VISTA (CNS) - An intoxicated driver who struck a homeless man in Oceanside and continued driving for more than a mile, even though the victim's body had gone through her windshield and ended up on the front seat, was sentenced Wednesday to 15 years to life in state prison.Esteysi "Stacy" Sanchez, 31, was convicted in April of second-degree murder, gross vehicular manslaughter and hit-and-run in the death of 69- year-old Jack Ray Tenhulzen. At one point, the sentencing hearing was interrupted because the defendant was sobbing uncontrollably, said Deputy District Attorney Robert Bruce.RELATED: Woman accused of hitting pedestrian, driving with his body in windshield found guiltyThe prosecutor told jurors that Sanchez displayed a conscious disregard for human life when she drove drunk and ran over Tenhulzen on a sidewalk on Mission Road near the state Route 76 bridge the morning of June 27, 2016.The victim went through the windshield and into the passenger seat of her car. Part of one of his legs -- which was severed in the accident -- was found at the back of the car near the rear window.Tenhulzen was hit so hard that he was ripped out of his pants and shoes, authorities said. After a night of drinking, Sanchez left a hotel room the next morning and was told by a male friend that she was too drunk to drive, Bruce told the jury.Defense attorney Herb Weston argued that Sanchez was tired and fell asleep behind the wheel and rode up on the sidewalk, striking Tenhulzen. He said Sanchez "freaked out" when she saw the victim's body in her car and kept driving, finally stopping a block from her home.Sanchez, who lived in Oceanside, still had shards of glass in her hair when she was taken into custody. Her blood-alcohol content was measured at between .18 and .19 percent -- more than twice the legal limit of .08 percent -- two hours after the collision, Bruce said. 1891

VISTA (CNS) - An Oceanside man convicted of abusing his neighbors' dogs, including gouging out the eye of a Siberian Husky, was sentenced to nearly 10 years in custody Friday.Jurors last summer found 37-year-old David C. Herbert guilty of six counts of animal cruelty, one count of burglary and four misdemeanor counts of vandalism for harming two separate families' dogs, one of which remains missing.Herbert was handed an 8-year, 8-month prison term in a Vista courtroom Friday morning, to be served along with a one-year jail term on the misdemeanor counts.RELATED COVERAGE: Navy veteran accused of torturing dogs ordered to stand trialMan arrested for assaulting huskies, stealing Oceanside dogsSearch warrant served in Oceanside dog torture caseStalker targets and tortures Oceanside dogs, neighbors sayAuthorities said Herbert targeted a family living next door to him in north Oceanside, burning their two huskies, Cocayo and Estrella, with caustic chemicals and repeatedly slashing the tires on the family's vehicles in 2017.The family moved out of their rental home after discovering that someone had broken in and gouged Estrella's eye out.About one month later, a new family with two dogs moved in, and within two days their 9-year-old Golden Retriever Lala disappeared. The dog has never been found and is presumed dead.Police found a small amount of blood in Herbert's car and on a baseball bat he owned.Herbert, who represented himself at trial, testified that Lala jumped in his car and he was about to take her to a shelter when she jumped out and ran off. 1580

VISTA, Calif. (KGTV) -- The Vista Unified School District confirmed that a student at one of its high schools tested positive for COVID-19.According to the district, a positive case in a student was reported at Mission Vista High School on Tuesday, resulting in about 130 students in the four classes the positive student attended to be placed into a 14-day quarantine. Those students will pivot to virtual learning.Staff members involved in these classes or who may have come into contact with the student were also quarantined, the district said."The student did not come into close contact with every student; however, since this is our first incident, we are proceeding with an abundance of caution," a district release stated.District officials said schools will reopen at normal capacity on Friday. The positive test comes just two days after Vista Unified reopened its schools for in-person instruction.Part of the reopening plan, known as “Vista Classic,” includes attempts to have social distancing as much as possible. The district will allow as many as 38 students in a single classroom, so desks will not be spaced six feet apart.According to the district dashboard, prior to the full reopening, there were four confirmed positive COVID-19 cases at schools between Sept. 8-Oct. 19. 1300

WASHINGTON (AP) — Defense Secretary Mark Esper on Sunday fired the Navy’s top official over his handling of a disciplinary case involving a Navy SEAL.Esper asked for the resignation of Navy Secretary Richard Spencer and Spencer submitted it Sunday, said the chief spokesman for the Pentagon, Jonathan Hoffman. The firing was a dramatic turn in a long-running controversy involving Navy Chief Petty Officer Edward Gallagher, whose case has been championed by President Donald Trump.Esper also directed that Gallagher be allowed to retire at the end of this month, and that a Navy disciplinary board that was scheduled to hear his case starting Dec. 2 be cancelled, Hoffman said. At Esper’s direction, Gallagher will be allowed to retire as a SEAL at his current rank, Hoffman said.Hoffman said Esper lost trust and confidence in Spencer “regarding his lack of candor” over conversations with the White House involving the handling of the SEAL case.“I am deeply troubled by this conduct shown by a senior DOD official," Esper said in a written statement issued by Hoffman. "Unfortunately, as a result I have determined that Secretary Spencer no longer has my confidence to continue in his position. I wish Richard well." 1225
