CHULA VISTA, Calif. (KGTV) -- A South Bay family spoke about the frightening moments that took place when a police chase ended in front their home and then turned into a shootout on their driveway Monday afternoon.Mark Yturralde said his son-in-law had the quick thinking and presence of mind to shut the door to prevent a suspect, later identified as David Angulo, from getting into their home on Rutgers Avenue.“I didn’t have time to be kind or nice. I had to shove my wife and granddaughter into a closet, and I told them to stay low, keep quiet, don’t come out until I tell you. I tried to watch from a corner,” said Yturralde.RELATED: Carjacking, pursuit leads to deadly officer-involved shooting in Chula VistaAccording to Chula Vista police, Angulo was a known gang member wanted in connection with at least three shootings in June. Police said Angulo carjacked a pickup truck in an area near Main Street, refused to pull over for officers, and led a pursuit into east Chula Vista.Police said Angulo lost control of the truck and crashed into a car driven by an active-duty military member. While the other driver was seriously injured, Angulo got out of the truck and ran to a family’s driveway.Angulo, according to police, opened fire at officers -- the exchange of gunfire that Yturralde said went on for several minutes. Shots struck and flattened the tires of vehicles parked in the driveway, but none of the bullets penetrated the house.Yturralde and Chula Vista police credited Yturralde’s son-in-law for keeping the incident from turning into a hostage situation, or worse.Angulo was killed during the shootout, and police said an investigation will determine how many shots were fired and who opened fire first. Police will also review officers’ body camera footage.Police promised the investigation findings will be released in a timely manner.The three officers involved in the incident were not injured.Family members said they found five shell casings in their backyard. They told ABC 10News they are grateful to police but also offered their condolences to Angulo’s family, even though he put their family in danger. 2145

(CNS) - The family of a 56-year-old man who died earlier this year following an encounter with Chula Vista police announced Monday they are filing a pair of wrongful death lawsuits against the city.The lawsuits seek the names of the officers involved in the March 13 call for service that culminated in Oral Nunis' death.Both lawsuits are being filed in San Diego federal and state courts on behalf of four of Nunis' children, including his daughter Kimone, who called 911 shortly after midnight March 13 after her father began experiencing a mental health issue and attempted to jump out of a second-story window.While addressing reporters at a news conference announcing the lawsuits, Kimone Nunis said responding officers did not speak to her or ask her what was happening with her father when they arrived."That night, I just wanted help. I picked up the phone. I didn't know what I was getting myself into," she said.Attorneys for the family say officers tackled Nunis outside the home and "dogpiled" atop him, placed him in a WRAP restraint device and put a "spit hood" over his head.In a statement released shortly after Nunis' death, the police department said he was restrained to prevent him from hurting himself or others. The department also alleged Nunis was "uncooperative with officers and struggled as they attempted to detain him," resulting in injuries to two of the officers.The federal lawsuit alleges Nunis was unconscious and unresponsive after the altercation, and that those restraints were placed upon him while he was unconscious.Nunis was taken to a hospital, where he was later pronounced dead.Attorney John Burris, who represents the family, said police should have responded by de-escalating the situation."Mr. Nunis was seeking help. The family was seeking help. But instead of getting help, he was met with force," Burris said.A similar lawsuit was filed last month on behalf of Nunis' widow and three other children. Their attorney, Carl Douglas, alleged the city has withheld Nunis' cause of death, while a statement released by the city last month indicated his cause of death has not yet been determined."The City of Chula Vista understands and shares the public's and the family's desire to have all of their questions answered about this incident. However, it is premature and inappropriate to come to any conclusions at this time," according to the city's statement in response to that lawsuit. "The investigation is ongoing, and the true cause of death has not been determined by the Medical Examiner. Because of this, and now the threat of litigation, the City and the Police Department must refrain from commenting further beyond the statements already made. The City and Police Department continue to express our deepest condolences to the family and all of those touched by Mr. Nunis' tragic passing."City officials did not immediately respond to a request for comment regarding the latest filings.In addition to the federal lawsuit alleging wrongful death and violations of Nunis' civil rights, the state lawsuit seeks the release of the officers' names.The complaint states Kimone Nunis submitted a California Public Records Act request in July seeking the names of the involved officers, as well as body camera footage, reports and statements from witnesses and other information police have regarding the case.According to the lawsuit, which alleges the city violated the CPRA, the family was told months later that the information was being withheld "because of ongoing criminal and administrative investigations." 3591

CHULA VISTA, Calif. (KGTV) -- Three Chula Vista teens are recovering after they were assaulted and robbed near Heritage Elementary School on Monday night. The teens are still on winter break. They tell 10News they were walking along Monarche Drive, on their way to get a slice of pizza, when four men pulled up next to them in a white car. The four men got out and assaulted them, getting away with their cell phones and wallets. One teen had to go to the emergency room to get a CAT scan and a x-ray to check for a wrist fracture. Chula Vista Police confirmed the incident to 10News. A lieutenant with the department says they were able to find the car and arrest the four suspects just hours later, two adult men and two male minors. When the suspects were located, officers found a total of 10 cell phones. Police are now working with other local agencies to find out if there are more victims. The two adults were taken to county jail. The minors were booked at juvenile hall. Anyone with information is asked to call Chula Vista Police. 1051

CHULA VISTA, Calif. (KGTV) — A South Bay postal worker has pleaded not guilty to firing pepper spray at a dog. Nestor Medina was charged with three counts of animal cruelty in connection with the encounters 10News first reported in Otay Mesa last March. “It’s heartbreaking,” Alfonso Galindo said. Galindo checked surveillance video of his home on Agosto Street. Cameras recorded a postal carrier walking up to Galindo's mailbox and past the metal front gate. Behind the gate is Pupa, and as the mail carrier places the mail in the mailbox, a cylindrical object is seen in his left hand. At the same time, from another camera, Pupa is seen behind the gate beginning to convulse for several minutes. RELATED: Dog owner: Video shows mail carrier routinely pepper spraying dogAn extensive search through video found nine similar encounters where Pupa had convulsions after the postal worker walked by, Galindo said. Galindo said his children, 3-year-old Alfonso Jr. and 1-year-old Regina developed strange respiratory problems after hugging Pupa. "Countless trips to the ER and urgent care, and countless medications," said Galindo. (KGTV) — Chula Vista could be the next city to make outdoor dining easier for several restaurants.The city says it’s established a free permitting process for Third Avenue businesses, between E and G Streets, to move indoor operations outside amid a new round of coronavirus-related closures across the state.The businesses will be allowed to expand into the public right-of-way, giving them the option to create a large dining area while adhering to social distancing measures.“This will provide the businesses outdoor options using tables and canopies while having social distancing and queuing areas for sidewalk cafes and curb cafes. Businesses on Third Avenue would be able to create a larger outdoor dining experience as public health mandates currently have indoor dining closed,” a city release stated.The city also approved a temporary closure of Third Avenue on the weekends, between E and G St., through January 2021 for businesses to expand outdoor dining. This plan would have to be approved by the Third Avenue Village Association to go into effect, the city says.This week, the city also approved a .5 million grant for small businesses to be reimbursed for the costs of business interruptions due to pandemic closures. The grant, called Chula Vista CARES, is funded through the federal CARES Act funds.For-profit businesses located in commercial or industrial space in the city, with ten or fewer employees, and who were required to closed due to COVID-19 can apply between July 20, at 7 a.m. and July 24, at 7 p.m. for a portion of the grant. The maximum a business can receive will be ,000. To be fair, the city says businesses will be selected in a lottery format.“Small businesses are the backbone of Chula Vista’s economy and are a critical part of our community’s economic recovery from the ongoing COVID-19 pandemic.
