California will end the cash bail system in a sweeping reform for the state. Rather than requiring defendants to pay in order to be released before trial, their release will hinge on an assessment of their risk to public safety."Today, California reforms its bail system so that rich and poor alike are treated fairly," Gov. Jerry Brown said in a statement.Brown signed the bill Tuesday, and the new law goes into effect October 1, 2019.Critics have long contended that the money bail system perpetuates inequality. While some people are able to quickly get out of jail by posting bail, people who aren't able to afford it sit in jail until the court takes action, or until they work with a bail bond agent to secure their freedom, which can leave them in debt."Abolishing money bail and replacing it with a risk-based system will enhance justice and safety. For too long, our system has allowed the wealthy to purchase their freedom regardless of their risk, while the poor who pose no danger languish in jail," said Assemblymember Rob Bonta, one the lawmakers who introduced the bill, in a statement.Under the new law, a pretrial assessment would be done by either court employees or a local public agency that has been contracted to determine a defendant's risk. That entity would assess the likelihood that the person will not appear in court or commit a new crime while released, and would make a recommendation for conditions of release. The pretrial assessment services will not release a person arrested for violent felonies.The California Money Bail Reform Act, also known as Senate Bill 10, passed in the State Senate with a vote of 26-12, and the General Assembly by 42-31."SB 10 puts all Californians on equal footing before the law and makes public safety the only consideration in pretrial detention. This critical reform is long overdue," Toni Atkins, Senate president pro tempore, said in a statement.But the ACLU in California expressed disappointment over the bill, saying it "is not the model for pretrial justice and racial equity that California should strive for.""It cannot guarantee a substantial reduction in the number of Californians detained while awaiting trial, nor does it sufficiently address racial bias in pretrial decision making," said the three executive directors of the California ACLU affiliates, Abdi Soltani (Northern California), Hector Villagra (Southern California) and Norma Chávez Peterson (San Diego & Imperial Counties). "Indeed, key provisions of the new law create significant new risks and problems."The organization pulled its support for the bill earlier this month as the it underwent changes in the state legislature. 2705

CAMPO, Calif. (KGTV) -- Three people were taken to the hospital and two others are in custody after a Border Patrol chase led to a crash in Campo Tuesday night. According to Border Patrol, agents tried to stop a 23-year-old San Diego resident driving a blue Mazda MPV around 5:05 p.m. near Old Highway 80 and McCain Valley Road for possible immigration-related violations. The driver refused to stop, sparking the chase. During the chase, agents say the woman drove onto Shasta Way at a “high rate of speed” before driving over a dip and losing control of the vehicle. According to border patrol, the 23-year-old had minor injuries and was taken to the hospital. Border Patrol says four men were found in the back of the vehicle. The men are between the ages of 24 and 39 and all claim to be residents of Mexico. Two of the men were taken to the hospital for treatment while the other two were taken into custody after refusing medical aid, Border Patrol says. 1139

  

CARLSBAD, Calif. (KGTV) — Carlsbad Police arrested a man they believe tried to break into multiple homes early Saturday.Police say 26-year-old Esparza Alan Arias, of Los Angeles, was arrested Saturday and charged with residential burglary and other charges. Police are asking residents to check their cameras if they have any for images of Arias.Police say the first incident happened in the 6500 block of Paseo Frontera at about 12:30 a.m., though the victim didn't report it until about 1:30 a.m. Police say while inside, Arias reportedly touched the male resident while he was sleeping and woke him up. Arias then fled after being confronted, police said.The second incident happened just after 1:10 a.m. in the 2900 block of Unicornio St. Residents awoke to find Arias in their home, and he fled after being confronted, according to police.Just before 1:30 a.m., a third incident occurred in the 3000 block of Xana Way. Police say a resident of the home found Arias trying to enter and confronted the suspect through a window. Arias fled and the resident walked outside and fired a warning gunshot into the air, police added.Police were investigating the other incidents when they heard the gunshot. Arias was found nearby hiding behind a vehicle, police say.Arias was booked into Vista Detention Facility.Police ask anyone in the area to check their cameras and call 760-931-3819 to report any sightings of Arias. 1426

  

CARLSBAD (KGTV) — A woman visiting Legoland in Carlsbad was stunned when she spotted someone angling their phone into her changing stall at the water park. "I saw a phone at the corner, which is under the divider of the stalls. So I called out to that person, 'Excuse me, what's that phone doing there?'" Carisma Jucaban recalled.She thought it may have been a child or just an accident, but it was not."As soon as I heard the door open, I ran out to take a look, but he was already making a turn. And I was kind of standing there like, 'What just happened?' My husband is looking at me like, What's going on?' I was like, 'Did you see that guy?'" Jucaban explained.Jucaban immediately reported the man to Legoland security and within hours they found him. Carlsbad police arrested 26-year-old Anthony Galindo of Los Angeles. "They looked through his phone and found a bunch of disturbing — they didn't really specify what it was — I don't really want to know. And from there, the police arrested him," she said.Legoland released a statement that reads in part: "Park staff acted promptly as the safety and security of park guests is the number one priority. Park officials are assisting Carlsbad police with the investigation."The information about the suspect's phone was given to Jucaban by security. It has not been verified by Carlsbad police. 1356
