A Florida judge has denied a request for a temporary injunction to block the Palm Beach County mask mandate.Attorneys for a group of Palm Beach County residents filed a lawsuit claiming that the county's emergency order requiring masks in public places to help prevent the spread of the coronavirus was unconstitutional.Judge John Kastrenakes issued his ruling Monday morning."The right to be 'free from governmental intrusion' does not automatically or completely shield an individual's conduct from regulation," Kastrenakes wrote in his 13-page order. "More to the point, constitutional rights and the ideals of limited government do not absolve a cititzen from the real-world consequences of their individual choices, or otherwise allow them to wholly shirk their social obligation to their fellow Americans or to society as a whole. This is particularly true when one's individual choices can result in drastic, costly and sometimes deadly consequences to others."Kastrenakes went on to say that there is no "constitutional or protected right to infect others."Commissioners voted unanimously last month to approve the mask mandate, despite objections from an impassioned group of residents who spoke against such an ordinance.County Administrator Verdenia Baker last week extended the order for an additional 30 days. It now remains in effect until at least Aug. 23.Mayor Dave Kerner said Friday that the county is in the process of mailing about 3 million masks to residents."As this community tries desperately to navigate the tumultuous seas presented by COVID-19, it is reasonable and logical that our elected officials are throwing the citizens of Palm Beach County a lifeline in an attempt to ameliorate the spread of this deadly, unbridled and widespread disease," Kastrenakes concluded. "Based on the evidence, this court will not second guess the manner in which a co-equal branch of government sought to discharge its sacred duty to protect the general public."A statement from the Florida Civil Rights Coalition, which filed the lawsuit on behalf of the plaintiffs, said Kastrenakes "unsurprisingly" denied the motion, "paving the way for continued government tyranny under the guise of disease prevention in Palm Beach County."Attorneys for the plaintiffs argued during a hearing last week that the mask mandate infringes upon their clients' constitutional rights.In their statement, attorneys claim the ruling "disregards fundamental rights like freedom of speech and the right to medical self-determination protected by the Florida Constitution."The Florida Civil Rights Coalition plans to appeal the ruling. DENVER – The man who was detained after driving his car through a crowd of protesters rallying for Breonna Taylor says he had no intention of hurting anybody and was only defending himself after his vehicle was surrounded by demonstrators outside the Colorado State Capitol building in Denver Wednesday night.“I was driving to go pick up a client and I saw a commotion, I saw police lights at 14th and Lincoln and so when I was there, at the Capitol, I wasn’t really looking left, I was looking right to see the accident and by the time I turned, I started getting surrounded by people,” said Jonathan Benson, who claimed demonstrators yelled, kicked and even used a hammer on his windshield as they tried to get him to leave the area.Video from AIRTRACKER7, as well as from reporters on the ground, showed the small crowd of protesters surrounding Benson’s vehicle and blocking his way. The driver, who was going north on Lincoln Street, had slowed down as he reached the protesters in the area, eventually pulling up and parking his vehicle in front of the Capitol building. There were other cars trying to drive that day and they stopped. There are people with signs, there are people honking in support and so why would a person want to try to drive through?” she said.Benson was detained seconds later by police about a block away from where the incident occurred and was released after providing officers with a statement and his contact information.Thomas said no charges have been filed against Benson as police are still investigating exactly how the events unfolded, but he did give drivers some advice should they end up in a similar situation.“In the event someone is blocking you or you are surrounded by people, our advice is to stay in the car, lock your doors, do not engage with demonstrators,” Thomas said, adding drivers should back away, or turn around. If that’s not possible, they should call 911.While no arrests in connection to that incident have taken place, Denver Police Department spokesman Doug Schepman said three people were arrested following the protest: Allan Cutler, 52, was arrested for obstruction of a street. Joseph Miller, 33, and Coy Jones, 27, were both being held for investigation of prohibited large capacity magazines.During a virtual news conference on the city’s response to COVID-19 earlier Thursday, Denver Mayor Michael Hancock was asked about the incident from the night before and what drivers should do if they encounter protesters.“I don’t know what you recommend to people but if you get a sense something is going on, avoid it,” Hancock said, adding that admonishment “goes both ways.”“We have to make allowances for drivers who might accidentally find themselves there. We gotta not assume every driver is listening to radio or aware protest is there,” he said, further suggesting protesters work with drivers by creating a safe path for them to travel on the street.The incident between the driver and the protesters happened toward the end of an otherwise peaceful night, after hundreds rallied and marched in downtown Denver over the lack of charges against the police officers involved in Breonna Taylor’s death in Louisville, Ky.Wednesday’s incident marks the third time this year a driver has encountered a crowd of protesters calling for racial justice.On May 28, the driver of a black SUV hit a protester after George Floyd demonstrators had blocked off the intersection of Colfax Avenue and Broadway. Having easy access to Mario’s first three 2D adventures provides an easy way to experience the evolution and improvements made with each entry. Most importantly, all three of those games still hold up in 2020. When it comes to Super Mario 3D All-Stars, a package that includes Super Mario 64, Super Mario Sunshine, and Super Mario Galaxy, this is not the case, but that doesn’t mean Nintendo’s new collection on the Switch is one to overlook. Image from Nintendo.com Super Mario 64Let’s get this out of the way. Super Mario 64 does not hold up. I know, it saddens me too. Mario’s first 3D adventure is arguably one of the most important video games of all time, but mamma-mia, has this game aged poorly. As soon as I jumped into the Bob-omb Battlefield course at the start, my gaming brain was startled by the game’s awful camera system, which makes completing an objective far more frustrating than I remember in 1996. Obtaining stars on each course is still exhilarating, but the excitement stemmed from the relief of conquering the awkward jumping angles, rather than accomplishing the task at hand. When it comes to visuals, the game looks exactly how you remember, albeit a bit smoother in some textures. It even retains the 4:3 aspect ratio. If you’re looking to experience the origins of 3D Mario titles, give this a look, if just for a nostalgia fill and move on. Image from Nintendo.com Super Mario SunshineThe most non-traditional of 3D Mario entries is by far Super Mario Sunshine. Originally on the only console to ever feature a handle, the Nintendo Gamecube, this game is worth a second look. Sunshine’s verticality, combined with its open-world structure, feels surprisingly modern and its difficulty remains among the highest in the Mario series, even if it’s sometimes unintentional due to the game’s bugginess. Controlling Mario with his water-filled jet pack still feels unlike anything else in the series, making for some literal refreshing mechanics that I enjoyed during my playthrough. From an art standpoint, I absolutely adore the colorful, tropical look of Isle Delfino and the characters that populate it. It’s not the best 3D Mario game, but don’t overlook this nautical adventure. Image from Nintendo.com Super Mario GalaxyThis was my first time experiencing Mario’s outer space escapade. If you told me this game came out this generation, you could easily fool me. Super Mario Galaxy hasn’t aged a day since its release in 2007. Its space-aesthetic rivals the art direction of any Nintendo Switch game to date, and its tight controls feel fantastic. Running around bite-sized planets, playing with gravity, and that launching into the next world animation makes me want to stop writing this review and go play it right now. I am cherishing the number of stars I have left to collect. It’s a real shame that Super Mario Galaxy 2 was left off of this collection. Perhaps it’s time to go dig out my Wii to experience the sequel. Galaxy is reason enough to purchase this bundle, even at the slightly steep price point.The full packageSuper Mario 3D All-Stars is just the meat and potatoes without any added junk food to consume. Aside from a playlist of 175 iconic Mario jams to listen to separately, this collection has zero special features. I would have loved to see a documentary about the making of these games, or even some never-before-seen sketches when the game was in its early stages. Instead, we’re simply left with the bare minimum of the three original games with some slightly improved visuals. Still, though, this is the easiest way to play these titles in 2020. If you’re on the fence about purchasing, this game is only available until March 31, 2021, according to Nintendo. Nearly a year after walking off the job, teachers in West Virginia are going on strike again.Last year, teachers in the state went on strike for nine school days, fighting for higher pay. This year, they’re protesting an education reform bill that would bring charter schools to the state and create education savings accounts parents could use for homeschooling, private schools and other educational costs.Unions are calling it retaliation. "We are taking action,” said Fred Albert, with the West Virginia American Federation of Teachers. “We are left with no other choice.”Tuesday’s strike is just the latest of several strikes nationwide in recent months. Teachers in Denver, Colorado recently went on strike for three days. In Los Angeles, 30,000 teachers went on strike for six days. Teachers in Oakland are set to strike Thursday. At the heart of the strikes are better school funding and higher pay. Experts say the strikes will likely continue. “Once you have educators seeing that when they come together in collective action and they raise their voices together, they're looking around and they're seeing it's not just them,” says Becky Pringle, vice president of the National Education Association. Pringle believes education is a shared responsibility and everybody’s business. 1305
