SAN DIEGO (AP) — A Navy SEAL committed murder during a deployment to Iraq and the proof is in his own words, his own photos and the testimony of his fellow troops, a military prosecutor told a jury Monday.Cmdr. Jeff Pietrzyk said in closing arguments of a court-martial that text messages by Special Operations Chief Edward Gallagher show he is guilty of fatally stabbing a wounded Islamic State prisoner on May 3, 2017.One message said: "I've got a cool story for you when I get back. I've got my knife skills on." Another text stated: "Good story behind this. Got him with my hunting knife."As he showed a photo of the dead prisoner with Gallagher holding up his head by the hair, the prosecutor said, "Those are his words."The prosecutor said one SEAL who changed his story and claimed to have killed the prisoner himself was lying to protect Gallagher."The government's evidence in this case is Chief Gallagher's words, Chief Gallagher's pictures, Chief Gallagher's SEALs," Pietrzyk said.The prosecutor said he wouldn't try to argue sympathy for the teenage prisoner, who had been wounded in an air strike."Before the air strike, he would have done anything in his power to kill an American," Pietrzyk said.But he said the prisoner was not a lawful target."We're not ISIS. When we capture someone and they're out of the fight, that's it. That's where the line is drawn," Pietrzyk said.Gallagher, 40, has pleaded not guilty to murder and allegations that he shot civilians and a violation involving posing with the corpse for photographs.Defense lawyer Tim Parlatore began his closing argument the same way he started the trial. Parlatore said.The attorney said there's no body, no forensics, and the SEALs who testified against Gallagher lied because they didn't like his demanding leadership.Parlatore also addressed the testimony of Special Operator Corey Scott, who said he saw Gallagher stab the prisoner in the neck but stunned the court when he said he was the one who ultimately killed the prisoner by plugging his breathing tube with his thumb as an act of mercy.The defense attorney contended that investigators never asked Scott about the cause of the death, which is why they were surprised by his testimony."They didn't even listen to their own witness," Parlatore said.A jury of five Marines and two sailors, one a SEAL, will weigh whether Gallagher, a 19-year veteran on his eighth deployment, went off the rails and fatally stabbed the war prisoner as a kind of trophy kill.During the trial, it was revealed that nearly all the platoon members readily posed for photos with the dead prisoner and watched as Gallagher read his reenlistment oath near the body in an impromptu ceremony.Nearly a dozen SEALs testified over two weeks. Most were granted immunity to protect them from being prosecuted for acts they described on the stand.Seven SEALs said Gallagher unexpectedly stabbed the prisoner, moments after he and the other medics treated the 17-year-old boy. Two, including Scott, testified they saw Gallagher plunge his knife into the prisoner's neck.An Iraqi general who handed the wounded prisoner to the SEALs testified that Gallagher did not stab the boy. SAN BERNARDINO (KGTV) - With their backs to the wall, facing elimination, an unforgiving heat, and trying to stave off fatigue from a rigorous schedule, the Park View Little League all-stars survived to play another game at the West Regional tournament in San Bernardino.Keyed by slugger Jose Mendoza and stellar pitching by Kainoa Baptista, the Green Monsters kept their postseason run alive while ending the Arizona Sunnyside Little League's hopes of advancing.  The squad from Chula Vista defeated Sunnyside 9-5 in an elimination game Tuesday afternoon.PVLL, which suffered its first loss of the postseason on Monday, took an early 3-0 lead on a first-inning three-run blast to right center by Mendoza.The Southern California champs broke the game open in the third inning.  Down two outs with runners on first and second, Aiden Skinner punched a deep single to right field scoring Jordan Bleisch.The long inning and blistering 108-degree heat seemed to wear down Arizona starting pitcher Cristobal Lorta.  Lorta started struggling with his form allowing Park View to extend their lead 7-0 on two wild pitches with runners on third and an RBI single to Conner Alonzo.Sunnyside's decision to keep Lorta on the mound in the fourth inning backfired when the leadoff batter, Ivan Rodriguez Jr., ripped the first pitch down the left field line for a double. He never expected to be going out on a limb."I want to get the word out," he says.Walters says he's concerned about Census takers in the field, including his team of 11. His crew is knocking on doors around Mira Mesa to collect data from those who haven't responded to the government survey. Walters says the Census Bureau gave each worker a Ziploc bag with just two cloth masks and a bottle of hand sanitizer, which Walters says is not nearly enough."We would be sending them into harms way with nothing but a piece of cloth over their face," he says.His concern is that when people are home and come to the door, they're less likely to be wearing a mask. He's now pushing for the Census bureau to provide its field workers with plastic face shields - a request he has tried to escalate with no success.The Census Bureau referred ABC-10 to a recent joint statement with the CDC. It says Census takers are trained to wear face masks, maintain six feet of social distance, practice hand hygiene, and not enter homes to do interviews.Walters says the leadership agreed the plastic face shields would be a benefit, but if Walters wanted to get them for his own crew, he'd need to pay for them out of his own pocket. SAN DIEGO (CNS) - A gun control group has filed a lawsuit on behalf of victims the Poway synagogue shooting against several parties, including the alleged shooter, his parents, the gun store that sold him the weapon used in the deadly shooting and the weapon's manufacturer, Smith & Wesson.The suit filed Monday in San Diego Superior Court alleges `irresponsible and unlawful conduct by a firearms manufacturer and seller for making, marketing, or selling weapons in an unsafe and illegal manner'' in connection with the rifle allegedly used by John T. Earnest, 21, in the April 27, 2019, shooting at Chabad of Poway.The suit filed by the gun control advocacy group Brady United accuses Smith & Wesson of failing to ``use reasonable care'' when marketing the rifle -- a Smith & Wesson M&P 15 -- and alleged the company made the weapon ``easily modifiable,'' which facilitates crimes like mass shootings.The lawsuit also alleges gun store San Diego Guns unlawfully sold Earnest the rifle used in the shooting, as he lacked a valid hunting license to buy such as weapon at his age.The suit also alleges Earnest's parents ``negligently facilitated their son's (the shooter's) ability to gain access to one or more pieces of weaponry/tactical equipment used in the incident, upon information and belief, having prior knowledge of his avowed, virulent anti-Semitism and propensity for violence.''The shooting resulted in the death of 60-year-old Lori Gilbert Kaye, who was shot in the synagogue's foyer. Three others were injured, including the synagogue's rabbi, Yisroel Goldstein, who is among several people listed as plaintiffs in the lawsuit.Earnest remains jailed on both state and federal charges for the shooting, as well as the alleged arson of an Escondido mosque, both of which are being charged as hate crimes.Earnest allegedly told a dispatcher that he committed the shooting because Jewish people were destroying the white race and made similar anti-Semitic comments in an online manifesto in which he said he spent four weeks planning the attack.Earnest faces the death penalty in the state's prosecution, while a federal capital punishment decision remains pending.According to testimony, a receipt found in Earnest's car showed he purchased the rifle at San Diego Guns on April 13, 2019, the same day a California Fish and Wildlife card found in his bedroom showed he completed a hunting program, qualifying him for a hunting license.However, the license -- which would allow someone in California under 21 to purchase a gun -- was not valid until that July. Without a valid license, Earnest would have been prohibited from purchasing the rifle under state law, as he was 19 at the time of the purchase.The California Department of Fish and Wildlife and Department of Justice are also named as defendants for alleged negligence in allowing Earnest to buy the gun when a background check should have precluded him from purchasing it. 2968

SAN DIEGO (CNS) - A 22-year-old motorcyclist was hospitalized in critical condition this morning with injuries he sustained in a crash with a Toyota Rav4 in Mira Mesa.The man was riding northbound on Camino Ruiz at Marauder Way at 10:30 p.m. Friday when he broadsided the Rav4, according to Officer Robert Heims of the San Diego Police Department, who added one driver ran a red light, but it was unclear which one.The motorcyclist sustained multiple fractures and was taken to a hospital in critical condition, Heims said.The driver of the Toyota was not hurt. 569
