(CNS) - A verdict has been reached in the trial of a woman and her gun instructor who are accused of carrying out a plan to kill the woman's estranged husband.A jury has found Diana Lovejoy, 44, guilty of conspiracy to commit murder and attempted murder. Welcon McDavid Jr. was also found guilty of conspiracy to commit murder, but the reading of the verdict had to be postponed because Lovejoy passed out. Lovejoy and McDavid Jr. were charged with conspiracy to commit murder and attempted murder in the Sept. 1, 2016, attack on 45-year-old Greg Mulvihill, who was wounded in the 11 p.m. shooting in Carlsbad.Police allege Lovejoy and McDavid planned the crime and that the latter - - who worked at a gun range where Lovejoy was taking marksmanship lessons -- called the victim, arranged to meet him in the alley and opened fire on him with a rifle while hiding in a patch of bushes.Court records indicated Lovejoy and Mulvihill were in the midst of a contentious divorce, and that she had obtained a restraining order against him on accusations of emotional and sexual abuse.Mulvihill took the stand during the trial and described the moments leading up to him being shot, saying he didn't realize he'd been shot right away and, at first, he thought he felt something in his back even though he could see the shooter in front of him.Mulvihill testified about a bitter custody battle with his estranged wife.Mulvihill said he went up a remote trail in Carlsbad out of desperation, fearing Lovejoy would reopen their custody battle. He took a friend, a flashlight and a small aluminum baseball bat, but he thought he was picking up documents from a private investigator.Instead, as he approached the spot off Rancho Santa Fe Road and Avenida Soledad, he shined his flashlight around and spotted someone dressed in camouflage pointing a long gun right at him.Before he knew what was happening, Mulvihill said he was hit once in the side, the bullet exiting out his back. VISTA, CA (KGTV) — The man accused of intentionally driving a U-Haul van into a crowd of people outside of an Encinitas bar, pleaded not guilty to serious charges in a Vista courtroom Wednesday.Christian Davis, 28, stood next to an attorney with his head down as he was formally charged with two counts of attempted premeditated murder, three counts of assault with a deadly weapon, and one count of felony driving under the influence of alcohol.Deputy District Attorney, Kim Coulter, said the incident early Sunday morning started at the Saloon and Shelter bar when Davis was kicked out.RELATED: Video shows driver slamming into crowd outside Encinitas bar"He was asked to leave because he was highly intoxicated and it was time for him to go," said Coulter.Once he was kicked out, Coulter said he got into a verbal argument with two bouncers, then threatened them."It escalated and culminated with Davis telling the security guards 'you're going to regret doing this, I’m going to come back and I’m going to kill you,'" she said.Moments later, witnesses saw the U-Haul heading for a crowd of people standing outside of the bars.RELATED: Man arrested after driving into crowd outside Encinitas barThe incident was captured on a passerby's dash cam video."He reversed out of a 7-Eleven and he came barreling down a sidewalk in front of Shelter bar, right into a crowd of people," said Coulter. Walmart is making its opioid policy more strict, limiting the duration of such prescriptions and requiring that they be filled electronically.The company announced on Monday that within 60 days, it will only fill first-time acute opioid prescriptions for seven days or less nationwide, and it will limit the dosage to 50 morphine milligram equivalents, or MMEs, per day. A CDC study found that people who were prescribed at least one day of opioid therapy had a 6% chance of being addicted a year later — but for those prescribed eight or more days of treatment saw that chance spiked to 13.5%. The CDC also notes that patients who are prescribed higher dosages are more likely to die from an overdose.Some states already limit prescriptions to seven days or fewer. Walmart will go by state law when the cap is lower than one week.Walmart also said that starting in 2020, it will require e-prescriptions for controlled substances. The company explained that online prescriptions will help prevent prescription fraud and minimize error.The new measures are an extension of Walmart's efforts to fight the US opioid epidemic.In January, the company introduced a way to safely destroy leftover opioids at home. DisposeRx is a powder that, when combined with water and the pills, creates a gel that is difficult to remove from its container. The mixture can be thrown out at home or left at a drop off location. The company said on Monday that it will make DisposeRx available online.Plus, Walmart and Sam's Club pharmacists will continue to recommend the anti-overdose drug naloxone, which is available over the counter in some states, to customers who may be at risk of an overdose. They will complete a pain management curriculum by the end of August.Other companies are making similar efforts to help fight the epidemic.Aetna started waiving co-pays for the anti-overdose drug Narcan, a branded version of the naloxone nasal spray, and limiting first-time opioid prescriptions to seven days in January.
