SAN DIEGO (KGTV) - One of La Jolla's most scenic spots is also the scene of a 20 year battle that has left the community divided.The Coastal Commission voted unanimously Thursday night to approve a measure to renew a 10-year permit to close the Children's Pool to human access during Harbor Seal Pupping season.The Children's Pool was built in 1931 to give kids a safe place to enjoy the beach.In the late 1990's, harbor seals moved in on the area creating conflict.Surveillance cameras captured visitors getting dangerously close to the seals causing the city to take action.In 2014, they decided to close the Children's Pool from December 15th through May 15th. This is typically the time period when mother seals use the beach to birth their calves.The California Coastal Commission agreed to try out this plan for five years.Dr. Jane Reldan, President of the Seal Conservancy, said the beach closure was an "elegant compromise." Reldan added that the closure happens during a time of year when it's cold and people don't want to go swimming anyways.Opponents say there's plenty of coastline for the seals to use and that it's time the Children's pool was given back to the kids. 1190

SAN DIEGO (KGTV) — One man has died after a hit-and-run outside Sharp Memorial Hospital in Kearny Mesa, after he had reportedly been discharged from the hospital.San Diego Police said a 61-year-old man was in the southbound land in the 3000 block of Health Center Dr. when they were hit by an unknown vehicle just after 5:30 p.m. The vehicle fled the scene after hitting the man, SDPD said.The man was taken to the hospital, where he died.Police told ABC 10News at the scene that the man had reportedly just been discharged from the hospital before he was hit by the vehicle.SDPD Traffic Division was investigating the collision. The victim's name was not immediately released.Health Center Dr. and Frost St. were closed following the hit-and-run for investigators. 773

SAN DIEGO (KGTV) -- More than 20 people were arrested in San Diego as part of a statewide sanctuary enforcement operation carried out by Immigration and Customs Enforcement agents.ICE officials said the arrests were made between Sept. 28 and Oct. 2, with the focus on “criminal aliens and individuals who have violated U.S. immigration laws.”According to officials, arrests were made in San Diego, Encinitas, Vista, Lakeside, National City, Poway, Fallbrook, Spring Valley, Escondido, Oceanside, and San Marcos.In a news release, ICE officials said:“Of those arrested, 10 were the direct result of sanctuary state laws that force local law enforcement not to honored a lawfully issued immigration detainer. Two arrests were the direct result of the law enforcement agency releasing the individuals prior to ICE being able to place an immigration detainer on their case.Of those arrested, over 80 percent had prior criminal convictions and/or pending criminal charges. Of those, the criminal offenses included Lewd and Lascivious Acts with a minor under 14 with Force, Domestic Violence, Assault, Possession of Control Substance for Sale, Possession of Control Substance, Vehicle Theft, Burglary, and Driving Under the Influence of Alcohol.One individual who was arrested during the operation will face federal criminal prosecution for having illegally re-entered the U.S. after their removal. Those who were primary targets of this operation have final orders of removal issued by a federal immigration judge. Their due process was completed, and they will be removed from the United States. The individuals who were arrested and require adjudication from an immigration judge will be placed in detention pending the outcome of their removal proceedings.”Gregory Archambeault, Field Office Director for ICE Enforcement and Removal Operations in San Diego, said, “The State of California has chosen to prohibit local law enforcement agencies from cooperating with ICE to protect public safety. SAN DIEGO (KGTV) — New numbers show the trash continues to pile up at San Diego landfills.San Diego County's daily waste disposal per person increased from 5.5 pounds in 2016 to 5.6 pounds in 2017, according to the research group, Equinox Project, the nonprofit institute at University of San Diego."When the economy's booming and there's more disposable income, people tend to buy more stuff. That means more packaging, and it tends to come with more waste," said Nilmini Silva-Send, a researcher with the Equinox Project.San Diego County's disposal rate is among the highest in the state.More trash means more greenhouse gasses released and less landfill space. As for the biggest trash makers, Del Mar comes in at more than 17 pounds per person, followed by Coronado and Carlsbad. The Del Mar Fairgrounds and Naval Base Coronado are among several possible factors. "The higher the socioeconomic level, the more waste they will tend to produce," said Silva-Send. The cities tossing the least amount of trash per person are Oceanside, Chula Vista, and Imperial beach. The biggest increase for trash disposal happened in Santee, while the biggest year-to-year decreases were in Imperial Beach and National City. The waste report is part of the Equinox Project's annual Quality of Life Dashboard report, which provides a snapshot of economic and environmental trends in the region. 1389

SAN DIEGO (KGTV) — New details are emerging about the death of a man in San Diego Sheriff’s deputies’ custody. A recently released Medical Examiner’s report says an arrestee’s death last year was a "homicide." The District Attorney's office said last year that none of the deputies involved in the in custody death will face any criminal charges. Oscar Leal died last February 28 after deputies responded to his apartment in Vista and detained him. The Medical Examiner’s homicide classification is not a legal term, but a medical assessment. The DA's office wrote in part of a nine-page summary and statement in December last year: "... His level of methamphetamine intoxication combined with his active resistance combativeness in the duration of the struggle, all contributed to his death ... The deputies involved in his detention acted reasonably under the circumstances in bear no state criminal liability for their actions."The Sheriff Bill Gore wrote in a statement:"I am aware of the Medical Examiner's conclusion regarding the manner of death of Mr. Leal. I respectfully disagree with the classification of the manner of death in this case as a homicide.The pathologist wrote that his death was due to acute methamphetamine toxicity in the setting of agitation, physical altercation, and prone restraint. It was purely due to Mr. Leal's agitation that he was restrained. Peace officers have a duty to restrain those who are agitated and under arrest, as Mr. Leal was. Were it not for Mr. Leal's abuse of methamphetamine he would be alive today. The deputies and nurses on scene rendered immediate aid to Mr. Leal.Mr. Leal brought upon his own death with his choice to use methamphetamine. His manner of death is more accurately classified as an accident."It has not been made clear yet why the medical examiners report took 13 months to be released. 2135
