SAN DIEGO (CNS) - Police were searching today for two men suspected of being involved in a shooting on an Encanto street.A man and a woman were standing outside of a parked car on 59th Street near Market Street around 7:20 p.m. Saturday when two men approached them, San Diego Police Sgt. Michael Tansey said. One suspect pulled out a handgun and shot at the male victim, who was hit once in his right ankle. The two suspects ran away north on 59th Street, then west on KenwoodStreet. SAN DIEGO (CNS) - The California Supreme Court on Monday upheld the conviction of a death row inmate found guilty of hiring another man to shoot and kill his fiancee in Alpine 20 years ago.Michael William Flinner applied for a life insurance policy for 18-year-old Tamra Keck, then arranged for his former employee, Haron Ontiveros, to kill her on June 11, 2000, according to the ruling.The killing occurred shortly after Flinner met Keck and began dating her.According to the ruling, Flinner named himself as the beneficiary in the insurance policy, and falsely alleged Keck was an employee at his landscaping business whose death would cause him to suffer financially. Prosecutors alleged Flinner arranged for Ontiveros to meet with Keck at a gas station, then direct her to his car in a nearby cul-de-sac under the guise of having engine trouble. Once there, he shot Keck in the back of the head.Separate juries convicted Flinner and Ontiveros of murder and conspiracy and found true special circumstance allegations of killing for financial gain and lying in wait. Jurors recommended capital punishment for Flinner and life imprisonment without the possibility of parole for Ontiveros.In the appeal, Flinner's counsel alleged his case was adversely affected by issues that included limited access to defense counsel, which was allegedly restricted by Flinner's relocation from the downtown San Diego jail to the jail in Vista. Flinner's defense attorney at the time claimed the distance to Vista and other limits on telephone communication would hurt the defense's preparation for trial. According to the ruling, the relocation was implemented because Flinner obtained the home addresses of the prosecutor and trial judge through another inmate.The state Supreme Court found the claims had no merit, as the trial court permitted increased communication between Flinner and the defense team at the defense's request.Another claim alleged juror misconduct by one panelist who sought to write a book about the trial. Flinner's counsel alleged her objectivity may have been compromised as a result. The state Supreme Court disagreed, though it noted the juror had made misconduct claims about other panelists, which the high court also ultimately ruled were unfounded. 2276

  

SAN DIEGO (CNS) - Some low-level, non-violent inmates facing trials and being held in San Diego County jails are being considered for release in the wake of the coronavirus outbreak, the county's district attorney and sheriff announced Saturday."In the wake of an unprecedented Superior Court closure, the San Diego County District Attorney's Office and San Diego County Sheriff's Department took several proactive steps this week to address the threat of the coronavirus to individuals arrested for low-level, non-violent crimes who normally would have been released if the court was open or can't afford to post jail," the DA and sheriff said in a joint statement.The DA's office did not say how many inmates have already been released under the new policies nor how many are expected to be released.District Attorney Summer Stephan said she and the sheriff were concerned about defendants who are not an imminent threat to pubic safety, who are unable to post bail and would be forced to wait weeks or potentially months for their first court appearance because of the court being shut down.Cases involving people in custody are being reviewed and if no charges are going to be filed, the jail will be notified by the district attorney so the person can be released, the statement said."If charges are going to be filed, the district attorney is working with the sheriff and the court on an electronic pre-arraignment review to identify individuals whose charges are eligible for immediate release or bail reduction," a news advisory said."We're taking these steps because it's the right thing to do in the face of extreme circumstances that pose a serious health risk to inmates and everyone who has contact with inmates..." Stephan said.Other actions the district attorney said are being taken include:-- identifying those in jail who are awaiting trial or sentencing and may be eligible for release;-- prioritizing the release of vulnerable inmates who are "medically fragile" to determine if it is appropriate to ask the court to re-sentence them;-- allowing some people nearing the end of their sentence to be released early."People aren't going to get a free pass if they commit a crime," Stephan said. "This is about prioritizing and making thoughtful decisions based in fairness and equity during a time of crisis in order to relieve pressure on the system while protecting the public." 2405

  

SAN DIEGO (CNS) - Recent rainfall has led to an influx of seabirds washing ashore and becoming beached along San Diego's coast, the San Diego Humane Society said Friday.The organization's Project Wildlife program, which focuses on animal rehabilitation and conservation, has recently cared for multiple seabirds, including loons, western grebes and a blue-footed booby who became beached during periods of high surf and stormy weather.Seabird diets are also affected by rainfall as vacillating ocean temperatures cause their food sources to dive deeper than normal. Consequently, the birds are often too weak to get past strong coastal waves into the open ocean. Humane Society animal care staff recently transferred their rescued birds to SeaWorld for further rehabilitative care.Residents are advised to contact a lifeguard, the Humane Society's Humane Law Enforcement division at 619-299-7012, ext. 1, or SeaWorld at 800-541- 7325 if they see a beached or struggling seabird. Birds that are in immediate danger can also be wrapped in a towel and brought to Project Wildlife, located at 5433 Gaines St. 1112
