FALLBROOK (KGTV) -- A couple looking to buy a home in the North County wants to share an experience they're describing as negative as the new solar energy law goes into effect in 2020.The law requires that homes built in California starting in 2020 must have solar panels. It has caused confusion among potential homebuyers, like Brian and Carmen McKay. They recently left Las Vegas, looking to move back to San Diego County.“I used to work at Fallbrook skilled nursing many years ago,” said Carmen McKay. The couple found a home they liked in the Horse Creek Ridge development, a new housing project in Fallbrook.“When we realized it was a corner lot… oh my gosh, we loved it,” Carmen said.They were told the cost was roughly 5,000—which sounded like a reasonable price for San Diego, according to the McKays. That is when they say they got a surprise from the sales representative.“Then she says, by the way, once we were sold on the house and the price… there’s solar panels on the house. You have the option to lease it or buy it. And we’re like, why?” Carmen said.They said during the home tour, solar panels were not mentioned at all. Carmen said the sales representative only mentioned it when they were back in the office, ready to sign documents to buy the home. As the McKays were questioning solar, they were told “it’s required by the state.” That is only partially true. A spokesperson for the California Energy Commission told Team 10 that “the law only applies to homes that have been permitted after Jan. 1, 2020.”“If that’s not the case with the home in question that you mentioned, then the mandate does not apply,” wrote energy commission spokesperson Edward Ortiz.The McKays were told it would be about ,000 extra to buy the solar panels.“I think that it was misleading because we were buying a house that we were told it was 5, but it’s actually 5 or we’re paying a higher monthly out of pocket,” said Brian McKay.The seller knew they were on a time crunch.“We sold our property [in Nevada]. We’re at an AirBnB… we need to buy,” Carmen added.Nobody at the sales offices at Horse Creek Ridge would comment. Team 10 was directed to public relations. Through email, the spokesperson said:“Two separate state energy requirements guide D.R. Horton in its decisions regarding home design options in the state of California – the current State Energy Code requirements (commonly known as Title 24) and the State‐Mandated Solar requirements, which take effect in 2020. In most communities, we have found that solar is the best, most cost‐effective option for both D.R. Horton and our homebuyers to meet the current Title 24 Energy Code requirements. Thus, Horse Creek Ridge was designed using solar to meet the current Title 24 requirements, and as a result, we are required by the state to have solar on each home in the community.”When asked why that was not told to the potential homebuyers from the beginning, during the tour of the home, D.R. Horton spokesperson added that “solar requirements are communicated to customers via numerous marketing materials… and as an addendum to the home purchase agreement.” She pointed to an 8-page brochure, where solar is mentioned once on page 7. She also sent Team 10 an image of solar displayed on a model home—something the McKays said they never saw.There is no mention of solar or photos of any homes with solar on Horse Creek Ridge’s website. “I feel like I was deceived,” Carmen said. “We fell in love with the place. I felt like I was pushed in the corner.”Dan Zimberoff is an attorney not involved in this case, but he has seen solar disputes in the past. “A buyer needs to be aware,” Zimberoff said. “If you’re purchasing a new home and you see what that price is, ask the details. Is that really going to be the final price?” “We’re starting to remember why we left California,” Carmen said.The McKays ultimately decided not to buy the home. They hope their experience teaches others about the right questions to ask. “We were willing to pay the higher cost to live here, but I don't like being misled by builders,” Brian said. ESCONDIDO, Calif. (KGTV) -- Video shows a machete attack in Escondido that occurred earlier in February. According to Escondido Police, the attack happened on Maywood Street and Washington Avenue around 10:17 p.m. on February 12. Police say it appears three teenagers walking in the area were confronted with a machete-wielding man. FALLBROOK, Calif. (KGTV) -- Firefighters have stopped the forward rate of spread after a fire, dubbed the Fallsbrea Fire, sparked in Fallbrook Sunday afternoon. “Too many times, man” Chris Beucler sighed. He could not believe he was witnessing yet another wildfire approaching his home. "I looked out the window, and just beyond our lots down here I see a huge flame up in the air,” Beucler said. Early Sunday afternoon, Beucler and his wife were putting up artwork in his home, when the flickers brought back memories. It seemed like just yesterday, he experienced the Lilac Fire, which destroyed many of his neighbor's houses. The Lilac Fire started on December 7, 2017. The 4,100-acre blaze destroyed 157 and damaged 64 structures. "I've been up here 16 years, and this is probably the sixth time these things have happened. So it's just high alert all the time,” Beucler said. Cal Fire and North County Fire responded to the scene of the Fallbrea fire that sparked near Highway 76 and Ramona Drive around 12:30 p.m. When they arrived, the fire was only about a half-acre. But it quickly spread up the slope to about five acres. While the region is under a Red Flag warning, flames spread before gusts took over North County, Cal Fire said. "Make no mistake about it, while we are expecting a red flag condition to take hold of the county, we are not under those conditions as we speak,” Cal Fire San Diego Captain, Issac Sanchez said. “This was absolutely slope and fuel driven. Mostly burning in grass, which burns very quickly and very hot.”Firefighters are expecting conditions to worsen and to work overtime. But for now, veteran wildfire survivor Beucler is relieved. The walking trail that he created six years ago and preps twice a year saved his home once again. "We got a natural firebreak that we built for a trail to go around our house, and they're saying that's what saved our part,” Beucler said. According to Cal Fire, several structures were threatened, but the forward rate of spread has been stopped. The fire was 100 percent contained by about 4 p.m. The cause is under investigation. 2216
ESCONDIDO, Calif. (KGTV) - Plans are underway to reinvigorate Escondido's historic downtown, with new businesses and plans to make the area more pedestrian friendly. One of the new ventures is the first-of-its-kind. "Escondido now has really started to invest a lot of time, a lot of effort, and they're putting a lot of money into the downtown district," said Nick Corona, a nationally recognized homebrewer who lives in San Marcos.When Corona started homebrewing in 2012, the dream was always to start a brewery, which he named Five Suits Brewing. Now that dream is coming true in a way he couldn't have envisioned back then. "We're looking to hopefully become a little bit more of a draw for Escondido."The plan is to house four different businesses under one roof, three of which are craft beverage manufacturers: beer, gin, and mead.The gin distillery is Stoke Distilling Co. and the meadery is Good Omen. "Nobody else in California and I don't even think in the U.S., has a storefront place that you can go to that has a brewery, a winery, and a distillery, with a restaurant all in the same location," said Brian LaMere, Owner of Good Omen.The owners of Carlsbad's Notorious Burgers will be supplying the food, which will consist of craft tacos and Mexican street food. The project is still waiting on approval from the alcohol and beverage agencies, but Corona says they've identified a 14,000 sq/ft property on Grand Ave. "It will be a destination, there's no doubt about it," said Corona. As far as making downtown more friendly to pedestrians, city planners say there are plans to widen the sidewalks, create more parking, and add art. Corona says he's excited for the future, "We're proud of our brand, we're proud of what we're bringing, but for me personally I just want to bring people something that opens their eyes." 1842

(KGTV) -- Wednesday morning, more than 110,000 signatures were turned in in an effort to put a housing project in North County in front of voters.The signatures were gathered by the “No on Newland Sierra” committee in 17 days.
