SAN DIEGO (KGTV) — A class-action lawsuit against the University of San Diego wants the school to refund students some tuition fees following the move to virtual learning.The lawsuit, filed by two students, claims the college owes students some of their tuition and fees back due to the switch to virtual learning.The suit says that when the school switched to virtual learning in Spring 2020, students were still charged full tuition even though "USD could no longer provide the promised hours of instruction." The lawsuit claimed that USD also increased its tuition on top of that."Similarly, students paid fees for services and access to facilities and equipment over the full semester. Though USD provided these services and facility/equipment access for only part of the semester, and could not provide them for the full semester, USD demanded that students pay fees for the entire semester," lawsuit documents state.A spokesperson for USD told ABC 10News they have not been notified of or served with the lawsuit.The lawsuit is seeking a "prorated portion of the tuition, fees and other related costs, proportionate to the diminished value of online classes and the amount of time in the Spring 2020 and following semesters when USD ceased in-person classes, campus services and access to campus facilities, continuing through to such time as USD reinstates in-person classes" for the two students who filed the lawsuit and "all others similarly situated." 1470

SAN DIEGO (KGTV) -- A driver escaped serious injury after falling asleep behind the wheel and crashing his pickup truck on state Route 52 in the Kearny Mesa area.The crash happened at around 11:45 p.m. Thursday on the eastbound side of SR-52 near the transition to Interstate 805, the California Highway Patrol said.ABC 10News learned a man was driving his work truck when he fell asleep, leading his vehicle to roll over several times across freeway lanes before coming to rest on the right shoulder.The driver was able to crawl out of the wreckage and was evaluated for minor injuries by paramedics at the scene. Family members rushed to the hospital after learning Estrada Romero had been struck by a hit-and-run driver. She was walking near Cesar Chavez Parkway, headed to a bus stop. According to police, a white Ford F-150 turning right onto Kearney Avenue climbed onto the sidewalk and hit her, before taking off."The driver never got out of the truck. Basically left her right there," said Ramos. The scene that first day at the hospital: a packed emergency room, as family, friends, and customers turned out."They loved her because she sold really good food," said Ramos.For more than a decade, Estrada Romero became well-known for selling tamales at parks and schools in Southcrest and Bay Terraces. Some of those customers heard about the crash and joined the family at the hospital."In a way I was happy to know they were here with us, supporting us," said Estrada Romero.On Sunday night, Estrada Romero was taken off life support. Today, a family searches for justice."Needs to turn himself in and pay ... pay for what he did to my mother," said Ramos.Police say the truck had a tinted back window and a white California sticker. SAN DIEGO (KGTV) -- A compromise in San Diego’s short-term rental debate may help the city get answers.In a news conference, San Diego City Councilmember Jennifer Campbell announced a compromise between “United Here,” which represents more than 6,000 local hotel, gaming, and hospitality workers, and Expedia Group, which is the parent company for short-term rental brands.Both sides have agreed on rules that Campbell said could help regulate the short-term rental industry -- by providing a balance between the hospitality industry and preserving the right of homeowners to use their property to help make ends meet.Under this agreement, it would cap the number of short-term rental permits that were granted and also establish a 2-night minimum stay.In turn, residents will be allowed to home share and those who rent out their homes part time -- usually during big events like Comic-Con, Pride, or December Nights -- wouldn’t have to pay the full permit costs.There will also be strict enforcement of the Good Neighbor Policy, which would include fines for those who violate it and possibly having permits revoked for repeat violations.This plan will be sent to the full council for further review. 1210

  

SAN DIEGO (KGTV) - A Father’s Day boat trip off the San Diego coast led to a rare wakeboarding encounter with dozens of dolphins for a Pacific Beach boy and his family. “It was a quick little boat ride and we saw paradise up there,” said Emiliano Gallego of Crown Point. Gallego and his three children decided to take a boat ride about 7:30 a.m. on a gloomy Sunday. They were about a mile off Pacific Beach when they realized their 24-foot Yamaha ski boat was surrounded by dolphins. “It was impressive,” said Gallego, who believes there were thousands of dolphins swimming with the pod. Gallego’s 9-year-old son Demi, an avid wakeboarder, grabbed his gear and jumped in the water. Gallego recorded the incredible scene. “At first, he was scared. He eventually just started enjoying the ride with the dolphins,” Gallego said. Gallego’s younger son and daughter didn’t want to jump in. “Too many dolphins,” said Gallego. After the spectacular ride, the family went out to breakfast, amazed at what they saw. “That was the best gift ever,” said Gallego. 1059
