SAN DIEGO (KGTV) -- A 25-year-old has been arrested after being shot by a store clerk he was trying to rob, San Diego Police say.According to police, Hector Lopez-Gastelum entered the La Michoacana store on the 700 block of Vesta Street around 10:40 a.m. on October 18 demanding cash. Police say Lopez-Gastelum was armed with a handgun.After the clerk handed over the cash, the suspect reportedly demanded that a second register be opened.“While Lopez-Gastelum was still in the store, the clerk shot him twice in the torso with his own handgun, which is legally owned,” police said.The clerk then retrieved Lopez-Gastelum’s handgun and called 911. The suspect was taken to a hospital where he is being treated for his injuries. SAN DIEGO (KGTV) - A former employee of the San Diego Metropolitan Transit System is suing the agency for retaliation after he said he stood up for a co-worker.Ivan Augustino moved to the United States from Sudan and still volunteers with projects for his native country. He started working for MTS in 2015.“It was pretty good,” Augustino said.Augustino worked as a Senior Applications Developer.“I am the main guy that deals with the complicated back end computer codes,” Augustino said.In 2017, he said he made a move that changed everything. It started with a co-worker.“One morning, she walked into my office pretty much in tears,” Augustino said.He said that a co-worker confided to him the Chief Information Officer discriminated against her when she asked about a promotion. The lawsuit filed against MTS claims the CIO told Augustino’s co-worker she was “not qualified for the job because of her age, her marriage and family planning status, and her relationship to an active duty military service member.”“The other question she also asked was, how old are you? You seem like you are at an age where you would be having kids,” Augustino said. It was a shocking conversation.“You know, that is wrong,” Augustino said.After his co-worker told him what happened, he first asked advice from another co-worker who then took it to human resources. Augustino said his co-worker did not want to bring the complaint to HR.“The last thing that anyone within the IT department wants is to take an issue to HR because once you report it to HR, there is going to be retaliation,” Augustino said.And that’s what happened, according to the former MTS employee. Initially, he was concerned how MTS investigated the complaint.“I was expecting someone to at least come and talk to me, but no one spoke to me,” Augustino said.He said retaliation began by the CIO and his direct supervisor.“The way they treated me just changed,” Augustino said.He claimed management suggested they would give him recommendations if he found another job. On another occasion, Augustino said they “mocked [his] English as a second language” in an email. On top of that, he said 98 hours of paid time off promised to him for working overtime on a big project was revoked, along with a promised promotion.“Coming from where I come from, I just felt like I did not even know what to do,” Augustino said.Feeling “degraded” and “intimidated”, he submitted a letter of resignation. However, he said he gave management an option.“If you can address this issue and the executive team and bring what I view as retaliation to a stop, I will pull my resignation,” Augustino said. Instead, he said he was fired and walked out of the building by security. His termination came a little over a month after he voiced his concerns about his female co-worker.A spokesperson for MTS told Team 10: “There is absolutely no validity to any of Mr. Augustino’s claims.”When asked if he would defend his co-worker again, Augustino said “absolutely.”Attorneys Zachary Schumacher and Daniel Goularte represent Augustino."This is absolutely a David versus Goliath situation," Schumacher said.Schumacher said fear is why people don't speak up."I like to compare it to battered wives syndrome, where you essentially have this person or in this case this entity who has this major power and balance who is doing all sorts of awful things and figuratively at least, battering its employees and yet they don't leave. She told Christopher Dougherty he doesn’t have the right to prefer his kid’s expenses over his creditors.Today the judge ruled Dougherty will be in Chapter seven bankruptcy, meaning that he and his wife are no longer in charge of their own assets.A trustee will investigate and liquidate those assets.Dougherty is being accused of running a Ponzi scheme targeting mostly elderly victims who planning for retirement and taking more than million, according to bankruptcy court records.In bankruptcy court documents, the United States Trustee wrote Dougherty’s “deception is the basis of a Ponzi scheme.”“[Their] practice of using new investment money to pay existing investors dividends and the principal gave the false impression that the payments received by investors came from earnings and profits or from a return of their principal,” the documents said.The San Diego County Sheriff's Department tells 10News there is a criminal investigation into Christopher Dougherty with at least 30 potential victims.The Securities and Exchange Commission also has an open investigation into Dougherty. 1237

SAN DIEGO (CNS) - The UC San Diego School of Global Policy and Strategy's Center for U.S.-Mexican Studies released a report today detailing recommendations for both countries to cooperate on border security and drug trafficking policy.Chief among the report's recommendations is the creation of a joint cooperating group to help both countries reconcile their differences to achieve the best policies possible. The report also suggests the creation of a joint task force to disrupt trafficking of opioids like fentanyl.Bilateral cooperation is made difficult at the moment, according to the center, due to the divergent policy views of U.S. President Donald Trump and Mexican President Andres Manuel Lopez Obrador, who took office last December.While Lopez Obrador declared an end to the country's war on drugs in January, Trump has sought to build a wall on the U.S.-Mexico border to deter drug traffickers and violent criminals in addition to immigrants entering the country illegally."Despite these challenges, we see this as an opportunity to resume a dialogue at the highest level around bilateral security,'' said Rafael Fernandez de Castro, the center's director. "Our report offers concrete and implementable policy recommendations over the next six years of Lopez Obrador's presidency, ensuring policymakers are informed and prepared to continue cooperation efforts in a difficult phase in the bilateral relationship.''In addition to the two joint groups, the center suggested that the U.S. should improve its cooperation with and support for Mexico's newly established National Guard, its criminal justice system and community policing efforts in both countries. SAN DIEGO (CNS) -- Two men were wounded when another man opened fire from the passenger's seat of a vehicle on a street in the Encanto neighborhood, police said Tuesday.It happened around 10:10 p.m. Monday on Klauber Avenue near Attix Street, west of 69th Street, San Diego police Officer John Buttle said.A 25-year-old man and a 28-year-old man were standing outside their home when a woman drove up in a vehicle, described as a black or white BMW, with a man in the front passenger's seat, Buttle said.The man in the passenger's seat, believed to be in his late 20s, fired at least seven shots and the younger man was struck four times in the stomach while the older man was struck in a buttock and a leg, the officer said.Family members started to transport the victims to a hospital, but they were stopped by police, then paramedics took the victims to a hospital for treatment of their injuries, which were not believed to be life-threatening, Buttle said.No detailed suspect descriptions were immediately available. 1029
