SAN DIEGO (CNS) - Citing the potential risks of sexual and physical abuse to children, San Diego County District Attorney Summer Stephan today urged Gov. Gavin Newsom to consider allowing county school districts to make their own determinations regarding reopening in advance of a Tuesday decision that could send the county to the most restrictive tier of the state's coronavirus reopening roadmap.In a letter sent Monday to Newsom, Stephan said there has been ``a drastic increase in child predatory behavior on the internet'' with children out of school and teachers unable to ``be the eyes and ears of law enforcement'' to report suspected abuse among their students.Local reports to the Internet Crimes Against Children Task Force have tripled since schools were shuttered due to the pandemic, and that similar increases have been seen nationwide, Stephan said. Stephan also said domestic violence reports have increased since stay- at-home orders were issued, and that Rady Children's Hospital has seen an increase in ``consult cases,'' in which cases of suspected child abuse are reported by physicians.Stephan's letter was sent in advance of Newsom's Tuesday decision regarding San Diego County's COVID-19 category status, when the county could potentially slide into the ``Purple Tier,'' meaning many schools could not open for in-person learning.``When evaluating the health of our children and our community, we must consider the effects of COVID-19, but also acknowledge and weigh the other real and potentially more life-threatening threat from violence and exploitation of children,'' Stephan said.``This is the public safety lens that I sincerely hope you will consider.'' Stephan raised similar concerns near the beginning of the pandemic regarding potential increases in domestic and sexual abuse, with abuse victims being trapped indoors with their abusers as a result of self-quarantining at home.In addition to safety risks, Stephan argued distance learning is not viable for many county residents. SAN DIEGO (CNS) - An alleged drunken driver was going 121 mph when he caused a fiery freeway pileup that killed two men and seriously injured a woman on Interstate 15 last year, a prosecutor told jurors Tuesday, but a defense attorney claimed an off-duty San Diego police sergeant is actually to blame for the deaths.Jeffrey Brian Levi, 39, is charged with murder, gross vehicular manslaughter while intoxicated, hit-and-run and drunken driving, for the Jan. 2, 2018, deaths of 33-year-old Jesus David Dominguez and 19-year-old Isaac Felix, who were burned to death inside a Toyota Corolla that was struck at about 11:45 that night in the fast lane of northbound Interstate 15 near Miramar Road.Giovanna Dominguez -- Jesus Dominguez's sister and Felix's girlfriend - - was also a passenger in the Corolla. Raymond Rowe then struck the Corolla, which burst into flames and left Dominguez and Felix trapped inside the burning wreckage, while bystanders pulled Giovanna Dominguez out.The Ford Explorer overturned, coming to rest upside down, and Rowe was treated for minor to moderately serious injuries.Aguilar alleged that about three hours after the crash, Levi had a blood-alcohol content of 0.16%, which is twice the legal limit.Levi, who was charged with murder due to a 2007 misdemeanor DUI conviction, faces 40 years to life in prison if convicted.Defense attorney Amanda Waddle alleged that Rowe was "an unreasonable and negligent driver" who should be held liable for the deadly wreck. According to Waddle, Rowe was speeding, failed to wear his prescription glasses and was looking in his rearview mirror at the time of impact.Aguilar noted that Rowe often used his rearview mirror to spot anyone who might be trailing him from the police station to his home, a risk that Rowe potentially faced as a member of the department's gang unit.In addition to not paying attention, Waddle said that Rowe failed to use evasive maneuvers that were part of his police training."This was the direct result of that secondary, very violent crash where Sgt. Rowe was not paying attention to the roadway in front of him," Waddle said.The defense conceded that Levi was driving too fast in connection with the initial crash, but said "thankfully" there were no significant injuries as a result.Giovanna Dominguez -- who was expected to testify Wednesday -- did indicate during a preliminary hearing earlier this year that no one was injured as a result of the initial crash. SAN DIEGO (CNS) - A man who beat his estranged wife to death with a commemorative baseball bat as she delivered food to him at his City Heights apartment was sentenced Friday to 16 years to life in state prison.Dana Marion Davis, 56, pleaded guilty at an earlier hearing to second- degree murder in the death of April Davis, his spouse of more than 30 years and the mother of his six children.The defendant beat the 51-year-old victim with a wooden bat on the afternoon of Oct. 7, 2017, then prevented a family member and police from entering the apartment, said Deputy District Attorney Stephen Marquardt. When officers finally gained entry, she was found dead on the floor.Davis told Judge Michael Smyth that he was remorseful for killing the mother of his children."She didn't deserve this," the defendant said before he was sentenced.To his children -- three of whom were present in court -- Davis said, "I am deeply sorry for the pain I have caused you."A psychologist determined the defendant suffered childhood development trauma that affected his relationship with his wife, Deputy Public Defender Amy Hoffman told the judge.When talking to police after the murder, Davis was "clearly in shock" as to what happened, Hoffman told the judge. The attorney said alcohol was involved in the fatal encounter.According to Marquardt, the defendant was on probation for domestic violence when he killed his wife.
