CHULA VISTA, Calif. (KGTV) -- Three gang members charged in a violent crime spree that stretched from San Ysidro to La Jolla were in court Tuesday in Chula Vista for their preliminary exam. Michael Pedraza, Cesar Alvarado, and Britney Canal are accused of murdering a South Bay businessman last April and kidnapping and shooting a woman who witnessed it. Mya Hendrix was the first took take the stand. She's paralyzed and confined to a wheel chair after being shot three times and left to die at Sunset Cliffs. The judge would not allow the media to show the faces of the defendants in court, but they smirked during much of testimony. Hendrix, 19, said she was friends with the defendants and had done drugs with some of them. She says they turned on her because they thought she stole a backpack with ,500 in it. Hendrix says they kidnapped her, tortured her with a game of Russian Roulette and tased her multiple times. At one point, she testified she was forced to call her mom for ransom money. “I told her I needed ,500. My life depended on it and she was asking me why, and I was forced to say that I had robbed somebody. I wasn’t allowed to say that people had thought I took something from them, they forced me and tased me told me to say that I robbed them," said Hendrix. Prosecutors said the trio drove Hendrix to various locations. "They were telling me they were going to put me into sex trafficking. They were telling me they were selling me to this guy they had at the park. They had me like tied up in this garage with duct tape over my mouth and they were tasing me in front of people," said Hendrix. Prosecutors say Hendrix was in the backseat when the defendants shot and killed a South Bay businessman. According to investigators, the suspects thought 59-year-old Mario Serhan was an undercover cop who was following them. The defendants are charged with fatally shooting him in the head. Witnesses found Serhan slumped over the steering wheel of his car with a gunshot wound to the head. The vehicle was coasting through the intersection of Industrial Blvd. and L Street before it collided with a storage business, police said. Hendrix testified that the trio celebrated the killing. "Ms. Canal was excited. She was like, "good shot babe" cause he was like, "I got him in the dome," testified Hendrix. She said the defendants cleaned the car with bleach to remove any gun powder residue. Shortly after, she says they took her to Sunset Cliffs and tried to murder her. "I walked down the stairs with the gun pointed at me the whole time, pleading for my life, crying he told me to take it with some dignity and not to die like a little *&^%$ and that’s when he shot me the first time, which the bullet hit my ear and I stayed standing. The second time is the one that went in my neck and out of my chest on this side that’s the one where I fell and broke my spinal cord and then as he was walking away he turned around and shot me a third time in the hip. All I could do was lay there and pray," testified Hendrix. She was found hours later near the surf by tourists at Sunset Cliffs. A fourth defendant, Francisco Aranda, is also charged in the case. He's accused of setting Hendrix up. Hendrix says she thought they were friends, but Aranda believed she had stolen from him. Testimony continues Wednesday morning. A judge will decide if there is enough evidence for this case to go to trial. 3431

Just a few months ago, the mall had more than a dozen empty storefronts and employees at the mall called it a ghost town. The new businesses moving in include Novo Brazil Brewing, Planet Fitness, and Barons Market.LONGFORM: Vacant storefronts reflect mall struggles at Otay Ranch Town CenterBrookfield Property Partners took over full ownership of the mall six weeks ago. It was a part of a larger merger across the country. The mall's general manager, Steven Sayers, sat down with 10News."Nothing was going wrong with the property at all. It was just, some of it was just timing with expiring leases and unfortunately, some tenants just left," says Sayers.Sayers says these new businesses were already in the works before the merger. He credits the construction surrounding the mall is a big factor for why these businesses are choosing to invest in the mall. (KGTV) - A new music school is open in the South Bay, teaching kids to play instruments with a less-classical approach."We're not the little old lady down the street with a metronome," says owner Mark Sheffield.He opened the School of Rock at Otay Ranch Town Center after his wife had to drive through traffic to take their son to classes in Liberty Station."Later on that evening, I asked how did it go, did you have fun? Yes, it was a blast. He loved it. We want to do that again. But we're not. But we're not ever doing that again. It was a 45-minute drive there and an hour and a half drive back," Sheffield explains.He says opening a South Bay location gives kids in that part of the county an option to learn music in a fun, modern way."The students learn music by playing it in an environment that fosters a true enjoyment for what they're doing," he says. "They're going to want to come anyway, and hang out with friends, and they're going to end up learning."School of Rock offers lessons for kids starting at age 3, no matter the skill level. In the lot on Main Street and Fourth Avenue, visitors can buy anything from fish tacos and flowers to Mexican food and coffee.Just Coffee opened up about two weeks ago and owner Tyler Detweiler said he knew it was a bold move to start a new business in the middle of a pandemic, but it’s been successful so far.“People come here with the best moods. They’ve been making their own coffee for three months, four months now, and they want to go get a coffee that tastes like real coffee from a real espresso machine,” said Detweiler.He said another draw has been thanks to his business partner, the owner of Keto Dessert Company. James Baum usually delivers his sugar-free desserts to various locations in the Chula Vista area, so the partnership means one central place for locals to find his treats.Baum said his drive to sell keto dessert comes from his personal background.“They just thought I was a slow learner and then I got older and took this super long test of hundreds and hundreds of questions and realized I’m autistic,” said Baum.He said a sugar-free diet can benefit people with autism so he started the company as a way to bring dessert to keto diets. (KGTV) - A Chula Vista homeowner's association (HOA) is dealing with claims of embezzlement, corrupted financial records and a police investigation.Team 10 investigative reporter Jennifer Kastner tracked down the former HOA manager who's at the center of the accusations, who says he did nothing wrong. However, the HOA claims that he was writing thousands of dollars in reimbursement checks every month to himself for alleged maintenance, but didn't provide basic documentation like store invoices or receipts.Unlike the idyllic, legendary city of Camelot, the local Camelot at Eastlake Shores is in turmoil. "It's not the wonderful place that it used to be," says homeowner Connie Patrick. She and other homeowners at the Chula Vista HOA are grappling with the news.Homeowner Griselda Palma tells us, "I was very startled when I read the letter…it was very disturbing."10News has a copy of a letter that was sent out to more than 400 homeowners by the HOA's Board of Directors this past spring. The letter accuses the former manager, Howard Gatbonton, of possible financial abuse. Gatbonton was directly employed by the HOA, which also contracted with an outside management company called Summit Property Management. Summit's main office is located overlooking Mission Valley. In the letter, the HOA wrote that a “Review of the Association's finances uncovered many discrepancies." The HOA letter also adds, "as of the date of this letter, no records have been provided or discovered that detail or explain over 0,000.00 of reimbursement expenses to Gatbonton."A police investigation is underway. In an interview with 10News, Gatbonton denied any wrongdoing. Gatbonton says he was forced to pay for maintenance expenses using his own money because the HOA Board wouldn't give him a credit card. He told 10News he spent about 0,000. This station asked if the money was from his own pocket. "Yes, ma'am," he told 10News. 10News asked Gatbonton if he would write reimbursement checks to himself."Yes, ma'am," he says. When this station asked if the board was aware he was doing that, he replied: "Yes, ma'am, because I was the manager to give them a copy of every single check that I [wrote]."After the investigation into the HOA's financial records and reimbursements to Gatbonton began, he stepped down, claiming he no longer wanted to deal with the Board.Summit Property Management was terminated.To make matters more complicated, according to the Board, it was discovered that, "all of the Association's electronic records stored in the Association's onsite computer had been deleted and the computer's hard drive corrupted."According to the letter, the records are "unsalvageable."We ask Gatbonton, "[Did you] destroy or corrupt any files?" He replies, "It's impossible to corrupt because it's in the cloud! How can I corrupt [them]? Even the emails are in the cloud! How can I corrupt that?"Gatbonton says that discrepancies with the HOA's financial records existed long before he hired, and when he alerted the Board, they dismissed the problems. "They turned a blind eye," Gatbonton says.Gatbonton told us he's got the records to vindicate himself, but he wouldn't share them. "I've been advised not to," he told us.The HOA declined an interview with 10News, but the law firm representing the HOA sent a statement claiming, in part, "Since quitting, Gatbonton has waged war against the Association, spreading false information…"The firm reports that "Gatbonton provided only copies of some of the checks he had written to himself as 'proof' of the validity of the expenditures. The Association had accounts at Home Depot, Office Max and other companies for supplies. It is not clear why Gatbonton did not use these accounts for maintenance supplies or why he did not simply write checks to these companies for the alleged supplies."According to the firm, "Over the months following his resignation more evidence of gross mismanagement and financial abuse by Gatbonton was discovered. The Association's pool and two children's playgrounds had to be closed for critical failure of safety inspections despite the 0,000.00+ that Gatbonton reimbursed himself for alleged maintenance."The firm writes, "When pushed for missing documents, Gatbonton claimed he had already turned over all existing records" and made no mention of nor provided any access to any alleged 'cloud' based documentation."Summit Property Management's Jennifer Rimer tells 10News that Summit was only in-charge of the Board's meeting minutes. It was never responsible for finances for the HOA and its members.
