SAN DIEGO (KGTV) - A man involved in a DUI hit-and-run crash that seriously injured a young boy in the South Bay started his sentencing hearing Wednesday for violating federal immigration laws.Constantino Banda Acosta, a Mexican national who had previously been deported from the U.S. at least 15 times in the past, has been in federal custody since March over federal criminal re-entry charges.He was transferred to federal custody after charges against him stemming from a 2017 crash were dismissed.Banda faced charges in the May 6, 2017, crash in San Ysidro that sent young Lennox Lake to the hospital with serious injuries, including head trauma.Banda was initially charged with drunk driving and hit-and-run after authorities said he ran a stop sign at Dairy Mart Road and slammed his pickup truck into the Lake family’s car as they were heading home from a Disneyland trip.Banda left the scene but was arrested about two miles away after Border Patrol agents spotted his damaged truck parked on a street, police said.San Diego police Officer Michael Muniz testified in the first trial that Banda's blood-alcohol content measured .151 and .152.Following a mistrial, a judge dismissed the case against Banda in March, saying there was no clear evidence that showed he was behind the wheel at the time of the crash.Banda’s lawyers had argued that another man in the truck, Jorge Adame Ariza, may have been driving the truck after a night of drinking with Banda.Adame said Banda got into a fight with another man outside a Chula Vista restaurant before the crash. SAN DIEGO (KGTV) – A man was stabbed to death in San Diego’s Gaslamp Quarter early Wednesday morning, and police say one person was detained in connection with the incident.At around 2:30 a.m., San Diego police responded to reports of a stabbing in the 400 block of Fifth Avenue, near J Street.When officers arrived, they saw a man in his 40s with a stab wound on his chest lying on the ground with a woman trying to keep pressure on the injury.The victim was rushed to UC San Diego Medical Center, where he later died from his injuries.After the victim gave police a description of the attacker, officers spotted and then apprehended a man believed to be linked to the stabbing.ABC 10News learned the man was detained for questioning.SDPD Lt. Andra Brown said the incident is under investigation, but it appeared the stabbing took place following an exchange of words between the victim and his friends and another group of people. 940

SAN DIEGO (KGTV) -- A judge ruled Wednesday that a Navy commander will face a third trial on charges he tried to rape a junior officer in her home.John Michael Neuhart II asked the judge to dismiss all charges after a second jury was unable to reach a verdict.The judge dismissed charges of assault with intent to commit rape during burglary, burglary and resisting or delaying a peace officer.RELATED: Mistrial declared for former Navy commander accused of rapeThe judge added that prosecutors can proceed with a third trial in January on charges of attempted forcible rape and assault with intent to commit rape.Neuhart now faces six years behind bars and lifetime sex offender registration if found guilty. Neuhart had previously been facing life in prison.In the two trials combined, 21 out of 24 jurors voted to convict Neuhart. SAN DIEGO (KGTV) -- A legendary sports radio station is returning to Southern California airwaves with an updated name.The Mighty 1090 abruptly went off the air on April 10, 2019, due to an issue between the station’s parent company and the owners of the Mexico-based radio tower that distributes the station’s signal.But on Monday, Aug. 17, the station once known as the Mighty 1090 will be back on the 1090 AM radio dial as "The Mightier 1090.”Bill Hagen of Mightier 1090 said in a news release, “It’s taken a tireless amount of work from a number of great people to get us to this point. SAN DIEGO (KGTV) -- A San Diego family wants to warn other about daytime burglars who may be posing as door-to-door salespeople.The Alvarado family just moved to a home in Allied Gardens. It is a safe neighborhood, but they noticed there are a lot of solicitors.Tuesday afternoon they were burglarized by a couple of young men wearing matching outfits.“I left the house for 25 minutes to pick up my daughters from school," Vanessa Alvarado said. "When I was coming down the street I noticed two young men walking quickly down the street, from my driveway, carrying both my guitars."Her daughters were also in the car as they drove up to their home, and burglars.“They looked up and saw me. They knew who I was,” Alvarado said. "They knew my car and they just sped down the street, made a sharp right turn."One of her daughters noticed the young men’s matching clothes.“I think they looked like salesmen. I noticed one of the had a binder in his hands with several things on top, which turned out to be my personal belongings,” Alvarado said.The home was locked at the time of the burglary.The thieves went into the backyard and broke in through a bedroom window, which was open a few inches but had a stopper device on it aimed to prevent anyone from opening the window further.Regardless, the thieves pried off the screen, and pushed the window open.The men made off with numerous items, including guitars, Kindles and jewelry. They left no fingerprints.“I went from trying to be strong for my daughters to realizing my wedding rings were gone and at that point, my heart just shattered into a million pieces,” Alvarado said.Now, the family is getting security cameras and they have dowels in the windows so they can't be opened.  1744
