SAN DIEGO (CNS) - Three San Diego County sheriff's deputies were justified in fatally shooting an Alpine man who charged at them with a knife in his hand last fall, according to a report released Wednesday by the District Attorney's Office.Daniel Ayala, 31, was shot 10 times outside his apartment in the 2600 block of Alpine Boulevard last Nov. 12.Sgt. Chris Katra, Cpl. Sean McGillicuddy and Deputy Kevin Nulton responded to that address around 2:50 p.m. following reports that a man was screaming, talking about killing himself and others, and throwing items, according to a letter prepared by District Attorney Summer Stephan and addressed to San Diego County Sheriff Bill Gore.Body camera footage from two of the lawmen was also released by the D.A.'s office.RELATED: Man who was fatally shot by deputies in Alpine identifiedAs the deputies approached the front door of Ayala's unit and knocked, announcing ``Sheriff's Department'' three times, Ayala opened the door, said ``What's up!'' and jabbed a knife twice through his metal screen door, the body-worn camera footage shows.The deputies backed up from the door as Nulton alerted the others by saying ``Knife, knife, knife.''Ayala then opened the screen door and advanced towards the lawmen, who opened fire, striking him mostly in the upper body, according to Stephan's letter.Ayala died at the scene. His 5-year-old son was inside the apartment during the entire encounter, but was physically unharmed, according to the district attorney.Toxicology results showed Ayala had methamphetamine, heroin, cannabis and alcohol in his system.Stephan's letter concludes that the deputies ``were in a confined space when Ayala advanced on them quickly with a knife in his hand.'' The letter also notes Ayala's previously reported statements about killing people.``The deputies had no other option available to them as they Ayala could stab them immediately and seriously injure or kill them,'' the letter reads.Katra has been employed by the San Diego Sheriff's Department for 18 years, McGillicuddy for 12 years and Nulton for 10 years. 2096

SAN DIEGO (KGTV) - A family wants the Governor of California to keep the man who murdered three San Diego State professors behind bars. Frederick Davidson was sent to prison in 1997 for three consecutive life sentences without parole after he gunned down his three engineering professors Chen Liang, Preston Lowry, and Constantinos Lyrintzis.The San Diego County District Attorney’s Office recently notified the victims’ families that Davidson applied for executive clemency.“Just asking for clemency?  Out of what?  On what grounds?” asked a distraught Esther Alonso, Lyrintzis’ sister-in-law.  Lyrintzis was married to her sister, Deana Alonso, and the couple had a young daughter.A District Attorney’s Office spokesman said the DA’s office already filed a letter opposing Davidson’s request.Alonso told 10News she could not believe Davidson would request clemency.  Alonso said the family agreed to not seek the death penalty in 1997 if Davidson agreed to plead guilty and go to prison for life without parole.“How can they tell them 20 years later that the deaths of their husbands and their fathers…that this guy has more rights than they do?” asked Alonso, a professor at Southwestern College. “I don’t understand a system where that is even possible.”Alonso created a Change.org petition directed at Governor Jerry Brown asking him to deny Davidson’s request.The DA’s spokesman said their office opposed more than 50 clemency requests last year and none of those requests were granted.  The spokesman added there is no deadline for Governor Brown to respond or send it to a hearing. 1627

SAN DIEGO (KGTV) – A child suffered severe injuries from a pit bull attack Monday in Logan Heights.The child was bitten on Irving Avenue around 2:30 p.m., according to the San Diego Police Department.Paramedics took the child to Rady Children’s Hospital to be treated for head lacerations and a possible puncture to the eye.20-month-old “Ookie” the pit bull was impounded by Animal Control officers. The dog was relinquished for euthanasia by its owner.According to the infant's adult sister, the 2-month-old has a cracked cranium and possibly a punctured eye socket. Witnesses say group was in the backyard when the dog licked then bit the infant's face. The owner of the dog reportedly had to pry the dog's jaw off the baby.  745

SAN DIEGO (KGTV) - A burglar squeezed through a doggie door and past a security system at a La Mesa-area home, making off with thousands of dollars in sentimental jewelry.Along Fuerte Drive, David Ward said his heart sank when he got home from running errands around 2 p.m. Wednesday. His eyes were immediately drawn to a back kitchen door."The cover to the dog door was not here .. it was lying on the floor. There's a sadness. SAN DIEGO (KGTV) - A Cajon Valley School District worker crossed into oncoming traffic in his work truck Friday morning, striking a car with a mother and child inside, California Highway Patrol officers said. The crash happened about 10:30 a.m. on Avocado Blvd. north of Challenge Blvd. in the Rancho San Diego area, according to the CHP. Officers say the 55-year-old CVSD employee was driving a Ford pickup with a trailer and made an unsafe left turn movement into oncoming traffic. The truck came into the path of a Ford Fusion and the vehicles crashed head-on. The impact sent both vehicles into the front yard of a home. “Initial indications are that the child safety seat which contained the infant was not properly installed and was found by responding emergency personnel face down on the rear floorboard of the Ford Fusion,” CHP officers said. Both drivers had major injuries but are expected to survive. The infant’s injuries are unknown but did not to be serious, officers said. Drugs and alcohol are not factors in the crash. 1044
