A report from the Tucson Police Department is revealing new details about the death of Carlos Adrian Ingram-Lopez while in TPD custody in April.The police department began its investigation into the incident hours after it happened on April 21. Nearly two months later, on June 19, the department finished its report and handed it off to TPD Chief Chris Magnus. After a news conference about the incident Wednesday, TPD released the full report to members of the news media.TIMELINE: What happened after Carlos Ingram-Lopez died while in TPD custodyThe report recommends termination for officers Samuel Routledge, Ryan Starbuck, and Jonathan Jackson, who had resigned the day before the investigation was completed.The discipline report focuses on how officers are supposed to treat someone in a state of “excited delirium," how it greatly increased the risk of dangerous physical distress and how the three officers failed to meet their standards and training.The report draws a number of conclusions about the officers involved in the incident. It says:The initial report of Ingram-Lopez's behavior should have prepared the officers to deal with excited delirium before they even saw him.Ingram-Lopez's behavior at the scene made excited delirium very clear.The report documents dates of when the officers had training on excited delirium at the academy and in other training sessions after that.Excited delirium and the likelihood of drug intake make overheating and rapid heartbeat something officers should anticipate.The fact that he was calling for water confirms they should have been more aware of his physical distress.The officers were trained on, and should have been alert to, signs of breathing trouble, like wheezing, and simply saying “I can’t breathe." Ingram-Lopez did both.The officers had been trained on the “recovery position” designed to reduce physical distress on a restrained suspect.One of the officers who arrived later said within 15 seconds, “Shouldn’t he be in the recovery position?” That officer is not being disciplined.The officers put a “spit sock” over Ingram-Lopez's face because of his choking and clearing his throat made them fear he would spit and spread COVID-19. The spit sock was available to officers even before the COVID outbreak.While officers did not use prohibited methods like neck holds, they noted Ingram-Lopez was a large man and one of the officers kneeled on his back for a sustained period.Officer Jonathan Jackson was Lead Police Officer -- slightly more senior than the other officers who first arrived at the scene. He was expected to take command and organize the other officers. A university official said that Jerry Falwell Jr. has resigned as president of Liberty University Monday, according to media reports. But Falwell told a TV station in Virginia that he has not agreed to resign, and reports of his resignation are "completely false."Falwell was already on a leave of absence from the evangelical Lynchburg, Va school his father founded following a series of personal issues.Over the weekend, Falwell issued a lengthy statement disclosing the “emotional toll” an affair his wife had with a man was having on him. He says the man, identified by media reports as a former pool attendant and later a business partner of Falwell and his wife, threatened to reveal the relationship “to deliberately embarrass my wife, family, and Liberty University unless we agreed to pay him substantial monies.”In his statement, Falwell said he and his wife met the man she had an affair with during a vacation over eight years ago. The man was working at the hotel where the Falwells stayed, the statement said.“Shortly thereafter, Becki had an inappropriate personal relationship with this person, something in which I was not involved – it was nonetheless very upsetting to learn about,” Falwell said in the statement. A routine trip to Walmart turned into a nightmare for a Maryland woman, but now she is using her negative experience to help others. Cynthia Morales and her boyfriend Linwood Boyd, who are both blind, were at the self-checkout lane at the Walmart in Owings Mills, Maryland in late July 2017 when they asked an employee for help. While the self-serve kiosks do issue some spoken prompts, it was still a challenge for Morales and Boyd to check out. A Walmart employee helped the pair finish their transaction, but unbeknownst to Morales and Boyd, they requested in cashback, which the employee pocketed. Because no audio prompt gave them a total of their transaction, the couple had no idea this happened until the machine told them to take the cash. Unable to check their receipt, the couple asked someone outside of the store to read them it and discovered they had been charged the extra . The money was returned, but Morales and Boyd decided to shop at another nearby Walmart from then on. Because of their experience at the Walmart, they are teaming up with Melissa Sheeder — another blind Marylander — the National Federation of the Blind (NFB) and the National Federation of the Blind Maryland to sue Walmart under the Americans with Disabilities Act. “What happened to Cindy Morales is an extreme example of what can occur when companies like Walmart deploy inaccessible self-checkout or point-of-sale technology,” said Mark Riccobono, President of the National Federation of the Blind. “The real problem is that Walmart has decided to treat blind customers differently from sighted customers. Walmart’s refusal to deploy readily available technology to give blind shoppers the same choice sighted shoppers have — whether to check ourselves out or visit a cashier —makes us second-class customers. That is unlawful and unacceptable.”The lawsuit is asking for the Maryland federal district court to order Walmart to make its self-service checkout kiosks fully accessible to blind shoppers.
