SAN DIEGO (AP) — A military judge on Monday took the rare step of removing a prosecutor accused of misconduct from the war crimes case of a decorated Navy SEAL.Capt. Aaron Rugh ordered Cmdr. Christopher Czaplak removed from the case of Operations Chief Edward Gallagher after defense lawyers accused the prosecution of spying on their emails, according to the ruling.The defense asked Rugh to dismiss the case or remove prosecutors because of a surreptitious effort to track defense emails without court approval in an effort to find the source of news leaks.Rugh said it was not in his power to determine prosecutorial misconduct, but there was the possibility of a conflict of interest that required Czaplak to be removed, the ruling said.Rugh has not yet ruled on whether to dismiss murder and attempted murder counts against Gallagher.Last week, Rugh unexpectedly released Gallagher from custody as a remedy for interference by prosecutors.The removal could delay the trial scheduled to start June 10.Republicans in Congress have rallied in support of Gallagher, saying he has been mistreated. SAN DIEGO (CNS & KGTV) -  Police believe a woman who crashed her car into a home in Talmadge  was intoxicated at the time.The crash happened about 2:30 p.m. Saturday at a home on Winona Avenue near Lucille Drive, according to San Diego police.A 23-year-old woman was driving her 2017 Honda on Winona Avenue at a high speed when she veered off the road and ran into the corner of a nearby home, according to San Diego Police Officer Robert Heims. The woman suffered serious head injuries and fractures to her right leg, and had to be taken to a hospital.No one in the home was injured.Police processed the driver for allegedly driving under the influence, Heims said.A building engineer was called in to assess structure damage, and the Red Cross helped with two residents displaced by the crash, San Diego Fire-Rescue spokesman Jose Ysea said. 880

SAN CARLOS, Calif. (KGTV) -- A grandmother and several children were forced to run out of a San Carlos home that burst into flames Saturday night. The fire broke out on Park Ridge Boulevard in San Carlos around 10 p.m. Saturday. Fire crews were able to stop the flames from spreading to a nearby canyon. Neighbors say they heard what sounded like explosions before they ran out and saw the home on fire. A woman was home watching her grandchildren when the house caught fire. All those inside were able to make it out safely. San Diego Fire-Rescue says it was initially challenging to battle the flames because the closest hydrants are located hundreds of feet away. “I went across the street and pounded on the door and the window to make sure that nobody was in there. Don’t think they were. There was just a lot of explosions and tires I guess blowing up. It was just In full flames when it happened,” one neighbor said.
