SAN DIEGO — The banner atop North Park’s Rudford’s Restaurant reads, “Stand up small business.”The word defy is written just below.Defy is exactly what father-and-son team Jeff and Nicholas Kacha planned to do over the weekend - until the community got word. They planned to continue serving food indoors even though the county on Saturday moved into the state’s most strict tier of coronavirus restrictions - the purple tier. But they were faced with threats of broken windows, picketing and lost customers.“It's been a nightmare that just keeps getting worse,” Jeff Kacha said.Redfords, which is not serving indoors, laid off 10 staffers at the news. Sales are down 40 percent. And the 60 turkeys they ordered for Thanksgiving may now not sell.Gov. Newsom says he remains concerned over the recent increase in the rate of coronavirus cases. The state on Monday moved 41 of the state's 58 counties into the purple tier. And even restaurants that look full outside say it hurts. At Puesto in La Jolla, the patio was busy all weekend, but co-founder Eric Adler wasn't celebrating“It looked full and it was full but that still translates to reduced revenue of around 30 percent for us,” he said. But other businesses weren't hit as hard.Point Loma Sports Club already had the bulk of its equipment outside under tents from earlier in the outbreak. When the county entered the purple tier, general manager Bryan Welch moved even more out for the members.“We may do this again two more times, four more times,” he said. "We're trying not to be shocked by it, we're just trying to adapt, and if you can adapt, we just feel like we can thrive.”The challenges, however, could grow as the weather cools into the winter months. 1724

SAN BERNARDINO, Calif. (KGTV) -- Prosecutors said Monday that a California man killed his business partner and his family out of greed, according to the Associated Press. Prosecutor Sean Daugherty told jurors that Charles Ray Merritt wrote checks totaling more than ,000 on his partner’s QuickBooks account after the family disappeared. The comments came during opening statements in the trial for the alleged murders of Joseph McStay, Summer McStay and their three and four-year-old sons. Prosecutors also say that, while being questioned about the family’s disappearance just days after they went missing, Merritt kept referring to Joseph in the past tense.Outside the courtroom, defense attorney Rajan Maline said Merritt’s livelihood depended on McStay being alive. The McStays disappeared from their Fallbrook home in early February 2010. Days after they were last seen, the family’s SUV was found abandoned at a strip mall parking lot in San Ysidro.RELATED: Trial set to begin in McStay family murder caseIn 2013, the bodies of the family members were found in the Mojave Desert, near Victorville. Prosecutors said the family died from blunt-force trauma to their heads. Authorities found a sledgehammer, believed to be the murder weapon, in one of the graves.According to court documents, investigators believe Summer McStay may have been raped before she was killed. Merritt was arrested in connection with the killings in November 2014 after sufficient evidence linking him to the case, including DNA, was discovered.Authorities alleged Merritt killed the family members inside their home and then buried them in the desert. Merritt also tried to paint over the crime scene, according to authorities.During Monday’s opening statements, jurors in the San Bernardino County courtroom are expected to hear a tape of Merritt being questioned by investigators.Merritt, 61, has pleaded not guilty to charges of murder and is being held without bail.Prosecutors are seeking the death penalty in the case. 2017

SACRAMENTO, Calif. (KGTV) -- Governor Gavin Newsom is proposing withholding gas tax funding for cities that don’t build enough housing. The proposal, released Monday, sets higher short-term housing goals that cities and counties would be required to meet. If housing goals aren’t met, “Local Streets and Roads funds may be withheld from any jurisdiction that does not have a compliant housing element and has not zoned and entitled for its updated annual housing goals.”RELATED: California lawmakers want 0 billion toward clean energy, would pay with gas tax fundsIf passed, the plan would withhold gas tax funding for road repairs beginning on July 1, 2023. “Our state’s affordability crisis is undermining the California Dream and the foundations of our economic well-being,” said Governor Newsom. “Families should be able to live near where they work. They shouldn’t live in constant fear of eviction or spend their whole paycheck to keep a roof overhead. That’s increasingly the case throughout California.”According to a news release, the proposal would provide 0 million in support and incentives to help plan and zone for increased housing goals. SB1 was signed into law by Governor Jerry Brown and increased the gas tax by 12 cents per gallon and registration fees by as much as 5.
