SAN DIEGO (KGTV) - A group of San Diego politicians presented a plan to White House officials Tuesday to finally address the flow of sewage from Mexico into U.S. waters.The centerpiece of the proposal is a 4 million treatment facility that would be able to process 163 million gallons of runoff a day.Local officials estimate the facility would be able to reduce the number days that sewage flows across the border from 138 to 12.“That’s 12 days more than it should be, but its certainly a lot better than the current situation is,” said San Diego Supervisor Greg Cox.He traveled to Washington for a meeting with White House officials on Tuesday, along with a delegation including San Diego Mayor Kevin Faulconer, Imperial Beach Mayor Serge Dedina and Port of San Diego Chairman Garry Bonelli. “We had a very good meeting,” reported Cox. “They were very impressed. The gentleman from the EPA, who’s in the best position to move the ball forward with us, said he’d never seen a more united effort coming from San Diego to deal with this problem.”Officials are looking at three potential funding sources. One would require Congress to pass a series of bills that would allocate .5 billion to the North American Development Bank (NADBank.)Money from NADBank can be used for the financing of infrastructure and water pollution projects on both sides of the border.A second option would also require an act of Congress, approving HR 4039 introduced by Rep. Mike Levin (D-CA.) The bill would allocate 0 million a year for five years to the EPA’s Border Water Infrastructure Program (BWIP.) Money from that account could also be used to fund the project.The third potential funding vehicle would be an increase to the International Boundary and Water Commission budget. Money for the IBWC is determined in agreements and treaties between the two countries. 1865

SAN DIEGO (KGTV) - A billion trolley extension in San Diego just hit a roadblock that could delay the project and drive the price tag even higher.Team 10 discovered the building permit for the Nobel Drive – La Jolla Village Square parking structure was not approved. The project development is being led by the San Diego Association of Governments (SANDAG).According to a letter sent from the City of San Diego to SANDAG, "The City determined in October 2019 that a building permit cannot be issued because the plans do not comply with the California Building and Mechanical Codes."The letter stated that the design of the parking structure includes a natural ventilation system, and the Building and Mechanical Codes require a distance separation of 10 feet where no other structures can be built that would block that ventilation. It goes on to state that the Building Code requires a minimum fire separation distance to an assumed property line between buildings or a property line.According to the letter, "The City understands it is SANDAG's position that the language in the easement being acquired for the parking structure prohibiting the property owner from causing a hazardous condition to the structure or the easement is sufficient to provide the necessary fire separation. However, the City disagrees that this language expressly prohibits the property owner from building on its property within the ten-foot separation required for the parking structure to comply with the Building Code. The parking structure easement only covers the footprint of the structure, and no other building restricted easement was obtained over the ten-foot separation area. The easement language specifically states that SANDAG has the responsibility for ensuring that the structure meets applicable building codes and safety standards."In a statement to 10News, the City of San Diego Chief Building Official wrote, "The City of San Diego has continuously worked with SANDAG and provided it with several options to incorporate the required fire-separation distance into its proposed Nobel Drive Parking Garage project and achieve compliance with the Building Code. Once the project design meets the building code requirements, a building permit will be issued."On Wednesday, SANDAG's Chief of Capital Programs Jim Linthicum told 10News the disagreement has nothing to do with the ultimate engineering of the project."It has nothing to do with any of the technical, the engineering, the mechanical work inside this parking structure they've all approved that," Linthicum said. "It has to do with a long issue of a setback, and so what we've requested is let us keep on talking and figure this out, but concurrently, let's keep the construction going so that Mid-Coast [Trolley] stays on schedule and on budget."Linthicum said the City requested a setback from the parking structure. He said the two agencies disagree on what exactly the code says."While we're working through this disagreement, we've asked for kind of a conditional or temporary permit to let work continue."Here's why the parking structure is so important. Beyond the parking spots, it will house some of the signaling and communication hardware that's needed to operate the trolley.Team 10 investigator Adam Racusin asked Linthicum if this could de-rail the project."Absolutely not," Linthicum said. "What this could do is this could delay the opening, and whenever you delay the opening, whenever you delay any mega project like this, it increases cost, and I think most people would understand that. We don't want to delay the opening, and we don't want to have increased cost. We have been working great with all the partners on this project. You know, with the City of San Diego, UCSD, and Caltrans, we've been working great. This, in my view, is just a small hiccup where they don't feel comfortable issuing a temporary or conditional permit."Linthicum said while they continue talking to the City of San Diego, they want the work to keep progressing."SANDAG has the authority under our MOU, our memorandum of understand with the city, to take this on ourselves," Linthicum said. "So we're going to be going to our board of directors later this month asking for that permission to do so."Linthicum said he's confident the parking structure will be open on time in October, keeping the project on budget and on track.A spokesperson for SANDAG also sent 10News a statement that says in part, "Throughout the Mid-Coast Trolley project, SANDAG has worked diligently to ensure that all design and construction work complies with California Building Codes and other applicable regulations. SANDAG continues to work through the technical issues raised by City of San Diego with regard to the Nobel Drive Trolley Station parking structure and is optimistic that the requisite building permit will be issued to allow the timely completion of the structure. The Mid-Coast Trolley project will add 11 miles to the UC San Diego Blue Line Trolley, extending service from the Santa Fe Depot in Downtown San Diego north along the I-5 corridor to the University community. The project is over seventy percent complete and remains on schedule." 5204

SAN DIEGO (KGTV) — A decision regarding the release of a sexually violent predator into Jacumba Hot Springs has been delayed.A judge said he still needed to look at alternatives after researching the proposed home at 45612 Old Highway 80 in Jacumba Hot Springs where 60-year-old Michael Poulsom would live if released. After listening to testimony, the judge says he’s not ready to make a decision about whether to grant his petition to be released from a mental hospital.Poulsom was convicted on three separate occasions, including twice in San Diego, for sex crimes involving children. He was sentenced to 15 years in prison in 1995, but committed to a state hospital as a SVP, a designation for sthose convicted of a sexually violent offense and diagnosed with a mental disorder. In Poulsom's case, he was diagnosed with pedophilia disorder.He has since petitioned for his release into a conditional release program for sex offenders. Doctors have medically cleared the release.RELATED: Bill introduced to keep sexually violent predator hearings open to publicAmong those that testified today was County Supervisor Dianne Jacob, who represents the area where Poulsom would be released. She says there has to be other areas he can go."Where are the other 700 places they checked out. I question that and I question if they checked out over 700," Jacob said.This hearing comes just after the court of appeals threw out a judge’s decision that would have freed the man known as the “Bolder than Most Rapist,” Alvin Quarles. Quarles was charged in more than 50 rapes, robberies, and burglaries in the 80s. His victims have fought to keep him away from the community.In Poulsom's case, the judge did not give a timeline as to when he will makes his decision.City News Service contributed to this report. 1809

  

SAN DIEGO (KGTV) -- A 2-year-old boy who was reported missing by his stepfather in San Diego in 2002 suffered a fatal injury and died while in the sole custody and care of the stepfather, who disposed of the body, a prosecutor said Thursday, but a defense attorney said her client loved the child and didn't kill him.Tieray Jones, 39, told police that Jahi Turner disappeared from a park near the southern end of Balboa Park the afternoon of April 25, 2002.Deputy District Attorney Bill Mitchell told a jury that Jones married Jahi's mother -- Tameka Jones -- after Jahi was born and the couple moved to San Diego from Maryland in February 2002.The defendant was left to care for Jahi when Tameka Jones -- who was in the Navy -- went out to sea on April 22, 2002, the prosecutor said.Three days later, the defendant called 911 and said his step son disappeared in the park when the defendant walked to a vending machine."We will piece together what happened that week," Mitchell told thejury. "You're gonna know what happened to Jahi based on the evidence."Two days before he reported the child missing, Jones told his wife that Jahi had fallen off the bed and bumped his head, but it was "no big deal," the prosecutor said.Jones also complained that Jahi had wet the bed, according to Mitchell. Witnesses at the apartment complex where Jones lived said they saw the defendant carrying three large trash bags to a Dumpster just before the trash was to be picked up the day before the child disappeared, the prosecutor told the jury.One neighbor commented, "It didn't look like regular trash," Mitchell said. The prosecutor pointed to "glaring inconsistencies" in the defendant's statements to police about what happened.Mitchell said there was "no credible evidence" that Jahi was at the park that day. Despite a massive search, the child's body was never found.Jones was arrested in April 2016 in North Carolina and brought back to San Diego to face a murder charge.Deputy Public Defender Courtney Cutter told the jury that her client was a suspect in his stepson's disappearance almost immediately.Cutter said the defendant and Tameka Jones were used to just "getting by" and had very little when they moved to San Diego.The attorney said her client loved Jahi as if he were his own. "Tieray did not kill this child," Cutter told the jury."He was an imperfect father, yes, but not a reluctant one." At the end of the trial, there will be more questions than answers as to what happened to Jahi, Cutter said. Jones faces 25 years to life in prison if convicted. 2570

  

SAN DIEGO (KGTV and ABC) - Fishermen had a close encounter with killer whales off the San Diego coast that was caught on camera. The group was on a 21-foot boat looking for yellowtail when they came across the orcas. "Out of nowhere, one of them popped up right next to the boat 3 or 4 feet away from me…landed, splashed me, and splashed the whole side of the boat. I screamed,” witness Nathan Benge told Good Morning America. One of the killer whales had a playful interaction, performing a belly roll beneath the surface of the boat’s wake, GMA reported. RELATED: Drone video captures massive group leopard sharks off La Jolla “Oh, it was incredible,” said Benge. “I've never been that close to a creature. Just huge.
