SAN DIEGO (KGTV) - — San Diegans are not allowing the pandemic to dampen their holiday spirit. This much was apparent at the beginning of Taste of December Nights.Within moments of its opening Friday, a line of cars streamed down Park Boulevard, waiting for a chance to order food from about a dozen vendors lined up at Inspiration Point in Balboa Park. "We've been going to December nights every year, but we didn't want to miss it this year," said Jasper Pascual, of National City, who came with his girlfriend Wendee. "It's something new, something interesting."The pandemic has upended decades of tradition, including December Nights in Balboa Park. Thousands normally pack the event in Balboa Park, enjoying holiday decorations, museums and food. This year, the event is a drive through for food vendors, with participants required to stay in their cars and wear masks. Pedestrians, bicyclists and scooter riders are not allowed. "This event obviously is re-imagined, it's different, but again I think it's the type of event that I think is just what some folks will need," Mayor Kevin Faulconer said as he kicked off the event. San Diegans appeared to agree, waiting in stop-and-go traffic to get into one of two ordering lines. A worker from one of the eateries comes to the window, takes an order, and eventually brings the food. Options included coffee, mini donuts, Cajun and kettle corn."Just tell people be super, super patient, bring some music, relax, have fun, enjoy it, because it's going to be a while," said Hellen Silva, who came with her husband and mother. SAN DIEGO (KGTV) -- A driver apparently lost control of his SUV and crash landed on the roof of a University City home early Tuesday morning.The crash happened at around 1:15 a.m. in the 3000 block of Pennant Way, according to San Diego police.Bill Crane told ABC 10News that after he heard a loud crash, he came out of his home and saw the male driver in his yard and the Jeep Cherokee Laredo on top of his next-door neighbor’s house."I was asleep at the time and I heard this crash, and I came out and I looked around and saw a guy kind of wandering near behind me, by what's left of the tree, and he was just kind of stumbling and I couldn't figure out what the hell that was. Because you usually don't think of a car being on someone's roof. So, when I finally figured that out, I went in to get my phone, and came back out and called 911, and he was gone,” Crane said.Crane called 911 to report the crash, and he then called the woman who lives in the house. However, Crane said the woman initially didn’t believe her.Crane added, "I called her twice and she said, 'What, a car on my roof? I'm not going out there, I can't believe that.’ It is pretty unbelievable.”ABC 10News learned the woman was asleep at the time and never heard the crash. She believes the SUV was coming down Pennant Way, somehow veered on a resident’s front lawn and launched onto her garage.A towing service used a crane to remove the Jeep from the roof of the home’s garage.There is no word on how much damage the home sustained, but inspectors said the house was structurally sound despite the wreck.No one was hurt in the crash.As of late Tuesday morning, police have not tracked down the SUV's driver. 1692

SAN DIEGO (KGTV) -- A City of San Diego employee says she was sexually harassed by her boss on the job and now the man accused of the harassment is asking the city to pay for his legal defense.The woman says her supervisor groped her and grabbed her arm hard enough to tear open a recent surgical wound, causing it to bleed. The parks and Rec Department employee alleges that her supervisor, Frank Cardenas, sexually harassed her, even touching her inappropriately at work.Josh Gruenberg is representing the city staffer and says she has put up with enough. "He pinned her legs against her desk in her cubicle he wrapped her up in his arms and pulled her close multiple times,” said Gruenberg.The victim says she rejected every overture Cardenas made. At one point, the victim says Cardenas told her "if she wanted to get the support to grow within the city she should only care what Cardenas thinks or wants.""He really tried to get her to put his trust in him and that it would be good for her career,” Gruenberg said.The lawsuit also claims that Cardenas gripped the victim’s arm so hard that he reopened a surgical incision, causing her to bleed at work."And all of this took place in the workspace. This was not something that involved the two of them going away for a weekend. This all took place on the job,” Gruenberg said.Cardenas declined a request for an interview. Monday night, the City of San Diego voted unanimously not to pay for Cardenas’s legal fees with city money and said they have no further comment. 1535

SAN DIEGO (KGTV) - A former employee of the San Diego Metropolitan Transit System is suing the agency for retaliation after he said he stood up for a co-worker.Ivan Augustino moved to the United States from Sudan and still volunteers with projects for his native country. He started working for MTS in 2015.“It was pretty good,” Augustino said.Augustino worked as a Senior Applications Developer.“I am the main guy that deals with the complicated back end computer codes,” Augustino said.In 2017, he said he made a move that changed everything. It started with a co-worker.“One morning, she walked into my office pretty much in tears,” Augustino said.He said that a co-worker confided to him the Chief Information Officer discriminated against her when she asked about a promotion. The lawsuit filed against MTS claims the CIO told Augustino’s co-worker she was “not qualified for the job because of her age, her marriage and family planning status, and her relationship to an active duty military service member.”“The other question she also asked was, how old are you? You seem like you are at an age where you would be having kids,” Augustino said. It was a shocking conversation.“You know, that is wrong,” Augustino said.After his co-worker told him what happened, he first asked advice from another co-worker who then took it to human resources. Augustino said his co-worker did not want to bring the complaint to HR.“The last thing that anyone within the IT department wants is to take an issue to HR because once you report it to HR, there is going to be retaliation,” Augustino said.And that’s what happened, according to the former MTS employee. Initially, he was concerned how MTS investigated the complaint.“I was expecting someone to at least come and talk to me, but no one spoke to me,” Augustino said.He said retaliation began by the CIO and his direct supervisor.“The way they treated me just changed,” Augustino said.He claimed management suggested they would give him recommendations if he found another job. On another occasion, Augustino said they “mocked [his] English as a second language” in an email. On top of that, he said 98 hours of paid time off promised to him for working overtime on a big project was revoked, along with a promised promotion.“Coming from where I come from, I just felt like I did not even know what to do,” Augustino said.Feeling “degraded” and “intimidated”, he submitted a letter of resignation. However, he said he gave management an option.“If you can address this issue and the executive team and bring what I view as retaliation to a stop, I will pull my resignation,” Augustino said. Instead, he said he was fired and walked out of the building by security. His termination came a little over a month after he voiced his concerns about his female co-worker.A spokesperson for MTS told Team 10: “There is absolutely no validity to any of Mr. Augustino’s claims.”When asked if he would defend his co-worker again, Augustino said “absolutely.”Attorneys Zachary Schumacher and Daniel Goularte represent Augustino."This is absolutely a David versus Goliath situation," Schumacher said.Schumacher said fear is why people don't speak up."I like to compare it to battered wives syndrome, where you essentially have this person or in this case this entity who has this major power and balance who is doing all sorts of awful things and figuratively at least, battering its employees and yet they don't leave.
