The Trump campaign has dropped a central part of its lawsuit that seeks to delay the certification of election results in Pennsylvania, the state which proved to be the tipping point for Joe Biden in clinching the presidency.On Sunday, the Trump campaign dropped a portion of a lawsuit that alleged that more than 600,000 mail-in and absentee ballots were processed without Republican poll-watchers present. The claim has been a central part of President Donald Trump's argument that the 2020 election has been beset by widespread voter fraud.The Trump campaign's lawsuit now only focuses on claims that Republicans were "illegally disadvantaged" because some voters in Democratic-leaning counties were afforded the ability to fix mistakes on their mail-in ballots, a process called "curing." The Washington Post reports that the issue would likely only affect a small number of votes.Ballot curing is a process that takes place in several states. According to The Associated Press, there is no provision in Pennsylvania state law that prevents counties from affording voters the opportunity to cure ballots.Biden currently holds a lead of about 70,000 votes over Trump, with nearly all of the votes counted.Despite his campaign's altered lawsuit, Trump on Sunday continued to claim on Twitter — without providing evidence — that poll watchers "were thrown out of vote counting rooms in many of our States."Late Sunday evening, Trump tweeted, "I WON THE ELECTION!" a claim that quickly prompted Twitter to add a clarification to his message clarifying that "official sources have called this election differently." 1622

The state of Texas has already had nearly as many voters cast ballots in the 2020 election than in the all of the 2016 election.This year’s election is still five days away.Throughout the country, lines have formed at early voting centers to cast a ballot in next week’s election. Other national polls have similarly showed Biden leading early voting by up to a 2-to-1 margin.The challenge for Trump will be to make-up ground on Election Day. The same CNN poll showed Trump leading 59-36 among those who plan on voting on Election Day. Trump will need a strong Election Day turnout in order to overcome the lead Biden has likely established in early voting. Things like weather, daycare, illnesses, work and other factors that keep people from voting on Election Day could play against Trump on Election Day.While the news out of Texas may be discouraging for Trump, Pennsylvania and Ohio, two other key battleground states, have not seen nearly as much early voting as Texas. In Ohio, the early vote equals 43.8% of the total 2016 vote. In Pennsylvania, the early vote equals 34.3% of the 2016 vote.Similarly to Texas, Georgia, which has been a traditional GOP stronghold in recent decades, is a battleground state in 2020. There, the number of early voters equals 82% of the 2016 count.How votes will be tallied on Election DayEach state will release early voting numbers differently, and with such stark differences in how Trump and Biden voters are casting ballots, the numbers could have significant swings.In Pennsylvania, the early vote is expected to come in last after all ballots counted on Election Day are tallied. That means Pennsylvania will likely show a significant lead for Trump on Election Night, with the former vice president trying to make up ground. Some counties have said they will not even start counting the early vote until the day after the election.In close states that release the early vote first, Biden will likely amass a huge lead that will slowly evaporate throughout the night. For states that will wait to count the early vote, Trump will likely hold a huge initial lead. Election Night projections might take longer this year to account for how various states are counting the vote. 2977

The Supreme Court Monday rebuffed efforts by states to block funding to Planned Parenthood.It left in place two lower court opinions that said that states violate federal law when they terminate Medicaid contracts with Planned Parenthood affiliates who offer preventive care for low income women.It would have taken four justices to agree to hear the issue, and only three conservative justices -- Clarence Thomas, Samuel Alito and Neil Gorsuch -- voted to hear the case.Chief Justice John Roberts and Justice Brett Kavanaugh appeared to side with the court's liberals in not taking up the case -- showing an effort to avoid high-profile abortion-related issues for now.Roberts and Kavanaugh "likely have serious objections," said Steve Vladeck, CNN Supreme Court analyst and professor at the University of Texas School of Law. "But such votes seem to be a signal that they would rather avoid contentious, high-profile disputes for now, at least where possible."The case concerned whether states can block Medicaid funds from Planned Parenthood affiliates that provide such women with annual health screens, contraceptive coverage and cancer screening.Thomas wrote a dissent for the three conservatives, saying the court isn't doing its job."What explains the Court's refusal to do its job here?" Thomas wrote."I suspect it has something to do with the fact that some respondents in these cases are named Planned Parenthood," he wrote."But these cases are not about abortion rights," he said. "They are about private rights of action under the Medicaid Act.
