SAN DIEGO (KGTV) — New details are emerging about the death of a man in San Diego Sheriff’s deputies’ custody. A recently released Medical Examiner’s report says an arrestee’s death last year was a "homicide." The District Attorney's office said last year that none of the deputies involved in the in custody death will face any criminal charges. Oscar Leal died last February 28 after deputies responded to his apartment in Vista and detained him. RELATED: D.A.: Officers will not be held liable in 8 officer-involved shootings, 4 in-custody deathsThe autopsy report said the 37-year-old died from a sudden cardiac death due to chronic methamphetamine use, a physical altercation with deputies and being restrained. The Medical Examiner’s homicide classification is not a legal term, but a medical assessment. The DA's office wrote in part of a nine-page summary and statement in December last year: "... His level of methamphetamine intoxication combined with his active resistance combativeness in the duration of the struggle, all contributed to his death ... The deputies involved in his detention acted reasonably under the circumstances in bear no state criminal liability for their actions."The Sheriff Bill Gore wrote in a statement:"I am aware of the Medical Examiner's conclusion regarding the manner of death of Mr. Leal. I respectfully disagree with the classification of the manner of death in this case as a homicide.The pathologist wrote that his death was due to acute methamphetamine toxicity in the setting of agitation, physical altercation, and prone restraint. It was purely due to Mr. Leal's agitation that he was restrained. Peace officers have a duty to restrain those who are agitated and under arrest, as Mr. Leal was. Were it not for Mr. Leal's abuse of methamphetamine he would be alive today. The deputies and nurses on scene rendered immediate aid to Mr. Leal.Mr. Leal brought upon his own death with his choice to use methamphetamine. His manner of death is more accurately classified as an accident."It has not been made clear yet why the medical examiners report took 13 months to be released. 2135

SAN DIEGO (KGTV) — One person was found shot inside their vehicle in the Encanto area on Wednesday, according to police.The shooting occurred in the 6200 block of Varney Drive, near Leaf Terrace and Vado Way, just after 7:30 p.m., according to San Diego Police. Officers arrived to find a man in a vehicle who had been shot at least once.The man was taken to a nearby hospital, where he was pronounced dead. The man has been identified, though police only described him as a 44-year-old Black male.SDPD says it appeared the victim was in the area with an acquaintance when another vehicle pulled up near the victim and fired several rounds. The suspect then fled the area.Police described the suspect as an unknown race male, wearing all dark clothing. He was driving a white 4-door vehicle that was last seen driving away westbound on Varney Dr.Anyone with information is asked to call SDPD's Homicide Unit at 619-531-2293 or Crime Stoppers at 888-580-8477. 966

SAN DIEGO (KGTV) - Psychiatrist Clark Smith, MD, shed light on the San Diego County Medical Examiner’s findings in Trevor Heitmann’s autopsy that revealed the 18-year old suffered from mania.Heitmann caused the fiery 805 crash on August 23 that ended not only his own life but the lives of Aileen, 43, and Aryana Pizarro, 12.The Medical Examiner’s report showed Heitmann died of blunt force injuries. Toxicology reports indicated there were no signs of drugs or alcohol in Heitmann’s system. So what led an otherwise healthy 18-year-old man to drive the wrong way at 100 mph? The Medical Examiner believed there was a long build-up to the crash. The reports stated, five days before the crash, Heitmann began showing signs of mania."The manic mood swing could be so powerful, that people lose contact with reality,” Dr. Smith said.Dr. Smith reviewed the autopsy reports with 10News. Although Heitmann had no history of depression or mental illness, Dr. Smith believed he might have been bipolar with manic tendencies. "The mood swing can change like that from being king of the world, on top of everything, to crashing, and being horribly depressed and suicidal,” Dr. Smith said. “My guess is he was feeling badly because of the setbacks that he had, losing his business and source of income. And that would be a time when he would be reactive and become more depressed.”Heitmann was a popular YouTube gamer with a successful business selling game pieces online. That was how he said he bought his high-end sports car. But earlier this year, his business was suddenly banned and shut down. The Medical Examiner said his parents noticed his mood changes and tried to get him help. They physically blocked his McLaren from leaving the driveway, and called authorities to report his behavior. But Dr. Smith believes at that point, Heitmann’s symptoms had progressed too far. “Most people who are suicidal, just take their own life, but some people are also homicidal,” Dr. Smith said. “And in this case, it's a murder-suicide. I think he had lethal intention. He didn't know who he was going to kill. But he knew he was going to kill someone."Dr. Smith said this was a true tragedy that was preventable. “This was treatable, and it’s just a heartbreak that he didn’t get treatment,” Dr. Smith said. He added bipolar manic depression is nothing to be ashamed of. SAN DIEGO (KGTV) -- Police Tuesday released video of a deadly officer-involved shooting in El Cerrito. The body camera footage is being released within 45 days of the incident as part of Assembly Bill 748. The video shows the moment 52-year-old Dennis Carolino was shot by an officer. According to police, Carolino’s aunt called police the night of August 24 to report that he hit her in the head with a brick. The 70-year-old woman told police Carolino had psychiatric issues. RELATED: Man dies following officer-involved shooting in El CerritoPolice requested the assistance of the Psychiatric Emergency Response Team (PERT) and responded to the home in the 5800 block of Adelaide Avenue, where officers encountered Carolino in the backyard.“As the officers entered the backyard area to determine the location of the man, he quickly emerged from an outbuilding, holding a shovel. The officers gave the man verbal commands to drop the shovel. One of the officers drew his Taser at that point. The man did not cooperate with the officers’ commands and began to rapidly advance on the officers as he swung the shovel. One officer fired the Taser, which did not have any effect on him. The man continued to advance, prompting the other officer to fire his service weapon,” San Diego Police said in a statement.San Diego Police say three seconds passed from the time Carolino left the outbuilding to the time he was shot. Officers provided aid to Carolino until paramedics arrived, but he died shortly after. Officer Jose Mendez, a 16-year veteran of the department, fired his Taser, SDPD said. The officer who fired his service weapon was identified as Officer Brad Keyes, a four-year veteran of the department. 1717

  

SAN DIEGO (KGTV) - Police said Tuesday they have arrested a student for threatening to "shoot up" Westview High School.The threat was reported by school staff Tuesday, wherein a student reportedly told other students not to come to school Wednesday "because the student was going to shoot up the school," according to a press release from school officials.Officials said several students reported the threats to Westview High officials. School staff started investigating the threats before contacting police.RELATED: Police investigate threatening messages at Rancho Bernardo High SchoolThe student who reportedly made the threats was taken into custody and brought to Juvenile Hall.
