SANTA ANA, Calif. (CNS) - The Orange County Board of Education announced Wednesday that it has decided -- by a 4-0 vote -- to file a lawsuit against Gov. Gavin Newsom and the California Public Health Officer to seek a court order that sets aside the state orders preventing public schools from holding in-person classes and resuming services on campus.The vote came during a closed session Tuesday night, according to a statement.The California Supreme Court has interpreted the California Constitution to require that California school children have a constitutional right to substantially equal opportunities for learning, and the governor's order will unequally burden the most underprivileged families of California, the bard's lawyers said in a statement.The attorneys, Tyler & Bursch, LLP, of Murrieta in Riverside County, said they agreed to represent the board pro bono "to protect the vulnerable children in California."The lawsuit will also be supported by the nonprofit legal organization, Advocates for Faith & Freedom."California children have a constitutional right to both an education and equal protection under the law. The governor denied them these rights and did so without adequately considering the disparate impact these restrictions would have on the disadvantaged," said attorney Jennifer Bursch of Tyler & Bursch, LLP. "We brought this lawsuit to protect the single mom and her children, children whose parents do not read or write English, and children with special needs."The governor's ban on in-person learning will cause tens of thousands of kids to fall through the cracks and, in many cases, will be harmed for life."The Orange County Board of Education earlier this month approved a non-binding recommendation for reopening schools that would not require physical distancing or wearing masks. One of the county's largest districts, Santa Ana Unified, almost immediately rejected that advice, as did other school officials."The board majority's recommendations are not binding and La Habra City School District will not open our schools under these conditions," said that district's superintendent, Joanne Culverhouse. SAN MARCOS, Calif. (KGTV) - The San Diego County Sheriff’s Department is investigating a crash that sent a child to the hospital Monday. The accident happened about 2:30 p.m. at Woodland Parkway and Rock Springs Road. "Witnesses observed two 12 year old male Woodland Parkway Middle School students run westbound into a marked crosswalk against a solid red signal light and red crosswalk signal," deputies said.The 38-year-old male driver of a white Nissan could not avoid hitting the first boy, while the second narrowly avoided being struck, according to deputies. SCOTTSDALE, AZ — Emergency crews have recovered a body after an incident at a Scottsdale aquatic park.Crews were at Eldorado Aquatic Park near Hayden and McDowell road early Monday morning.Scottsdale police say around 12:30 a.m.; an officer was making rounds in the area when he heard what sounded like muffled calls for help.He worked to locate where the calls may be coming from and eventually found them to be coming from a pipe that helps support one of the water slides.Officers were communicating with the victim, said to be a transient, but lost communication with him around 2 a.m.Officials say the man reportedly went up over a tall fence surrounding the park and was up on the slide. He then somehow fell into the pipe structure, where he became trapped.Crews had to dismantle the slide in order to get the victim's body out.He has since been identified as 31-year-old Ryan Kelly. SAN ONOFRE (CNS) - A man drove a stolen van onto the grounds of the now- idled San Onofre Nuclear Generating Station and claimed to have explosives in the vehicle, drawing a response from the San Diego County sheriff's bomb squad, which determined that there was no danger, authorities said Wednesday.The driver, 27-year-old Erik Jon Norman, was arrested on suspicion of felony vehicle theft, San Diego County sheriff's Sgt. Pamela Wotkyns said.Sheriff's deputies went to the nuclear station a little after 4:20 p.m. Tuesday after security officers reported that Norman drove a white delivery van past the entrance gate and into a restricted parking lot, Wotkyns said. The security guards quickly detained Norman, but he told them the van contained electronic equipment and "possible explosives."The sheriff's department's bomb/arson unit was called to the scene but determined the van contained no explosives, only standard shipping parcels, Wotkyns said. Deputies later discovered the van was reported stolen earlier in the day from Oceanside and arrested Norman, taking him to the Vista Detention Center where he remained in custody Wednesday in lieu of ,000 bail. 1178
