man. Police said during the altercation, the third man produced a handgun and shot one of the men in the upper torso. The suspected shooter and the victim's companion both fled the scene.The victim was rushed to UC San Diego Medical Center for treatment, but he later died from his injuries. Police identified him as a 22-year-old Hispanic male.While the victim's companion was found a short distance away, police are still searching for the gunman. The suspected shooter was described as a Black male with braided hair, between 20-40 years of age, and wearing a bandana or rag over his face. He was last seen wearing dark clothing and running on eastbound E Street.Police are interviewing witnesses and viewing surveillance video footage from area businesses as part of the investigation. 1141

SAN DIEGO (KGTV) – A local medical spa is coming under fire for offering a coronavirus treatment that costs thousands of dollars but the spa director defends his actions.Dr. Jennings Staley operates Carmel Valley’s Skinny Beach med spa which specializes in treatments like Botox and laser hair removal. He says he’s been dealing with a lot over the last few days.“Death threats. He adds that he doesn't have test kits yet and he has not yet prescribed any of them the hydroxychloroquine.Dr. Kildare believes it’s irresponsible to offer the drug outside of a controlled hospital setting.“I wouldn't take the risk. SAN DIEGO (KGTV) - A new technology platform launched this week is making it easier for restaurants, hotels, and caterers to donate food to those facing hunger in San Diego County.The new platform, MealConnect, was unveiled by Feeding San Diego. CEO Vince Hall says the free platform will help rescue the more than 14 million pounds of food going into San Diego landfills every year. "This is an issue that is compelling, it is serious, and it is urgent because hunger is debilitating," said Hall. Restaurants and food service providers use the MealConnect app to submit a food donation. It's then picked up by a volunteer and delivered to a nearby charity. Nancy Kane is one of the first San Diego volunteers to take part in the program. "It's flexible, it's not that hard to do, I can do it on my own time. I love it; it's one more thing I can do to make a difference," said Kane.Volunteers receive training and equipment to ensure food is delivered safely. They can choose their delivery hours and can accept or decline requests via text message. MealConnect enables food donors of all sizes, such as hotels, meeting and event planners, restaurants, farmers market vendors, and convenience stores to post surplus food to the system.Feeding San Diego received a ,500 grant from the Walmart Foundation to support the launch of MealConnect in San Diego County. SAN DIEGO (KGTV) — A Rancho Bernardo family's home has become a must-see experience for their neighbors. Inspired by Disneyland's Haunted Mansion, the Loveless family has created a walk-through Halloween event that has grown bigger and bigger each year. She has recreated many of the iconic characters from the popular ride, as well as adding other spooks and haunts.For creator Katherine Loveless, it brings her back to her childhood. "I grew up on a city street that had a lot of haunted houses like this, so I grew up with it," Loveless said.Loveless and her husband, Bernard, began work on this year's Loveless Manor in August. They have created panels, which serve as moveable walls to create a maze-like path that runs through their yard. The family put a lot of thought into how to adjust their plans for the pandemic.“Last year we did kind of a smaller, tight trail that went in and out the same gateway," Bernard said. "We knew that wasn’t an option and we needed to have the whole trail outside and have more space between groups.”Loveless Manor is only open Halloween night.
