TWENTYNINE PALMS, Calif. (KGTV) – After a Southern California Navy corpsman suddenly died this summer, his family has been trying to get answers for almost two months. This week, 10News has learned that 30-year-old HM3 Michael Vincent De Leon may have been killed by someone else.10News began looking into the case last week after his father, Jose De Leon, contacted 10News for help. 10News interviewed De Leon over Skype because he and the rest of the family live in Texas. De Leon says his son was stationed at the Twentynine Palms Marine Corps base in San Bernardino County. It was almost two months ago when De Leon says that he was visited by military officers who informed him that his son had died and an investigation was underway.“I gathered my emotions and asked them ‘why?’ or ‘what happened?’ but they couldn't give me anything,” De Leon tells 10News.Since then, the family says they've largely been kept in the dark, but this week 10News learned from a source with close military ties that the Naval Criminal Investigative Service (NCIS) has confirmed that Michael's death is now being investigated as a homicide. It’s a very different story than what De Leon says he was lead to believe in the hours just after learning of his son’s death when he says the word "suicide" came up from service members on-base.De Leon didn't believe it, claiming there was no history of depression or substance abuse. He says his son was happy and excited about an upcoming deployment.“He was an extrovert. He could walk into a room and make friends,” he told 10News with tears in his eyes.De Leon is a former television news photojournalist. Using his skills, he started his own investigation. This is what he says he learned just 48 hours later from a service member who is close to the case. De Leon tells 10News, “I begged him, ‘Just tell me, did Michael pull the trigger or did someone else?’ There was a long pause and he [replies], ‘Mr. De Leon, someone else pulled the trigger.’"De Leon says that other service members who knew his son said that his son was shot on-base at another corpsman's going-away party in the military housing area. A full week passed, but De Leon says there was still no word from the base about what happened.“It’s a bunch of bureaucrats that are not vested at all in the family,” he adds.He says after formally complaining he finally got a call from an agent with NCIS, which is handling the investigation. De Leon says the agent would only confirm that there was a shooting on-base at a housing unit with corpsmen present and a firearm was produced. It’s now seven weeks later and 10News has verified with our source that agents are officially treating this investigation not as a suicide, but as a homicide. It remains unknown as to whether it was accidental or intentional.10News directly asked NCIS and the base for comment. On Thursday afternoon, a spokesperson for the base sent 10News the following statement:"I spoke with a representative from the Provost Marshall's Office and he has confirmed that the incident is currently still under investigation so the information you inquire is unable to be released at this time. However, I was able to confirm that the base policy for securing firearms for those who live on/work at/visit the military housing area is that all firearms need to be in a secured location in the home and must be in a secure location in order to get a weapon onto base and when being transported to and from the home. Weapons must be registered on the installation. As far as Marines living in the barracks, their firearms need to be stored in a unit armory. It is actually an inspectable item and part of the unit armory policy. I apologize I do not have more information for you at this time. VENICE, Fla. -- A Florida pet groomer is under investigation by the Sarasota County Sheriff's Office after a recent video of alleged animal abuse surfaced on social media.The video taken by former Happy Puppy Pet Spa employee Briana Brady, shows another employee putting both hands around a dog's neck and laying it down on the table, leaving Brady to label the action as animal abuse. Brady first witnessed the alleged abuse when another dog left the salon with a broken jaw.“The dog was picked up by the throat, choked, shaken and then his head slammed on the table,” Brady said describing the video.The viral Facebook video has over 250,000 views. Brady worked at the Spa for four weeks prior to posting the video on social media.“It was very hard for me to witness any of that happening," Brady said through tears.The woman in the video who owns the spa, Phyliis Lucca has a different perspective. She claims that her actions weren't abuse, but instead necessary steps for the dog's overall health."If you see the video, I know it looks bad, but that’s not what I’m doing," Lucca explained. “What the dog did was pass out and she faints and what I did was hold her head and shake her. That’s all.”Two weeks prior to the video going public, a puppy named Pumpkin left the spa with a broken jaw and bruises all over his stomach.Lucca claims that Brady was the one responsible."The only one that was in the room alone, with the dog, was Briana.”However, both Brady and Pumpkin's owner, says they believe Lucca was the only one who could've have harmed the dog. The Spa owner hopes to move forward and survive the blow to her business.“If I get through this, I won't have another groomer in the store because nobody can be trusted now.”Brady and Pumpkin's owner say they will be pressing charges against Lucca. 1853

TUCSON, Arizona — An Arizona high school principal admitted on Facebook he changed the grades of seniors at the school, but claims his supervisor directed him to take that action. The Tucson Unified School District Governing Board of Pueblo High School in Arizona have voted to release a district report on the incident that has been kept confidential.The board released the following report:         The governing board is set to vote Wednesday, March 28 on whether to release a portion of the report by the law firm hired by the district.Pueblo High School principal Auggie Romero has come under fire in recent years over a grade changing scandal.  He's been on the hot seat after a teacher came forward to E.W. Scripps television station KGUN in Tucson — that Romero changed several seniors grades without her consent — a violation of state law. And she provided proof — her grade sheets."This is something that has never happened before in my 31 years as a teacher," said Yolanda Sotelo in 2016. Romeo even admitted on Facebook he changed the grades, but claimed his supervisor, Abel Morado, directed him to take that action. KGUN obtained a scathing memo written by Morado, who stated that wasn't the case. He stated that he had reminded Romero he needed to get the teacher to change grades and Romero's "failure to comply with the very simple directive caused all of the controversy." The memo also reveals the Deconcini law firm investigated the allegations and found Romero "did change the student's grades." KGUN requested the document through a public records request, but the district declined citing attorney-client privilege. Now the board is voting on whether to release the findings "concerning potential violations of the law: improper grade-changing, improper promotion, and discrimination.  1961

  

Two of the former owners of Toys "R" Us have agreed to pay million to help laid-off employees.Bain Capital and KKR, private equity firms that owned part of the toy retailer, set up a severance fund to pay former workers who lost their jobs when the company closed its stores.The third owner, real estate firm Vornado, did not join the fund, and did not immediately respond to request for comment.MORE: How the Toys 'R' Us closures massively impact?the U.S.Toys "R" Us filed for bankruptcy a year ago with plans to stay in business. But in March the company's creditors forced it to go out out of business, and the 31,000 remaining employees did not get severance payments.Some top executives at Toys "R" Us received bonuses as part of the bankruptcy process. The nation's bankruptcy laws place limits on the severance payments that can be made to laid-off employees, and they give priority to repaying creditors of the bankrupt companies.Had the employees been laid off before the bankruptcy, they would have been entitled to severance pay of up to one week of pay for every year of service.The million severance fund does not come from Toys "R" Us.The fund was set up following negotiations between the private equity firms and various public interest groups that organized the employees, including Organization United for Respect, Private Equity Stakeholder Project and Center for Popular Democracy."This Fund begins to ensure the hard-working people who spent their lives building Toys 'R' Us and making children happy are not left out in the cold," said Marilyn Muniz, a New York-based Toys "R" employee for nearly 20 years.The groups are seeking additional contributions to the fund from Vornado as well as two Toys "R" Us lenders, Solus and Angelo Gordon, which pushed the company to shutdown operations rather than stay in business. Solus did not respond to a request for comment and Angelo Gordon declined to comment.Tracy Forbes, a former employee who lost her job, told CNN Business that she had worked for the company for 31 years, making her way up to store manager of a Babies "R" Us store in Tempe, Arizona. At the time of the bankruptcy filing she figured she would get about seven months of severance if her store shut down. She said she was shocked when she learned the promised severance wouldn't be paid."It was very difficult," she said. "Here in Arizona, unemployment is only 0 a week. It's not even minimum wage. It was rough. I only got by with friends and family helping me out."After about four months she found a job as an assistant manager of a Home Goods store, which pays less than Babies "R" Us. She said she's kept in touch with the employees who used to work with her at Babies "R" Us."Just about everyone has found some kind of work, but it generally took three or four months," she said. "Some aren't earning as much. Some of the lower-level employees have actually found better paying jobs."The fund has hired attorney Kenneth Feinberg to come up with a formula to determine who gets how much money. Feinberg has made a career deciding distribution to victims of events, such as the terrorist attacks on September 11, 2001, and the BP Deepwater Horizon oil spill. He has proposed that payments go to workers who had been with the company at least a year and who made between ,000 and 0,000 in annual income."In order to maximize the impact of available funds, key eligibility requirements and payment parameters had to be instituted," said Feinberg. Payments are expected to start soon after December 15 and be completed by April.The million fund will not cover a full severance plan for the workers. The employee groups estimate that would take million.The proposed payment schedule provides at least 0 to anyone eligible for payments and as much as ,800 to the top earning employees -- those earning more than 0,000 a year who had been with the company for more than 25 years. TULSA, Okla. — A Tulsa police major is suing several media companies for publishing comments he made in a radio interview in June.Major Travis Yates has filed a lawsuit against Comcast, Gannett, Public Radio Tulsa, Gatehouse Media and others, saying their reports portrayed him in a "false light."During a June appearance on Talk Radio 1170 with host Pat Campbell, Yates said data shows systemic racism "doesn't exist" and "all the research says we're shooting African Americans about 24% less than we ought to be based on the crimes being committed."In the days following his comments, the Tulsa Police Department opened an investigation into Yates, and Tulsa Mayor G.T. Bynum called on Yates to apologize.Yates later claimed his comments were taken out of context, particularly in the headlines of some media reports.
