A federal court in Texas sentenced ice cream manufacturer Blue Bell Creameries to pay .25 million in criminal penalties for shipments of contaminated products linked to a 2015 listeriosis outbreak, the Justice Department announced Thursday.Blue Bell pleaded guilty in May 2020 to two misdemeanor counts of distributing adulterated ice cream products.The sentence, imposed by U.S. District Judge Robert Pitman in Austin, Texas, was consistent with the terms of a plea agreement previously filed in the case.“The results of this investigation reflect the determination of the Defense Criminal Investigative Service to hold companies that sell food products to the military accountable and ensure they comply with food safety laws,” said Michael Mentavlos, Special Agent-in-Charge of the DCIS Southwest Field Office. “The health and safety of our service members and their dependents are of paramount importance.”The .25 million fine and forfeiture amount is the largest-ever criminal penalty following a conviction in a food safety case.“American consumers must be able to trust that the foods they purchase are safe to eat,” said Acting Assistant Attorney General Jeffrey Bossert Clark of the Justice Department’s Civil Division. “The sentence imposed today sends a clear message to food manufacturers that the Department of Justice will take appropriate actions when contaminated food products endanger consumers.”According to the plea agreement, Texas state officials notified Blue Bell in February 2015 that samples of two ice cream products from the company’s Brenham, Texas factory tested positive for Listeria monocytogenes, a dangerous pathogen that can lead to serious illness or death in vulnerable populations such as pregnant women, newborns, the elderly, and those with compromised immune systems.Blue Bell directed its delivery route drivers to remove the remaining stock of the two products from store shelves, but the company did not recall the products or issue any formal communication to inform customers about the potential Listeria contamination.Two weeks after receiving notification of the first positive Listeria tests, Texas state officials informed Blue Bell that additional state-led testing confirmed Listeria in a third product.Blue Bell again chose not to issue any formal notification to customers regarding the positive tests. Blue Bell’s customers included military installations.In March 2015, tests conducted by the Food and Drug Administration (FDA) and Centers for Disease Control and Prevention (CDC) linked the strain of Listeria in one of the Blue Bell ice cream products to a strain that sickened five patients at a Kansas hospital with listeriosis, the severe illness caused by ingestion of Listeria-contaminated food.At least three people in Kansas died as a result of the contamination, according to the CDC.The FDA, CDC, and Blue Bell all issued public recall notifications on March 13, 2015. Subsequent tests confirmed Listeria contamination in a product made at another Blue Bell facility in Broken Arrow, Oklahoma, which led to a second recall announcement on March 23, 2015.According to the plea agreement with the company, FDA inspections in March and April 2015 revealed sanitation issues at the Brenham and Broken Arrow facilities, including problems with the hot water supply needed to properly clean equipment and deteriorating factory conditions that could lead to insanitary water dripping into product mix during the manufacturing process.Blue Bell temporarily closed all of its plants in late April 2015 to clean and update the facilities. In that case, authorities have arrested the driver on charges of reckless endangerment and reckless driving.And most recently, multiple vehicles drove through a protest in Hollywood Thursday night, one of which struck and injured a person. That victim was transported to an area hospital with minor injuries, according to the Los Angeles Police Department.LAPD says a group of more than 300 protesters were marching near Sunset Boulevard when a blue pick-up truck maneuvered through the crowd and became involved in an altercation shortly after 9 p.m. As the driver of the truck attempted to get away from the situation, police say the vehicle struck a protester standing in the street.Moments later, police say a white Prius attempted to drive around the same protest and also became involved in an altercation with people in the crowd.“A black pick-up truck leading the protests accelerated and pinned that white Prius in, forcing it to come to a stop,” wrote police in a statement. “The driver of the Prius attempted to flee the area and reversed into a green mustang behind it. That vehicle was also participating in the protest.”Police say both the drivers of the truck and Mustang attempted to extract the driver of the Prius from the vehicle, but that driver was able to get away. Several blocks away, that motorist was detained by Hollywood officers, according to police.All the drivers and victims involved in both altercations have been identified by Hollywood officers and an investigation is ongoing.Protests are expected to continue throughout the coming days as people demand justice in the Breonna Taylor case.On Wednesday, the Kentucky grand jury indicted one of the three Louisville police officers who entered Taylor's apartment in March and fatally shot the emergency medical technician. However, the indicted officer isn’t being charged in connection with Taylor’s killing, he’s being charged with wanton endangerment for shots fired into her neighbor’s apartment. After the grand jury's charging decision was announced, the Kentucky attorney general held a press conference, during which he said the officers who shot Taylor were "justified" in their actions because they were responding to a shot fire by Taylor's boyfriend, Kenneth Walker, who has said that he believed the police were intruders. 3027

  

A lock of Abraham Lincoln’s hair, wrapped in a bloodstained telegram about his 1865 assassination, is up for sale. Boston-based RR Auction says bidding has opened online for the items ahead of a live auction scheduled for Sept. 12. Measuring roughly 2 inches long, the bushy lock of hair was removed during Lincoln’s postmortem examination after he was fatally shot at Ford’s Theatre in Washington, D.C., by John Wilkes Booth. The auction house says it was given to Dr. Lyman Beecher Todd, a Kentucky postmaster and a cousin of Mary Todd Lincoln, the 16th president’s widow. 582

  

A chickenpox outbreak among students at Asheville Waldorf School in North Carolina has grown to 36 cases as of Monday, and exemptions from vaccination were a contributing factor, according to the Buncombe County Health Department, which has been monitoring the situation since the end of October.Asheville Waldorf School, which serves students from nursery through sixth grade, is part of an educational movement that subscribes to a philosophy focused on physical activity and learning through hands-on tasks, according to its website. There are more than 900 Waldorf schools in 83 countries, and the Asheville school, which was founded in 2009, is one of about 160 in the United States.The school is closed for Thanksgiving break and could not be reached for comment.Chickenpox is a very contagious disease that causes a blister-like rash, itching, tiredness and fever, according to the US Centers for Disease Control and Prevention. The disease is caused by the varicella-zoster virus, and a vaccine was introduced in 1995. Two doses of the vaccine, given at ages 12 months through 15 months and then again at 4 through 6 years, are about 90% effective at preventing chickenpox. 1189
