SAN DIEGO (CNS) - As his trial entered its eighth week, a man who shot at officers from his ex-girlfriend's condominium in Bankers Hill pleaded guilty to four counts of assault with a firearm on a peace officer and agreed to a 20-year prison sentence, it was confirmed Thursday.Titus Colbert, 36, faces formal sentencing May 18 before Judge Louis Hanoian.Deputy District Attorney Michael Runyon was about to wrap up his case when Colbert decided to plead guilty Monday afternoon.Charges of premeditated attempted murder of a peace officer and assault with a semiautomatic weapon were dismissed.RELATED: Suspect in Bankers Hill standoff that shut down Lindbergh Field in courtRunyon said in his opening statement that Colbert took two rifles and a revolver belonging to his roommate in Las Vegas and showed up at his former girlfriend's condo in Bankers Hill a few days before his Nov. 4, 2015, arrest.According to Runyon, the morning of the shooting, Colbert's ex- girlfriend Ashley Davies realized that he'd had broken into her complex and sent him a text saying: "You're trespassing! You're going to jail!"Colbert responded by texting, "(Expletive), I'm going to be a star. (Expletive) you for putting my life in danger," the prosecutor said.When officers responded to Davies' sixth-floor condo near the roof of the complex, a shot rang out from behind her door and an officer returned fire, according to Runyon.The prosecutor said officers retreated and more shots were fired at them and members of a SWAT team.Hours later, police observed a rifle, revolver and a magazine for a rifle being thrown out of the window where Colbert was holed up, Runyon said.After Colbert's arrest, officers found 17 expended casings and another rifle under a pile of clothes in the room, the prosecutor said.Even though traces of cocaine and methamphetamine were found in Colbert's system, and even though he had a history of mental health issues, the defendant knew what he was doing that day, Runyon said.Defense attorney Melissa Tralla told the jury that Colbert had a psychotic break and was paranoid and delusional. She said that days before, Colbert had called Davies at least 50 times and was not acting right.Colbert was rambling, saying he had special powers and was part of the New World Order, Tralla said.The attorney said Colbert was showing signs of mental illness by age 6, and was diagnosed with schizophrenia by age 15. Tralla told the jury that Colbert did not intend or plan to kill officers that day. 2518

SAN DIEGO (CNS) - A San Diego-based telemarketer was fined nearly million by the Federal Communications Commission Wednesday for making more than 47,000 robocalls over a two-day period leveling false accusations against a local state Assembly candidate and manipulating caller ID information to appear as though a competitor was making the calls.Kenneth Moser and his company, Marketing Support Systems, were fined ,997,750 for making the calls on May 30 and May 31, 2018, about one week prior to the primary election, in which Philip Graham unsuccessfully sought to represent the 76th Assembly District.Shortly before the primary, a woman accused Graham of kissing her against her will in an Encinitas bar, triggering a sheriff's department investigation that concluded the claim was unfounded. Nichole Burgan, the woman at the heart of the allegation, later pleaded guilty to filing a false report.According to the FCC, the robocall messages repeated Burgan's claim and caller ID information was manipulated to make the calls appear as though they originated from another telemarketing company, HomeyTel, described as a competitor to Moser's company. As a result, HomeyTel received "a multitude of angry complaints" from people who received the calls, as well as a cease-and-desist letter from Graham, according to the FCC.The agency said 47,610 robocalls were made during the two-day period, with multiple calls sometimes sent to the same recipients.The calls violated the Truth in Caller ID Act prohibiting manipulation of caller ID information -- otherwise known as spoofing -- with the intent to defraud, cause harm or wrongfully obtain anything of value, according to the FCC. 1697

SAN DIEGO (CNS) - A suspected hit-and-run driver who allegedly struck and gravely injured a bicyclist last month in the Midtown area was arrested in a shopping center parking lot in Kern County, it was reported Wednesday.San Diego police identified the suspected driver last week as Mauricio Flores and also released the name of a woman, Jessica Bailey, suspected of riding in the van with Flores.The pair were in a 2005 Dodge Caravan with Georgia license places that struck a bicyclist around 1:30 p.m. on Aug. 21 on West Washington Street at India Street in the Midtown area, police said.RELATED: Bicyclist sustains life-threatening injury in hit-and-runThe victim suffered a life-threatening head injury and remains in the hospital, the San Diego Union-Tribune reported.In video shot by a witness and released by San Diego police, the driver could be seen stopping after the collision and getting out of the van.The video then showed the driver and passenger going to the injured man on the side of the road before the driver tugs the bent bicycle out from under the front of the van and sets it aside. He and the female passenger then got back into the van and drove away.A second passenger in the van has not been identified by police and no description of the man has been disclosed.An off-duty CHP officer who saw a flier about the collision spotted a suspicious looking van bearing CA exempt plates, typically used by state-owned vehicles, while riding his motorcycle in the Lake Isabella area over the weekend and notified the local office, CHP Officer Robert Rodriguez told the Union-Tribune.The officer assigned to that area -- roughly 35 miles northeast of Bakersfield -- went looking for the van early Tuesday morning and found it in a Vons parking lot, this time with Vermont license places, Rodriguez told the newspaper. With the assistance of Kern County sheriff's deputies, the officer located Flores and Bailey nearby and arrested them. 1962

  

SAN DIEGO (CNS) - A Utah man who robbed a Carlsbad Motel 6 at gunpoint, then was arrested attempting to re-enter the United States, was convicted of federal robbery and firearm-related charges, the U.S. Attorney's Office announced Wednesday.Lance Lamont Lavert of Salt Lake City, 37, was convicted Tuesday by a San Diego federal court jury for the July 9, 2018, morning robbery of the motel on Paseo Del Norte.Prosecutors said Lavert and his girlfriend asked for a room, but were denied due to a lack of ID.Lavert then pointed a gun at the motel clerk and her manager, demanding money. When the clerk and manager ran, Lavert leapt over the counter, kicked in the door of the bathroom where the clerk was hiding, dragged her back to the cash register by her hair and pistol-whipped her in the head, court documents state.Along with 5 in cash, Lavert and his girlfriend made off with the clerk's car keys and stole the clerk's car, prosecutors said.Lavert was arrested two days later trying to cross the border back into the United States. The revolver he used in the robbery was found in his waistband.In addition to committing the robbery, Lavert was convicted for possession of a gun while having several prior felony convictions, including for arson in Utah and assault with a deadly weapon out of Imperial County, the U.S. Attorney's Office said.Lavert's girlfriend pleaded guilty prior to the trial, according to prosecutors. 1440

  

SAN DIEGO (CNS) - Monday is the deadline for San Diego County residents to register to vote in the Nov. 3 election.County residents will need to register or re-register to vote if they are not registered in San Diego County, recently moved or changed their name.County residents can check their registration status online at sdvote.com.If they are not registered or need to change their registration, they will be able to complete an online registration form.If their signature is confirmed through records at the Department of Motor Vehicles, it will automatically be sent to the Registrar of Voter's office.If a signature is not confirmed, the form can be printed out, signed and returned to the registrar's office at 5600 Overland Ave. in Kearny Mesa by 8 p.m. on Monday.Registration forms are also available at the offices of the U.S. Postal Service, City Clerk, public libraries and Department of Motor Vehicles.Election materials are also available in Spanish, Filipino, Vietnamese and Chinese.Registration forms must be postmarked or delivered to the Registrar of Voters office by 8 p.m. Monday. Voters may also register online until midnight.If you miss the deadline to register, you may still conditionally register and vote provisionally through Election Day.Early voting is underway at the registrar's office in Kearny Mesa.
