He said the ratio between the billion in punitive damages and million in compensatory damages is too high. He said judges rarely allow punitive damages to exceed four times actual damages awarded.The California Supreme Court ruled in 2016 that any punitive damages exceeding 10 times the compensatory damages are likely unconstitutionally high. The court didn't propose a ratio it felt correct, but said punitive damages should almost never exceed nine times actual damages, it said.The punitive damages awarded Monday are 36 times the actual damages.The lawsuits have battered Bayer's stock since it purchased Monsanto for billion last year and Bayer's top managers are facing shareholders discontent.Chairman Werner Wenning told shareholders at Bayer's annual general meeting in Bonn last month that company leaders "very much regret" falls in its share price. At the same time, CEO Werner Baumann insisted that "the acquisition of Monsanto was and remains the right move for Bayer."Bayer's stock price closed Monday at .91 a share, down 45 cents or 2.76 percent per share, in trading on the New York Stock Exchange. SAN FRANCISCO (AP) — After successive years of devastating wildfires, California's fire agency announced a plan Tuesday that would dramatically increase logging and other forest management efforts with the help of the National Guard.The California Department of Forestry and Fire Protection released a list of 35 priority fuel-reduction projects it wants to start immediately across the state over roughly 90,000 acres. That's double the acreage the agency aimed to cover in the current fiscal year, CalFire Deputy Chief Scott McLean said.The agency is also seeking National Guard assistance to coordinate the work. SAN DiEGO (KGTV) - Police deployed tasers to arrest a man following a road rage outburst that got out of control Wednesday evening.Police identified the man as 33-year-old Jason Berard. He was driving a silver SUV that backed into a white pickup truck near Park Boulevard and Howard Avenue in the University Heights neighborhood.  According to the driver of the pickup, they pulled over into a Chevron. The driver of the pickup truck thought they were going to exchange insurance information, but instead, Berard was confrontational.  According to witnesses, Berard punched the other driver before ripping away the man’s cell phone and throwing it on the ground, smashing it.A gas station employee called the police.  After police responded and made contact, police say Berard assaulted an officer. That’s when another officer came to help and fell to the ground during the struggle.Police say Berard took off on foot and got about a block down Howard Avenue but was taken down after an officer using their taser.Berard could be facing battery charges on an officer as well as resisting arrest. 1122

(KGTV) - A wall at the intersection of Ocean View and 30th in the Logan Heights neighborhood of San Diego has been turned from a place with frequent unwanted graffiti, to a work of art that embraces the community.David Mena said he and about seven artists have been painting the wall for about a month and it’s finally completed. It’s a celebration of the different types of people who live in the area, plus a look at the different cultures and ethnicities. From a depiction of the “tortilla lady” to the mascots from local schools, the art captures the spirit of a wide variety of types of people and brings a message of unity.“This is our peaceful protest and letting the community and everyone in San Diego county know that in these destructive times, we can build and we can move forward as a unit,” said Meno.He said he recruited youth in the area to help with the art as a way to inspire them and show them a positive influence.Mena said close to ,000 was donated by the community to help pay for supplies and food during the project. They put a coat over the paint that will help prevent graffiti. He said they’re not asking for money, but if anyone donated, he would give the money to the young artists. 1240
