(CNS) - A verdict has been reached in the trial of a woman and her gun instructor who are accused of carrying out a plan to kill the woman's estranged husband.A jury has found Diana Lovejoy, 44, guilty of conspiracy to commit murder and attempted murder. Welcon McDavid Jr. was also found guilty of conspiracy to commit murder, but the reading of the verdict had to be postponed because Lovejoy passed out. Lovejoy and McDavid Jr. were charged with conspiracy to commit murder and attempted murder in the Sept. 1, 2016, attack on 45-year-old Greg Mulvihill, who was wounded in the 11 p.m. shooting in Carlsbad.Police allege Lovejoy and McDavid planned the crime and that the latter - - who worked at a gun range where Lovejoy was taking marksmanship lessons -- called the victim, arranged to meet him in the alley and opened fire on him with a rifle while hiding in a patch of bushes.Court records indicated Lovejoy and Mulvihill were in the midst of a contentious divorce, and that she had obtained a restraining order against him on accusations of emotional and sexual abuse.Mulvihill took the stand during the trial and described the moments leading up to him being shot, saying he didn't realize he'd been shot right away and, at first, he thought he felt something in his back even though he could see the shooter in front of him.Mulvihill testified about a bitter custody battle with his estranged wife.Mulvihill said he went up a remote trail in Carlsbad out of desperation, fearing Lovejoy would reopen their custody battle. He took a friend, a flashlight and a small aluminum baseball bat, but he thought he was picking up documents from a private investigator.Instead, as he approached the spot off Rancho Santa Fe Road and Avenida Soledad, he shined his flashlight around and spotted someone dressed in camouflage pointing a long gun right at him.Before he knew what was happening, Mulvihill said he was hit once in the side, the bullet exiting out his back. McDavid faces 50 years to life behind bars, and Lovejoy could be sentenced to 25 years to life.After court, the jury foreperson, Erin Reed,  told reporters the defense version of the shooting "seemed too far-fetched." 2224

(CNS) - A 54-year-old Poway man accused of killing a young woman in Carlsbad 33 years ago pleaded not guilty Tuesday to charges of murder and rape.James Charles Kingery faces 33 years to life in state prison if convicted of all charges stemming from the killing of 26-year-old Julia Hernandez-Santiago, according to the San Diego County District Attorney's Office.The victim's body was found on Oct. 10, 1987 on an ivy-covered embankment in the 2100 block of Alga Road, Carlsbad police spokesman Jodee Reyes said.The San Diego County Medical Examiner's Office determined the cause of death was asphyxiation due to strangulation.While a suspect was not identified at the time of the killing, investigators said technological advances eventually led to Kingery's arrest.In March, San Diego County sheriff's deputies arrested a man on narcotics and weapons violations and took a DNA sample from him, as required by law based on his alleged offenses, Reyes said. Then in May, the sheriff's crime lab notified Carlsbad police that DNA samples from the 1987 murder case were a match for Kingery, who was arrested July 22.A suspected motive for the killing has not been disclosed."When a murder goes unsolved, not only is justice delayed, but families are left in turmoil with no closure," District Attorney Summer Stephan said in a statement. (KGTV) - Kellen Winslow Jr. affirmed his innocence to 10News Thursday as he appeared in court to face a third charge of rape.The son of a Chargers legend, Winslow pleaded not guilty to the alleged rape a 17-year old girl in 2003.  10News was able to capture a few words with Winslow as he walked to his car in the parking lot outside court. When reporter Jim Patton asked about the new rape charge, Winslow responded it would all come out in court. Then asked if he was innocent of the other allegations of raping two women in Encinitas, Winslow said, "I'm advised by my lawyer to not speak on much. But yes, I am innocent." The new charge involves a woman who was 17 years old at the time. Winslow was 19. She claims he raped her while she was unconscious. Winslow Jr.'s attorney has previously said their relationship was consensual.  Thursday, the defense repeated a request for the woman's psychological history.Thursday's court hearing lasted no more than 15 minutes as attorneys debated whether this new case should be tried along with the other two rape allegations. Winslow Jr.'s attorneys argued the new charge could prejudice the other two.The judge allowed the cases to remain joined for now for efficiency but said the trial judge would make the ultimate decision.  Winslow is currently free on a million bond, while required to wear a GPS monitoring bracelet. His trial date was set for March 19th, 2019. 1507
