SAN DIEGO (KGTV) -- San Diego Police are investigating after a man died in custody after reportedly breaking down a fence and walking into someone’s home Tuesday afternoon. Police were called to the 2900 block of Hornet Way around 3:30 p.m. Tuesday afternoon after receiving a call from someone saying a man, later identified as Buddie Thomas Nichols, 40, had entered his home through a rear door. According to police, the man broke down a fence and walked into the home through an open back door. Two of the residents were upstairs while their 9-year-old daughter was asleep downstairs, according to police. Police say one of the residents came downstairs when he heard commotion and confronted Nichols, punching him twice in the face and rendering him unconscious. Police say the suspect woke up and ran out of the house displaying bizarre behavior after the resident kicked him. Witnesses told police they believed the man was on drugs. When police arrived and tried to take the Nichols into custody, officers say he resisted, forcing them to use physical force to get him into handcuffs. After paramedics arrived, police say Nichols became unresponsive and later died after being taken to the hospital. 1215

SAN DIEGO (KGTV) — San Diego County avoided being on the state's monitoring list for the third consecutive day on Friday, which should allow the county to be removed from the list.Friday, the county reported a calculated case rate of 96.3, below the state's threshold of 100 coronavirus cases per 100,000 people over 14 days. Despite this, the county said Friday, "the state said today that it will review its data before removing San Diego County from the list."San Diego County has remained within the necessary thresholds of California's other five monitoring metrics:The county could be placed back on the list if it posts three straight days over the state thresholds once again.If or when the county is removed from the list, officials say the region shouldn't expect an immediate return to normal. California is not planning on issuing any further business reopening guidance and county officials have said that no new business sectors are scheduled to reopen if the county gets off the list."The goal of our exercise is not to get off the state's monitoring list and get our case count below that, the goal is to have it remain below that," Supervisor Nathan Fletcher said Thursday. "And we have to avoid the temptation or mindset that if tomorrow's numbers are under 100 that somehow we feel like we've made it, that we're done, we can go back to normal ... we want to avoid the seesaw of up and down, opened or closed."But part of the uncertainty is the state hasn't clearly outlined what happens after a county falls off the watch list. Mayor Kevin Faulconer sent a letter to Gov. Gavin Newsom requesting guidance on how counties proceed after they fulfill the requirements to get off the list."No process currently exists for restarting other activities, such as gyms and fitness centers, places of worship, non-essential office workplaces, personal care services, barber shops and salons, shopping malls, and higher education, all of which have been restricted to outdoor operations," Faulconer's letter read. "The lack of a consistent process for these businesses, with logical, data-driven triggers, exacerbates an increasingly difficult economic situation, and undermines the credibility of and compliance with the State's public health order."Schools, however, would be the next sector to see some sort of reopening. In-person classes at schools 7th- through 12th-grade can resume after San Diego County stays off the state watch list for another 14 consecutive days — depending on school district plans. This could mean students are able to return to the classroom before the end of the month.So far, 56 local elementary schools have also filed waivers with the county to return to classrooms early.Last month, California released guidance on how schools can resume in-person this fall if approved, including measures regarding face coverings, physical and distance learning requirements, testing needs and contact tracing, and physical distancing.Those guidelines also included when schools would be required to go back to distance learning:Schools should consult public health officer first if a classroom needs to go home because of a positive caseA classroom goes to distance learning if there is a confirmed caseA school goes to distance learning if multiple classrooms have cases or more than 5% of a school is positiveA district goes to distance learning if 25% of a district's schools are closed within two weeksSchools that have already reopened for in-person instruction would not be required to close again if the county is placed back on the watch list. SAN DIEGO (KGTV) — San Diego Lifeguards say beach attendance was much larger compared to a typical weekend, but drastically smaller than the usual Independence Day crowds. Still, lifeguards conducted hundreds of rescues along San Diego's coastline.America's big beach birthday bash was not as jam-packed this year."We didn't know what to expect," San Diego Fire-Rescue Lifeguard Lt. Andy Lerum said. "We thought maybe with LA beaches and Orange county beaches closed, we'd see an influx, but we didn't really."Lt. Lerum says only about 200,000 to 300,000 people came to San Diego beaches this July 4th weekend, compared to over 1,000,000 visitors in years past."Obviously, with the fireworks being canceled, people didn't camp out all day waiting for them," Lt. Lerum said. "So parking lots were full; however, the beaches and parks were not at full capacity."This meant leftover trash was not nearly as bad either. Volunteers of the local Surfrider Foundation spent a fraction of their usual time picking up Sunday morning.Those who did come to the beaches could not wait to dip their feet in the sand."For three months, we are in quarantine, and so it was so hard for me!" Fay Beygi said.Only a few people were seen wearing masks, as many visitors stuck together with their families, or were in the water.While some were hoping for more enforcement, lifeguards shifted their focus on the dangerous high surf. On July 4, 2020, they conducted about 300 rescues — 197 of them were at the La Jolla Windandsea. That number includes responding to swimmers in distress, stingray patients, and boating emergencies.While that is a lot for a typical day, lifeguards say that it is less than half of the usual July 4 numbers. SAN DIEGO (KGTV) — San Diego District Attorney Summer Stephan is objecting to the early release of a man convicted of driving off the Coronado Bridge and crashing in Chicano Park, killing four people.Richard Anthony Sepolio, 27, was convicted of four counts of vehicular manslaughter while intoxicated and one count of DUI causing injury in the crash on Oct. 15, 2016. He was sentenced to nine years and eight months in prison. He is set to be released early after serving two years and 10 months of his sentence. Monday, the CDCR notified victims in the case of the release, citing prison credits for good behavior and the state's policy on release amid COVID-19. Stephan wrote a letter to Gov. Gavin Newsom and the California Department of Corrections and Rehabilitation (CDCR), calling the release a "miscarriage of justice.""This very early release is unconscionable," Stephan wrote. "CDCR’s decision is re-victimizing the family and friends of the four people killed and seven injured who have been devastated by their loss and continue to deal with the financial, emotional, mental and physical trauma caused by the defendant.
