SAN DIEGO (KGTV) — The family of 19-year-old Dylan Hernandez, the San Diego State University (SDSU) freshman who died after falling off a bunk bed last November, say they are concerned about the investigation conducted by Campus Police and the University. The family believes the University Police Department is not pursuing certain angles, including a possible cover-up.Last November, Dylan Hernandez died after attending a Phi Gamma Delta fraternity party. In police reports obtained by the San Diego Union-Tribune, the freshman made it back to his dorm room around midnight. On the morning of Nov. 7, 2019, he fell off the top bunk bed and hit his head. An autopsy concluded that Hernandez had fractured his skull, suffering from a brain bleed that ultimately led to his accidental death. Reports also state that his blood-alcohol level was about 0.23, nearly three times the legal limit. RELATED: San Diego State suspends 14 fraternities after student is hospitalizedIn a newly released statement to 10News, the Florida native's family said they are disturbed at how poorly Campus Police and San Diego State are handling the investigation. "The Hernandez family is concerned because witnesses they provided to SDSU and UPD still have not been questioned," George Kindley, Hernandez family lawyer, said. The same University Police reports state that UPD never interviewed anybody from the Phi Gamma Delta fraternity. They also never sought out search warrants for Snapchat videos or phone records, despite knowing that some fraternity brothers instructed others to delete possibly incriminating videos and messages. According to the report, one of those messages read, "Remember, silence is golden."This was a shocking revelation to the family. The Hernandez family wants SDSU and UPD to take action now to prevent future tragedies like this one from occurring." They said:"The preliminary, incomplete police report was provided to a representative of the Hernandez family in an effort to be as supportive and transparent with the family as possible during a difficult time for them as they are mourning the tragic loss of their loved one. Details of the incomplete report, released late last year, was not meant to be shared with the public as it compromises our ongoing investigation and can hinder witnesses from sharing information. "The Hernandez family also told 10News they are questioning the SDSU's bunk bed safety enforcement. They said:RELATED: SDSU launches two task forces in wake of student's death"SDSU needs to provide all students in school issued bunk beds with a safety rail that actually meets minimum safety standards, not a pseudo safety rail that SDSU knows failed and caused other students injuries in the past." They said: "All lofted beds and bunk beds located within SDSU residence halls are produced by national manufacturers and meet California State Fire Marshal requirements. Colleges and universities are not required to follow U.S. Consumer Product Safety Commission guidelines defining requirements for childrens' beds." SAN DIEGO (KGTV) - The local ACLU is now firing back at ICE officials after news broke Tuesday of a new measure in place of blocking certain calls from detainees’ being housed at the Otay Mesa Detention Center.“For the government to interfere with the people's ability to make those calls and advocates abilities to receive those calls is deeply troubling,” said ACLU senior staff attorney Mitra Ebadolahi. She’s now sent a letter to both ICE and ICE’s contractor, CoreCivic, demanding answers and writing in part, "…legally, these blockages may violate the constitution."On Tuesday, Alex Mensing with Pueblo Sin Fronteras said his number was blocked along with numbers to another immigrants rights' activist group, Otay Mesa Detention Resistance. Mensing told ABC 10 News, “Last time I checked, in the United States we're not supposed to censor people's ability to denounce abuses, to denounce medical negligence, to denounce physical assault by guards…by private prison guards or ICE officers against the people.”The Otay Mesa Detention Center has come under fire for allegations of poor health conditions and abuses inside as hundreds of people being housed there were testing positive for COVID-19.“Without more information, it does appear that his kind of blockage is either retaliatory or at least viewpoint discriminatory,” added Ebadolahi.The ACLU is demanding that ICE remove the blockage and offer a response by next Tuesday.CoreCivic referred ABC10 News to ICE which sent a statement Wednesday reiterating part of a statement from Tuesday which reported that it temporarily blocked detainee calls to a specific San Diego area phone number after calls resulted in disruptive behavior from detainees. The full statement from Wednesday is below.“U.S. Immigration and Customs Enforcement (ICE) has temporarily blocked detainee calls at Otay Mesa Detention Center (OMDC) to a specific San Diego area phone number after detainee calls to this number resulted in detainees exhibiting highly disruptive behavior, threatening the health and security of other detainees and employees at the facility.""ICE fully respects the rights of those in our custody to peacefully express their opinion without interference. This action was taken out of concern for the safety of those in our custody. ICE takes very seriously the safety and well-being of those in our care and will take all necessary steps in order to ensure the continued safety of both detainees and staff. San Diego ICE Enforcement and Removal Operations (ERO) management will continue to monitor the situation. Temporary blocked phone calls may be restored when deemed safe to do so.""All ICE facilities provide detainees with reasonable and equitable access to telephones. SAN DIEGO (KGTV) -- The man accused of killing his stepmother and burying her body in the backyard of a Tijuana home pleaded guilty to unrelated drug charges Tuesday. Aaron Seth Juarez, 20, pleaded guilty to possession of heroin for sale and agreed to a two-year state prison sentence. Juarez was taken into custody in San Diego earlier this month for probation violations. He’s also wanted by the Deputy Attorney General of Justice in Tijuana on suspicion of killing Fernanda González Serrano in February.RELATED: Man suspected of killing stepmother found in Tijuana backyard arrestedGonzález was last heard from on Feb. 2.
