SAN DIEGO (CNS) - New health restrictions took effect Monday in San Diego County and the rest of Southern California, shutting down indoor service at restaurants among other closures, due to the rapidly increasing number of coronavirus hospitalizations.A state-mandated "regional stay-at-home" order went into effect at 11:59 p.m. Sunday, triggered when intensive-care unit bed availability remained below 15% after Saturday's daily update, according to the California Department of Public Health.The 11-county Southern California region's available ICU capacity was 12.5% Saturday, a decrease from 13.1% the day before. The ICU capacity Sunday for the region was 10.3%. San Diego County had 20.5% of its ICU beds available as of Saturday.On Sunday, the county reported 35 new hospitalizations, bringing the total to 4,871. Three more patients were placed in intensive care, bringing the total to 1,068.The Southern California region consists of San Diego, Orange, Los Angeles, Riverside, Imperial, Inyo, Mono, San Bernardino, San Luis Obispo, Santa Barbara and Ventura counties.The stay-at-home order will be in place for three weeks and prohibits gatherings of people from different households. Regions will be eligible to exit from the order on Dec. 28 if ICU capacity projections for the following month are above or equal to 15%.On Sunday, San Diego County officials reported 1,703 new cases of COVID-19 and seven additional deaths.That brings the total number of cases to 92,171 with 1,062 deaths.County Supervisors Chairman Greg Cox said the three-week stay-at-home order was tough to take."There's no way around it," Cox said during a special Saturday briefing. SAN DIEGO (CNS) - Margaret Hunter, who pleaded guilty along with her husband -- former Rep. Duncan Hunter -- to illegally spending hundreds of thousands of dollars in campaign funds for personal purposes, was sentenced Monday to eight months of home confinement, slated to begin immediately, and three years probation.The former East County congressman's wife, who also acted as his campaign manager during much of the time the pair improperly spent campaign funds on personal expenditures, pleaded guilty to a conspiracy charge more than a year ago.Duncan Hunter pleaded guilty about six months later, then resigned from Congress the following month. He was sentenced in March to 11 months in federal prison, but has yet to serve any of his term as the COVID-19 pandemic led to a postponement of his self-surrender date. He's not expected to report to prison until possibly as late as January.Margaret Hunter's attorneys argued for an out-of-custody sentence involving home confinement and prosecutors agreed, citing her agreement to cooperate with investigators and the manner in which prosecutors say her husband directed blame at her when the allegations became public.Prosecutors did seek to have her home confinement delayed until January, as they stated it would be more punitive at that time, with the COVID- 19 pandemic currently keeping the majority of the general public confined to their homes.However, U.S. District Judge Thomas Whelan opted to begin her term immediately.Margaret Hunter made a brief, tearful statement to the court prior to sentencing, saying "I continue to take full responsibility. I'm deeply sorry."Assistant U.S. Attorney Emily Allen said the defendant spent most of the funds, but her role was "far less egregious" than that of her husband, who the prosecutor said was "the driving force" behind the crime."He was the elected official. He was the person in charge of the campaign and he was the decision maker who chose to allow this to go on," Allen said.Prior to his plea, Duncan Hunter repeatedly and publicly denied wrongdoing. He attributed more than ,000 in video game purchases to his son, while later suggesting his wife may have been responsible for the misspending, as she was the campaign manager and in charge of those finances.He later accused the U.S. Attorney's Office of a politically motivated prosecution, saying some of the lead prosecutors in his case attended a fundraiser for Hillary Clinton's presidential campaign. He alleged the prosecution targeted him because he was one of the earliest supporters of Donald Trump's presidential campaign."Today we're reminded that no one is above the law," Assistant U.S. Attorney Mark Conover said following the hearing.The prosecutor said the sentence handed down was appropriate because "not only did she have to withstand being thrown under the proverbial bus by her husband, but she took responsibility."Conover also credited Margaret Hunter's cooperation, saying that without it, prosecutors would have likely had to go to trial in order to secure a conviction against Duncan Hunter. Her cooperation "led Congressman Hunter to understand that he would not escape responsibility for his crime," according to Conover.The couple were indicted in 2018, charged with unlawfully spending hundreds of thousands of dollars on family vacations, restaurant and bar tabs, clothes and other frivolous expenses over the course of several years, while falsely stating to staff that the purchases were campaign-related.Prosecutors said that despite their lavish spending, the couple were in dire financial straits, overdrawing their bank account more than 1,100 times over a seven-year period.Amid the charges and public allegations, Hunter was re-elected in November 2018 with 51.7% of the vote in the 50th Congressional District, despite being indicted three months prior. SAN DIEGO (CNS) - A San Diego City Council committee signed off Thursday on the proposed sale of a vacant city-owned property on Cortez Hill to a nonprofit agency for less than ,000 to create more than 100 units of affordable housing.The .4-acre property at 1449 Ninth Ave. was most recently the site of the now-vacant Cortez Hill Family Center, which housed homeless families.The City Council's Land Use and Housing Committee unanimously approved the proposal to sell the property for ,593 to Community Housing Works, which develops, rehabilitates, preserves and operates affordable apartment communities in San Diego and throughout the state.The sale will now move to the full City Council for consideration.According to a staff report, the low price is justified because "the property sale furthers the public purpose of providing low-income rental housing for 55 years, the number of affordable housing units will be increased, and the city will be relieved of administrative costs and liabilities associated with managing and maintaining the property."Councilman Chris Ward, the committee's chairman, said the building has served an important role, and he's grateful to Community Housing Works for proposing to create a net affordable housing gain."We are eager to get started and to keep working," said Mary Jane Jagodzinski, Community Housing Works' vice president of housing and real estate development.The proposal calls for Community Housing Works to demolish the existing three-story structure and its 48 units and build anywhere between 75 and 110 units, at least 44 of which would be for people or families making 30% or less of the Area Median Income. The other units would be available to people making between 30 and 80% of the region's AMI. The property would also have up to three manager units.The city acquired the property -- formerly a Days Inn hotel -- in 2001 for transitional housing for homeless families. The San Diego Housing Commission administered homeless services at the facility from 2010 until last year, when nonprofit homelessness services provider Alpha Project took over.The building was vacated by families in April after the city opened Operation Shelter to Home at the San Diego Convention Center for those experiencing homelessness during the COVID-19 pandemic. The rest of the people at the city's transitional homeless shelters -- such as Cortez Hill -- were shuffled to central locations to allow for easier tracking of the virus and to prevent spread of the illness.Alpha Project vacated the building on May 8 and the city officially declared the property "surplus" on May 19.The city's sale is contingent on the development of affordable housing on the property. SAN DIEGO (CNS) - A young man accused in a series of San Diego-area gang-related killings and attempted slayings pleaded not guilty Monday to murder, attempted murder and conspiracy charges.Ismael Betancourt, 20, is charged in the Aug. 1, 2019, shooting death of 57-year-old Marco Magana in Mountain View, the Feb. 8 shooting death of 19-year-old Leah Posey in Southcrest, and two attempted murders that allegedly occurred on July 24, 2019 and Feb. 8.San Diego police announced Betancourt's arrest last month in connection with the April 8, 2018, shooting death of 55-year-old Lowry Rivers in National City, which occurred when Betancourt was 17. Rivers' killing is not listed in the latest complaint, and it's unclear whether Betancourt is being tried in juvenile court regarding that crime or whether additional charges are pending in his current case.In addition to the murders and attempted murders, Betancourt is charged along with six co-defendants with conspiracy to commit a crime, for what prosecutors allege was a plan to kill rival gang members.The overarching conspiracy includes the July 12, 2019, shooting death of 20-year-old Joaquin Ruiz, who was shot in a vehicle in Bay Terraces by assailants who opened fire from another vehicle.The four defendants charged with that slaying have been arrested and pleaded not guilty. Two of those defendants, Ethan Apan, 28, and Kevin Herrera, 26, are also charged in the murders in which Betancourt is charged. The complaint charges Apan in Marco Magana's murder and Herrera in Leah Posey's murder.Betancourt is being held without bail and his next court date is a Dec. 22 readiness conference. 1656
