SAN DIEGO, Calif. (KGTV) - A gang member was sentenced to more than 126 years in prison Tuesday for the murder of Navy pilot James Celani at Horton Plaza in 2017."This is not living. This is hell," said Celani's cousin, Sean, who was also shot in the incident. "Mr. Morris killed my happiness and my life."Sean, who asked not to have his last name revealed, and Celani were at the Mad House Comedy Club that night. Upon leaving the club, they walked past a group of men, including Morris. Sean said he offered an innocent greeting, "What's up, brother?" At that point, Morris pulled a gun and opened fire, killing Celani and hitting Sean in the leg. Prosecutors say Morris, who has a history of violence, was angry because of a fight that evening with his girlfriend.Celani's wife spoke during a victim impact statement, describing how she and their three children have suffered since her husband's murder. She called for Morris to get the maximum sentence. "The system couldn't or wouldn't protect Jim and Sean from Arrow Morris, but you can safeguard society from Arrow Morris by letting the punishment fit the crime and sending him to prison for the rest of his life."Morris has 60 days to appeal his sentence. 1221

(KGTV) - A couple in San Diego are spending the holiday telling everyone they know to register as an organ donor."People don't like to talk about their death, but rather than bury these organs or burn them up, you can save lives," says Nancy Marlin, who is recovering from a kidney transplant.Marlin had a genetic kidney disease and would have needed dialysis if not for the donation. Her new kidney came from a co-worker."I was so fortunate," says says. "Someone gave me the most amazing gift."It's a gift her family knows well. Marlin's husband, Fred Kolkhorst, had a heart transplant just 18 months ago after being diagnoses with heart failure."It changes you immensely in ways that are difficult to describe," he says.Kolkhorst and Marlin are rare in that they're a married couple who have both received donated organs. Sharp Memorial Hospital Transplant Coordinator Tammy Wright says she can't think of any couples in her 25 years in the field.Wright says the holidays are the perfect time for families to talk about their wishes in regards to organ donations."It's a time of giving," she says. "The simple thing is to tell your family what your wishes are. SAN DIEGO, California — One person died and two others were injured, and Coast Guard crews rescued 17 others after a mega yacht collided with a fishing vessel off the coast of Imperial Beach on Friday night. The 332-foot yacht, Attessa IV, crashed into the 65-foot sportfisher vessel, Prowler, just before 8 p.m. about nine miles off the shore of Imperial Beach, according to the Coast Guard.The collision caused extensive damage to the right side of the Prowler.One man was airlifted to UCSD Hillcrest and died at the hospital, the Coast Guard confirmed. Two others were injured in the accident.Coast Guard crews transferred 17 passengers from the damaged fishing boat back to San Diego. The Prowler's 10 remaining passengers were transferred onto the Attessa IV, set to return to San Diego.The Coast Guard is investigating the cause of the accident. 884

SAN DIEGO (KTGV)— A homeless man and convicted rapist accused of sexually assaulting a woman at an East Village bar in November faced his accuser in San Diego Superior Court. Gary Cushinberry, who's accused of multiple counts of sexual assault and attempted rape, pleaded not guilty. The judge ordered all media to conceal the victim’s identity, and to refer to her as Jane Doe. Jane Doe took the stand and recalled what happened on the evening of November 5th. She said she was at Amplified Kitchen and Beer Garden in East Village, celebrating with some colleagues.After having a few drinks, she headed to her car. She admitted she was drunk at the time, and her memory was hazy. But she did remember the moment her bottom touch the ground.“He was touching underneath the blanket, and I just remember being shocked. Uh, next he further proceeded to put his hand in my pants,” Doe said. While he attacked her on the ground underneath a dirty blanket, he tried to drug her with what she thought was a meth pipe, Doe continued. Detective Carlos Munoz of the San Diego Police Department also spoke in open court. After the case was assigned to him, he monitored surveillance cameras in the area. The detective found footage of a homeless man fitting Gary Cushinberry’s description, pulling Jane Doe into a bush next to her car. The two were not in frame for the next 25 minutes, until video captured Jane Doe speeding away from the parking lot, back into Amplified, where she later reported the assault.“It’s like you imagine a fight or flight. And I didn’t really fight and I didn’t flight. I just froze,” Doe said. Cushinberry, who is already a convicted rapist in Indiana, returned to the frame, just two minutes later. “When he walks up toward the intersection, or the corner, he is adjusting his belt, he is adjusting his waist,” Detective Munoz said. The next day, Jane Doe provided information for a suspect sketch.Officers also took her to Palomar Hospital to run a rape kit. DNA Criminalist Adam Dutra of the San Diego Police Department Crime Lab tested the DNA swab taken from the front button and zipper of Jane Doe’s shorts.“There was strong support for the inclusion of Mr. Cushinberry as the 98% contributor,” Dutra said. Cushinberry’s past convictions include rape in 1995, sexual battery in 1997, and recently, felony robbery in San Diego.His next court appearance is on December 19th. 2407
