But now, things are different due to COVID-19, and owner Nicole Dinkel is working hard to keep her doors open while keeping customers happy."This industry has been affected very hard," said Dinkel. "We're out here just trying to do the best we can. We're a small business, I run this with my father day-to-day."Dinkel said she and her father, Ed, have been forced to shut down three times over the past few months.The first time was in March when Governor Doug Ducey issued a Stay-At-Home order for Arizona. The second time was after several of their employees tested positive for COVID-19, and a third time after trying to re-configure the usually busy bar to offer a safer dine-in experience."The signage on the door over here "mask up," it says 'avoid the humans keep, your six-foot distance,"' said Dinkel. "We want everyone to understand that it's not us making these rules, we just have to enforce them. It's the only way we can stay open."Dinkel employs a handful of families, including mother and son duos, as bartenders and servers."I have several families who depend on me here, not just my livelihood, but theirs," she added. "If you have customers coming in here not wanting to abide by the rules, it's not worth losing my business or getting in trouble for."Dinkel had to stand her ground last weekend when a group of women went in for dinner and drinks and caused a scene."They were dancing, I had to tell them 'ladies, I'm so sorry I can't have you standing within 6-feet with Ducey's new rules. Can you please take a seat?' They would say OK, and then again in a few minutes, they would still stand up," added Dinkel. "So at the end, I said ladies listen I need to either have you take a seat or need to have you exit with a mask. They just weren't listening."Surveillance video from 92 Drinks + Eats shows one of the four women stand up from the table, without a mask, and blow in Dinkel's face."In that moment, I was shocked," said Dinkel. "I told her to get out of my establishment immediately with all of her friends and I walked them over to the exit."Dinkel then started recording the group as some women started yelling. She says several of her employees joined her outside as the confrontation continued. Then says the same woman took things to another level."She actually reaches across my bartender and snatches my mask off of my face, throws it to the ground, scratches my face."Dinkel contacted Scottsdale police, who then contacted the group of women that night and issued no trespassing orders.On Friday, ABC15 confirmed the Scottsdale Police Department filed assault charges against one woman. No arrests have been made. Instead, the charges are being sent to prosecutors with a notice for the woman to appear in court."There's a global pandemic going on right now," said Dinkel. "For someone to be able to think that they can do that to another person is shocking... SANTA ANA (CNS) - A man who drove drunk and veered into oncoming traffic while making a turn, slamming head-on into a minivan and killing a mother of three in Lake Forest, was convicted today of second-degree murder.William Joseph Carroll, 51, of Mission Viejo, had a blood-alcohol level of about 0.23 -- nearly three times the legal limit -- when his Ford F- 250 pickup truck slammed into a Toyota Sienna minivan driven by 36-year-old Ana Martinez about 11:40 p.m. May 7, 2013, Deputy District Attorney Daniel Feldman told jurors during the trial.Martinez, who was driving to work at the time, was "crushed to death" in the crash, Feldman said.The prosecutor said Carroll was making a left turn from El Toro Road to Santa Margarita Parkway in Lake Forest when he veered into oncoming traffic.A witness told investigators that Carroll ran a red light, he said. Witnesses "describe Mr. Carroll's truck like a train out of nowhere," Feldman said, adding that the force of the collision was like "100 mph" when combining the speeds of both vehicles.Carroll's attorney, Sara Ross, told jurors it was " a case of government overreach." Ross acknowledged that Carroll was "responsible for the killing of Ana Martinez, but he's not guilty of murder."Both drivers attempted to avoid each other, she said, adding that the intersection is "a bit confusing." "It's a very confusing road and you're going to need that context to determine whether this was a murder," Ross told jurors.Feldman said Carroll was charged with second-degree murder rather than vehicular manslaughter because when he was convicted of DUI on Sept. 11, 2008, he was warned he would be charged with murder in the event of involvement in a DUI-related death.Carroll faces 15 years to life in prison when he is sentenced Jan. 19. 1797

  

SAN JOSE, Calif. – A woman was caught on video intentionally coughing on a baby at a California yogurt shop after getting into an argument with the child’s mother.The San Jose Police Department is asking for the public’s help in identifying the woman, who they call an “assault suspect.”Police say the adult female suspect was standing in line inside a Yogurtland in front of the mother and her 1-year-old child, who was in a stroller.A preliminary investigation revealed the suspect was upset the mother was not maintaining proper social distancing, so she removed her face mask, got close to the baby’s face, and coughed two to three times, according to police.Video then shows the suspect leaving the business. (KGTV) - Months after the massive Equifax data breach, a North County couple got some heart-dropping news from the Internal Revenue Service (IRS).    Jennifer, who asked 10News not to identify her full name, says her accountant was just about to e-file her taxes when she got the letter from the IRS."It said we needed to verify that we filed, and if we had not filed, we had to call them immediately to tell them we hadn't filed," said Jennifer.RELATED: Equifax finds additional 2.4 million impacted by 2017 breachIn short, someone had already filed in her name, raising the suspicions of IRS employees.    "You feel violated. It's scary," said Jennifer.Jennifer spent an hour on the phone with IRS caseworkers, who told her the red flags were immediate."The numbers for the deductions were off, but also the final number on the refund, which must have been way off," said Jennifer.RELATED: San Diego City Attorney announces lawsuit against Experian over massive data breachThe fraudulent tax filing comes almost seven months after the wide-ranging breach at the credit reporting company Equifax."We immediately and proactively froze our credit and then got letters saying both me and my husband had both been compromised," said Jennifer.While they have credit monitoring and froze their credit, that doesn't protect them from fraud, which is a form of identity theft. And if filing electronically, use a secure network."Tax time presents a perfect storm for scammers, from tax identity theft to imposter scams, consumers must stay vigilant and prepared. Remember to go to the source of truth when you are contacted by anyone purporting to be from the IRS or other government entity," said Eva Velasquez, President of the Identity Theft Resource Center. 2462
