A Japanese marketing company is giving its employees a very attractive reason to stay away from cigarettes.Piala Inc., based in Tokyo, made the decision last month to give non-smoking employees an extra six paid days off every year. Their reasoning? To balance out the time smoking employees spend away from their desks on cigarette breaks each day.According to the Japan Times, Piala CEO Takao Asuka said the idea came from an employee comment box submission at its office.“I hope to encourage employees to quit smoking through incentives rather than penalties or coercion,” Asuka?told the Japan Times.He was likely contrasting his approach with that of fellow Japanese company Lawson Inc., which recently banned all employees at its corporate headquarters from smoking during the work day.Since Piala introduced the measure, four employees have quit smoking, according to London's The Telegraph.Smoking is a major issue in Japan, with the country ranking among the world's highest in terms of smoking rates, according to the Washington Post.Clint Davis is a reporter for the Scripps National Desk. A district judge in California denied Netflix's attempt to have actress Mo'Nique's discrimination case against them dismissed on Wednesday and said the lawsuit can move forward.The decision was made in the Central District Court in California by U.S. District Judge Andrè Birotte, Jr.Mo'Nique is alleging that Netflix discriminated against her because of her race and gender by offering her a "lowball offer" to perform a one-hour comedy special and then retaliated against her when they “dug its heels in the ground” and refused to negotiate fair pay with her, according to court documents.In his decision, Judge Birotte said that Mo'Nique's allegations are "plausible.""Mo’Nique raises a novel theory here, namely that an employer’s failure to negotiate an “opening offer” in good faith, consistent with its alleged customary practice which typically leads to increased compensation, constitutes an “adverse employment action” for purposes of a retaliation claim," the judge noted.In her lawsuit, which she filed last year, the Oscar-winning actress says she the streaming service offered 0,000, but claimed they paid comedian Amy Schumer "twenty-six times more than her for the same one-hour comedy special on grounds that Schumer had sold out Madison Square Garden and had a recent movie released.""Regardless of whether the plaintiff will ultimately prevail on (her) claims, dismissing this case under Rule 12(b)(6) is not appropriate," the judge said in his decision. A mail carrier in West Virginia has pled guilty to attempted election fraud after trying to change the party affiliation on several ballots from Democrat to Republican.Thomas Cooper, who was charged in May, pled guilty Thursday, attempt to defraud the residents of West Virginia of a fair election and one count of injury to the mail, a statement from the Department of Justice said.Cooper delivered letters to Onego, Riverton, and Franklin, West Virginia, all of which are in Pendleton County.According to a statement back in May, a county clerk found that five ballots' party affiliations had been changed from Democrat to Republican, and three other ballots' request had been altered, but their affiliation had not been changed.Cooper said he made the changes as a joke, the statement in May said. 808

  

A California coffee shop refused service to a customer last week after he insulted a Muslim woman and her headscarf.According to KTLA-TV, the video was shot inside of a Coffee Bean & Tea Leaf store in Riverside, California on Friday. The video opens with a man standing in line for coffee."I said, 'Is this Halloween or something?" the man says."Why did you say that?" the woman filming asks."Why wouldn't I? Why wouldn't I?"The woman filming the encounter then pans over to show herself wearing a niqāb, a Muslim headscarf worn by women that covers all but a woman's eyes."What's wrong with me?" the woman asks again."I don't know, you tell me what's wrong with you," the man says.  705

  

A California police officer was charged Wednesday in connection with a fatal shooting at an Oakland-area Walmart store in April.San Leandro Police Officer Jason Fletcher was charged with voluntary manslaughter in connection with an incident where he fatally shot 33-year-old Steven Taylor on April 18.According to the Alameda County District Attorney's office, a security guard at the store called police when Taylor tried to leave San Leandro Walmart with a baseball bat and a tent without paying.Fletcher responded to the call and approached Taylor as he entered the store. The officer tried to grab the baseball bat from Taylor, and when he couldn't get control of the bat he drew his stun gun.After firing the stun gun, Taylor stumbled forward with the bat sitll in his hand. According to body camera footage, Fletcher repeatedly asked Taylor to drop the bat. Fletcher then fired his gun once, a shot that proved to be fatal.In its charging statement, the District Attorney's office, claimed that Taylor "posed no threat of imminent deadly force or serious bodily injury" to the officers or anyone else in the store because he had "clearly experienced the shock of the taser as he was leaning forward over his feet and stumbling forward."Fletcher's lawyer, Michael Rains, told the San Francisco Chronicle that he was "very disappointed" that the officer had been charged and that the charges were "undeserved."The decision to file the criminal complaint was made after an intensive investigation and thorough analysis of the evidence and the current law," Alameda County District Attorney Nancy O'Malley said.Lee Merritt, an attorney for Taylor's family, told NBC News that Taylor was experiencing a mental health crisis at the time of the shooting.Fletcher will be arraigned on Sept. 15 at a county courthouse in Dublin, California. 1845
