SAN DIEGO (KGTV) -- A San Diego-based financial investment advisor is being accused of running a Ponzi scheme targeting mostly elderly victims who planning for retirement, and taking more than million, according to bankruptcy court records.Sharon and David Vega said they started working with Christopher Dougherty about 17 years ago. A few years ago, Sharon Vega said that he recommended to take money “out of the TD Ameritrade and place it in private placement in farm subsidy accounts.”The Vegas trusted him and placed approximately ,000 in these new accounts. They said they continued to receive statements showing how their money was doing, but they started to see red flags. Sharon Vega said when checks bounced, Dougherty gave various excuses.She showed Team 10 one bounced check where Dougherty claimed “there was a mix-up at the bank.” They decided to sever ties and asked for their money back.“He said no problem, he would start on it right away,” Sharon Vega said. However, she said that did not happen. She showed Team 10 several text messages from Dougherty late August into early September promising their money. One message said the transfer was “already in motion. Should see it shortly.”“We have not received any funds back. He filed bankruptcy and he’s trying to have ours discharged with many other people’s,” Vega said. She said the ,000 was money they had been saving to try and help their grandchildren with college.In bankruptcy court documents, the United States Trustee wrote Dougherty’s “deception is the basis of a Ponzi scheme.”“[Their] practice of using new investment money to pay existing investors dividends and principal gave the false impression that the payments received by investors came from earnings and profits or from a return of their principal,” the documents said. “It’s devastating,” said Jerry, another former client of Dougherty. He and his wife declined to use their last name.Jerry and his wife Diane told Team 10 they invested more than million with Dougherty over the years. At first, it was with traditional accounts. They said he later convinced them to invest in an Alpine farm. They thought they were diversifying their retirement money, but what they know now is everything they saved for is gone and what happened to their funds is unclear. Like Sharon and David Vega, they said Dougherty kept sending them statements.“We rely upon our children now,” Jerry said. “We can’t even afford a burial plot.”In 2011, Dougherty was charged for stealing money from a youth baseball league. He was ultimately sentenced to three years summary probation, according to the District Attorney’s Office. Team 10 attempted to contact Dougherty and his wife, Nereida, who is also named in the bankruptcy documents. They did not respond. An attorney for the Doughertys also did not respond to Team 10’s inquiries. Investigator Melissa Mecija visited the Alpine ranch connected to the couple, where a tenant said his power has been shut off three times in the last several months. It was a bill he said the Doughertys were supposed to pay. Sharon Vega said she tries to stay strong as she deals with multiple setbacks, including her husband’s larynx cancer. “He was diagnosed… when all of this happened,” she said. Lt. SAN DIEGO (KGTV) - An Oceanside woman says she was left feeling violated after her car was stolen from the Porto Vista Hotel's valet in Little Italy. "I had to leave some of my things in my car, like my work computer, some of my personal items that were expensive and personal, but I trusted they would be ok because it was a valet service at the hotel," said Ashley Holthaus, whose car was stolen. Her friend had a room at the hotel, and their group of friends went to a concert at San Diego State that evening. "The next morning, around 6:30 a.m. I got up and walked over to the valet and gave him my ticket and at that point, he looked for my keys and couldn't find my keys or record of my car being at the hotel."Holthaus says the next few hours were extremely stressful as staff tried to figure out what happened. She says she was asked to wait to call police until they had a better idea of what happened.Holthaus was eventually shown surveillance footage. She describes seeing a tall man in a hoodie walk up to the unattended valet kiosk, take her keys, walk straight to her car, and drive out of the parking garage. "Why am I paying for a service and then have something like this happen and then there's no accountability from the hotel?" said Holthaus.Her company's IT department was able to track the computer which was in the car; she says it was located out of the country.Holthaus says to make matters worse, the hotel charged her for the valet and did not offer to compensate her friend for the room.An attorney for the hotel tells 10News there hasn't been an incident like this in Porto Vista's 30 years of operation. The attorney says they've turned over surveillance to police and are cooperating with the investigation. He added that management is taking measure to ensure this doesn't happen again. SAN DIEGO (KGTV) — An 86-year-old woman, with underlying health conditions and who had been vaccinated, is the latest flu death in San Diego.The San Diego woman died on Dec. 1 from influenza A and had been vaccinated this season, the County Health and Human Agency said. Officials did not specify what underlying conditions the woman had suffered.This flu season, seven San Diegans have died from the flu. At this time last year, San Diego reported five deaths from the flu.RELATED: Health officials stress getting vaccinated for the flu ASAP“Influenza can be deadly, especially for people with underlying medical conditions and compromised immune systems,” said Wilma Wooten, county public health officer. “Vaccination is the best protection against influenza. SAN DIEGO (KGTV) -- A shark advisory is being issued Tuesday after witnesses reported seeing a five-foot-long shark near Black's Beach. According to Mónica Mu?oz with San Diego Fire-Rescue, the advisory is in place from the Mushroom House north to Bathtub Rock, also known as Flat Rock. “Some witnesses reported seeing a shark of about five feet in length which does not reach the threshold of a significant threat. However, the number of witnesses and the feeding behavior observed influenced the lifeguards’ decision to issue the advisory,” Mu?oz said. Just after 12:30 p.m., a group of 25 surfers got out of the water at Black's Beach after reportedly seeing a shark eating a sea lion. Another group of people reported similar information to a lifeguard. In the same area, Mu?oz says lifeguards witnessed a large sea lion eating a fish. The department says there were either two separate sightings in the area, or witnesses all saw a sea lion feeding on a fish, but mistook it for a shark. “We are acting out of an abundance of caution,” Mu?oz added. Lifeguards are conducting active patrols in the area to let people know what witnesses saw. Mu?oz says lifeguards are advising against water activity; however, the water is not closed to people who choose to enter. Signs will also be posted in the area. 1316

SAN DIEGO (KGTV) -- A state review board will decide Tuesday whether to grant parole to a former skateboarding star from Carlsbad who has spent nearly three decades behind bars for a brutal rape and murder.Mark “Gator” Rogowski was a world champion skateboarder in the 1980’s who drew comparisons to Tony Hawk. He parlayed his fame into endorsements and promotional videos until he entered a guilty plea to the 1991 rape and murder of Jessica Bergsten, whose body was found buried in the desert.“This was a horrific, heinous, monstrous crime by an individual who really doesn’t want to admit that he took out transferred rage on another innocent individual,” said Deputy District Attorney Richard Sachs, who will represent the state at Tuesday’s hearing.Rogowski was denied parole in 2011 and 2016, but his case was granted another review ahead of schedule, Sachs said. The parole board will determine if Rogowski remains a threat to the community based on a psychological assessment and other factors.In a promotional video by the prison rehabilitation non-profit Getting Out by Going In (GOGI), Rogowski said he’s taken accountability for the crime and found a higher power.“My identity as a man was skewed. I thought what it meant to be a man was to be a womanizer, to have a lot of relationships,” he said.In 1991, the former skateboarding celebrity invited Bergsten to his Carlsbad apartment. Bergsten was a friend of the girl who had just dumped Rogowski.In a fit of what he called “misplaced revenge,” Rogowski clubbed the young woman over the head, cut her clothes off with scissors and sexually assaulted her for hours. When she screamed for help, Rogowski covered her with a surfboard bag and strangled her through it. He then drove two hours into the desert and buried her naked body in a shallow grave.“Certain crimes are so horrible they shock the conscience and this is one of them,” Sachs said.Sachs said prosecutors will strongly oppose parole on public safety grounds, although he acknowledged he could not predict the board's decision.
