SAN DIEGO (KGTV) -- A brush fire burning near the border in Otay Mesa grew to 10 acres Monday afternoon, according to Cal Fire. Thick, white smoke could be seen billowing from miles away. Cal Fire originally reported the fire around 4 p.m. burning in Tin Can Canyon. The fire then grew to five acres before Cal Fire posted a third tweet, noting that the blaze had grown to 10. "Firefighters continue to make progress," the agency said Monday evening. SAN DIEGO (KGTV) - A 10News investigation has revealed that the California department responsible for the state’s child welfare program does not maintain data regarding all deaths of children in foster care.  The revelation is prompting calls for immediate action to child welfare services from at least one San Diego-based politician.State law requires counties to report any child death that is determined to be suspected to be the result of abuse or neglect to the California Department of Social Services.  According to the CDSS, each county in California is required to keep track of every foster child that dies while in its custody.Counties are also responsible for reporting all high profile incidents that occur in foster homes to the State Department of Social Services. High profile incidents would include incidents involving death or serious injury. But the CDSS has no master data list available regarding foster deaths and says that information is maintained at the county level.Using open records laws Team 10 collected the total number fatalities of children residing in a foster placement from all 58 counties in the state since 2010.The numbers show more than 250 kids died during that time across the state. 1290

  

SAN DIEGO (CNS) - The state Supreme Court Thursday ruled that a San Diego citizens' initiative that cut back city employee pensions was illegally placed on the ballot, and ordered an appeal court to consider a remedy.Proposition B, initially approved by voters in 2012, eliminated guaranteed pensions for new city employees, except police officers, and replaced those benefits with 401(k)-style retirement plans.In 2015, one of the city's largest public sector unions challenged the benefit system, alleging former Mayor Jerry Sanders and other officials illegally placed the measure on the ballot without conferring with labor groups. The Public Employees Relations Board ruled with the union, but the Fourth District Court of Appeal reversed the decision in April 2017.Now, the appeal court's decision is overturned."We reverse the Court of Appeal's judgment and remand for further proceedings to resolve issues beyond the scope of this opinion," wrote Associate Justice Carol A. Corrigan in Thursday's decision, in agreement with the other five justices.A city spokesperson couldn't be reached for comment.The court ruled that although it was a citizens' initiative, Sanders' support of Prob B as policy warranted engagement with the unions under the Meyers-Milias-Brown Act, which gave city and county employees the right to collective bargaining in 1968.Governing bodies "or other representatives as may be properly designated" need to engage with unions "prior to arriving at a determination of policy or course of action," according to the act.Sanders had said he supported the measure as a private citizen, not a public employee. The Supreme Court ruled that Sanders did use the power of his office to push the initiative, however."He consistently invoked his position as mayor and used city resources and employees to draft, promote and support the Initiative. The city's assertion that his support was merely that of a private citizen does not withstand objective scrutiny," Corrigan wrote.In overturning the Public Employees Relations Board ruling in 2017, the appeal court took an "unduly constricted view of the duty to meet and confer," according to the Supreme Court ruling.The Supreme Court ruled that the appeal court address an "appropriate judicial remedy" for the illegal placement of the initiative on the ballot.The Public Employees Relations Board had previously ruled the city must pay employees "for all lost compensation" related to lost pension benefits, which would cost millions of dollars.The 401(k)-style system was originally intended to save taxpayers money by reducing future pension liabilities. SAN DIEGO (KGTV) - A BB gun shooting spree has neighbors frightened Sunday after more than a dozen incidents across San Diego.At the corner of L Street and Sixth Avenue a woman was shot in the arm overnight, according to San Diego Police. She was walking in a small group and one of the men was an exhibitor at Comic Con, staying at the Omni Hotel, where they were headed before the shooting. That man, Sal Abbinanti, said "The girl I was with said a guy in a white car in the back seat, she heard a trigger sound and then she's like oh I think I just got shot which kinda got out attention and then we saw it was bruised and bleeding and it looked like a BB." "There's just so much security down here, so many San Diego police down here. I was surprised that this guy was dumb and brazen to do something like that," he said the hotel provided excellent care to his friend.Over in National City and Paradise Hills, at least a dozen cars were hit.Coronado Police say at least 11 businesses were hit.Downtown, police reported four more instances of people being shot at or hit by BB guns.The rash of crimes comes after 10News reported more than a dozen businesses and car windows busted by BBs in the past month:June 24th – Numerous vehicle windows were vandalized in the Point Loma, Ocean Beach and Mission Hills neighborhoods.July 1st and July 2nd - Three businesses in the Hillcrest neighborhood were vandalized.July 2nd - Two businesses in the Park West neighborhood were vandalized.July 2nd and July 3rd – Numerous vehicle windows were vandalized in the Clairemont neighborhood.July 6th - Three businesses and one vehicle were vandalized in the Midway area. A dark colored SUV is suspected in these cases.July 7th - Five businesses in the College area were vandalized.July 8th - One home in the Lake Murray neighborhood was vandalized.According to California law, negligent discharge of a BB gun resulting in injury could mean up to a year in jail.Police from the corresponding agencies are working on these cases.
