Sears has won some more time to save itself. But not a lot more time.At a bankruptcy court hearing Thursday, Judge Robert Drain approved Sears' plan to auction off about 500 stores. The auction is central to the company's mission to remain in business. Sears intends to use funds from the sale for its operations, and it will pay rent to the stores' buyers so they can stay open.A committee of Sears' creditors had objected to the plan and argued that the company should immediately start the process of going out of business to limit its ongoing losses.Judge Drain said he will hold another hearing a week before Christmas to consider whether to go ahead with Sears' effort to stay in business or start the process to close all its remaining stores. Drain said it wasn't realistic to start a liquidation process immediately."You can't do a GOB [going out of business] plan for a company this big by snapping your fingers," he said. "Let's come back to court [in December] and see what the lay of the land is."Sears' attorneys conceded was a chance the company might not be able to survive."We recognize we have a tough path ahead of us to save the company," said Sears attorney Ray Schrock. "We're not blind to that fact."Schrock said the upcoming holiday shopping season is a crucial period for Sears, and the company believes it will at least be able to break even in the fourth quarter. The creditors' attorney expressed doubts that the company will be able to stay in business. But he said they could live with waiting until December for a decision on Sears' future.Sears also disclosed in a filing late Wednesday that it has arranged for an additional 0 million loan to fund operations during the bankruptcy process. That loan is a crucial component of the company's ability to stay in business, according to a filing the company made on the first day of the bankruptcy process, but it has taken a month to lock-up the funding. The loan is from Great American Capital Partners, rather than ESL, the hedge fund controlled by Sears Chairman Eddie Lampert. When Sears first filed for bankruptcy, it said that it anticipated the loan would come from ESL, but creditors have objected to a the series of insider deals between Sears and Lampert. 2303

SANTEE, Calif. (KGTV) - Doorbell camera video of a coyote following a man on a dog walk in Santee may be another example of coyotes becoming more aggressive in the area.On Monday after 9 p.m. on a quiet residential street, Ring doorbell camera video captures a man walking his dog. Moments later, something emerges from the shadows. It a coyote, and it's in an hurry. The video posted on the Ring app is titled "Beware coyote chasing a man with dog." That's exactly what appears to be happening. In the video, the coyote runs down the street before cutting in the man's direction. It's not clear if the coyote did catch up to the man or dog.Last week, 10News reported on Michelle Cimmarrusti's morning walk with Presley, an 8-year-old Silky Terrier. It unfolded on Palm Glen Drive, about a half mile from the site of the newest video. Two coyotes emerged from a bush and attacking Presley, while he was on his leash. Presley lunged, snapping his collar. He and the coyotes would end in a condo complex, where Presley was killed.Presley was the second dog killed by a coyote in the neighborhood in the last few weeks. Experts say coyotes attacking a leashed dog is a sign they're getting more aggressive in an area, and less afraid of humans, whether is food scarcity or the unintentional feeding of coyotes. 1315

SAN YSIDRO, Calif. (KGTV) -- Dozens of migrants seeking asylum in the United States are being processed Tuesday afternoon, according to an attorney.Eight migrants were allowed in for processing Monday night followed by dozens more Tuesday afternoon and evening. The rest of the migrant caravan is waiting in Tijuana to be allowed in and processed. The attorney, who is working with the group of migrants, said members of the caravan were asked to choose among themselves who would be processed.MAP: Where is the migrant caravan from?Women and children were reportedly in the first groups of migrants selected Monday and Tuesday. An official with U.S. Customs and Border Protection said that, although this group of migrants has been gaining national attention, the process the group is going through is standard. As far as the process the migrants are going through, CBP said that individuals who don’t have proper travel documents and try to enter into the U.S. may be subject to expedited removal.PHOTOS: Migrant caravan makes way to U.S-Mexico borderThose in expedited removal who express fear of return are then referred to United States Citizenship and Immigration Services.Migrants then go through a “fear interview” to determine whether or not they have a credible fear of persecution or torture. The San Ysidro border inspection facility can hold 300 people. Between October of 2017 and February of 2018, 8,000 asylum cases were processed.RELATED: Migrant caravan waiting for entry at US-Mexico borderAccording to a CBP spokesperson, port capacity at San Ysidro is dependent on holding space, volume of traffic, officer resources and complexity of cases among other factors.“CBP is committed to maintaining security and meeting the health and safety needs of those persons in our custody, the traveling public, and officers and personnel. At times, this has required us to limit the number of people we can bring in the port facility for processing at a given time, including in 2016 when an influx of Haitians arrived at the California border, and as recently as within the past six months. In recent days, San Ysidro has exceeded port capacity due to an increase in arrivals of undocumented persons making asylum claims or presenting complex cases. Accordingly, CBP has had to limit the number of new arrivals for processing. CBP will continue to work with its interagency partners at ICE to ensure continued management of persons presenting without documents and appropriate care and custody of all those in our facility,” the spokesperson said in part.Migrants with the caravan have made their trip to the U.S.-Mexico border from three different countries in Central America. SANTEE, Calif. (KGTV) — Hundreds gathered in Santee on Saturday to call for justice for women of color.A flyer for the march advertised "promoting black and brown unity" and justice for Breonna Taylor and Vanessa Guillén.Breonna Taylor was an EMT who was shot and killed during a no-knock warrant against her boyfriend at her home in March. No drugs were found in her apartment.Vanessa Guillén was a 20-year-old Army specialist who disappeared in April from Fort Hood in Texas. Remains believed to be hers were found near the Army post in July, sparking protests over the military's handling of sexual harassment allegations.A section of Mission Gorge Rd. was blocked off by police for the planned protest. Counter-demonstrators also assembled in the area. One of the demonstration's organizers told ABC 10News that they hope their calls for racial justice are heard by Santee's City Council leaders."Santee has its things, it's known as being racist, and I'm here to change that. That's the goal," said Alana, one of the organizers with East County BIPOC, who adds that she is born and raised in Santee. "We tried to work with City Council and we tried to be a part of a diversity committee, and it was kind of just brushed under the rug. Nothing ever happened."The group is also calling for City Council to create a diversity committee led by people of color, for Santee Mayor John Minto to denounce the Defend East County Facebook group, and to meet with San Diego Sheriff's Department Captain Christina Bavencoff. One demonstrator told ABC 10News, "our message is that minorities can be safe here. I grew up here and there is racism but there's also perks to living in Santee. The community, when they accept you, can be good. But also for minorities, to feel comfortable and to expand all of our minds and to open up about Black Lives Matter as well."In regards to counter-protesters, the demonstrator added, "We're not here for them. They came here for us, clearly." 1978
